A RESOLUTION OF THE BOARD OF DIRECTORS OF
SOUTH TAHOE PUBLIC UTILITY DISTRICT
AWARDING CONTRACT FOR THE
SOUTH TAHOE PUBLIC UTILITY DISTRICT
EMERGENCY RETENTION BASIN SEALING PROJECT - 1988
EPA PROJECT NO. C-06-1414-12
BE IT RESOLVED by the Board of Directors of South Tahoe
Public Utility District as follows:
1. Notice was given for receiving bids tor the
South Tahoe Public Utility District, Emergency Retention Basin
Sealing Project - 1988, EPA Projeot No. C-06-1414-12, and four
bids were received at the time ana place specified, at 3 :00
P.M. on Thursday, June 2, 1988, and pUblicly opened.
2. said Board of Directors at its meeting on June
24, 1988 reviewed the bids and determined that Ford Construc-
tion Company, Inc., the apparent low bidder for the work ot the
South Tahoe Public Utility District, Emergency Retention Basin
Sealing Project - 1988, EPA Project No. C-06-1414-12, submitted
a non-responsive bid and, therefore, was not the lowest,
responsive, responsible bidder.
J. Thereafter, said Boara of Direotors at its
meeting on June 24, 1988 reviewed the next lowest bid of Alta
Pacific Constructors, Inc. and found that said bid was the
lowest, responsive, responsible bid for the work of the South
Tahoe Public Utility District, Emergency Retention BAsin Seal-
ing Project - 1988, EPA Project No. C-06-1414-12.

4. Ford Construction Co~pany, Inc. protested to
the Regional Administrator, Region IX, O. S. Environmental
Protection Agency, the award to Alta pacific Constructors, Inc.
5. On September 21, 1988, the Regional Ad-
ministrator remanded this matter to the District to determine
whether Ford Construction Company, Inc. is a responsible bid-
der. The Regional Administrator further concluded that the
District, in making a determination of ~heth8r Ford Construc-
tion Company, Inc. is a responsible bidder, should review all
relevant MBE/WBE compliance information, including Ford's per-
formance and post-bid documentation of its positive efforts
toward utilization of MBE/WBE businesses.
6. The Board ot: Directors previously determined
,
that Bid Alternate A in the specifications and Contrac~ Docu-
ments for the South Tahoe PUblic Utility. District, Emergency
Retention Basin Sealing Project - 1988, EPA Project No. C-06-
1414-12 shall not be accepted.
NOW, THEREFORE, BE IT RESOLVED by the Board of Direo~
tors of South Tahoe Public Utility District:
1. It is now further determined upon r.man~ from
the Regional Administrator, Region IX, U. S. Environ..ntal
Protection AgttnCY, that after review of all relevant MBE/WBE
compliance information I including Ford Construction Company,
Inc.'s performance ana post-bid documentation of ita positive
efforts toward utilization of MBE/WBe businesses, it is hereby
determined that the bid Ford Construction company, Inc., 639

East Lockeford street, Lodi, CA, 95240 is a responsible bidder
for doing the work and furnishing the materials, supplies, and
equipment for the South Tahoe PUblic utility District, Emer-
gency Retention Basin Sealing Project - 1988, EPA Project No.
C-06-1414-12 in accordance with the Plans and Specifications
prepared by the District Engineers, John Carollo Engineers, and
Contract Documents and Bid Documents dated 1988, as amended by
Addendum No.1 dated April 21, 1988, Addendum No. 2 dated May
12, 1988, Addendum No. 3 dated May 18, 1988, and Addendum No. 4
dated May 24, 1988.
2. It is now further determined upon remand from
the Regional Administrator, Region IX, U. S. Environmental
Protection Agency, that tha bid of Ford Construction Company,
Inc., 639 East Lockeford street, Lodi, CA, 95240 is the lowest,
responsive, responsible bid~er for doing the work and furnish-
ing the materials, supplies, and equipment for the South Tahoe
PUblic Utility oistrict, Emergency Retention aasin Sealing
Project - 1988, EPA Project No. C-06-1414-12 in acoordanoe with
the Plans and specifications prepared by the District En-
gineers, John Carollo Engineers, and Contract Documents and aid
Documents dated 1988, as amended by Addendum No. 1 dated April
21, 1988, Addendum No. 2 dated May 12, 1988, Addendum No. 3
dated May 28, 1988, and Addendum NO. 4 dated May 24, 1988.
3. Said Board of Directors does hereby award said
contract, subject to State Water Resources Control Board and
Environmental Protection Agency approval, for doing- the work

and furnishing the materials, supplies, and equipment necessary
for the South Tahoe Public Utility District, Emergency Reten-
tion Basin Sealing Project - 1988, EPA Project No. C-06-1414-
12, to Ford Construction Company, Inc. at the price namea in
its bid of One Million Two Hundred Thirty-Nine Thousand Dol-
lars, ($1,239,000.00) without Bid Alternate A.
4. The Chairman of said Board of Directors is
hereby authorized to make and enter into a written contract
with said successful bidder, Ford Construction Company, Inc.,
and to receive and approve all bonds in connection therewith,
and the Clerk is hereby directed to attest to said Chairman's
signature and affix thereto the corporate seal of said ois-
trict, all in accordance with the Plans and specifications, and
the special conditions and notice to bidders thereto approved
and placed on file with the District, all subject to State
Water Resources Control aoard and Environmental Protection
Agency approvals.
PASSED AND ADOPTED by the Board of Directors of South
Tahoe Public Utility District at a duly held adjourned regular
meeting on the 13th ~ay of October, 1988 by the following vote:
AYES: Directors Mason, Jones, Olson, Walker, Sinclair
