The Echo Creek Ranch project proponents (Blaise D'Angelo, Alex Graf, and Paul
Gardner) attended yesterday's Operations Committee meeting to discuss two requests: 1)
That the District take over the maintenance on the portion of waterline that will be in the
public right-of-way; and 2) If the District would assist financially with the project by funding
the portion of the waterline to be located in South Upper Truckee Road.
As a result of the Operations Committee meeting, it is the committee's and staffs'
recommendation that adopting the maintenance of the waterline located in the public
right-of-way should be considered. They do not recommend that the District participate
financially in the project.
Mr. D'Angelo called today to say that they only have one request for the Board to consider
Thursday— that the Board render a decision regarding maintaining the portion of
waterline that is in the public right-of-way. Since the Operations Committee's
recommendation was that the Distri�t shouldn't participate in the funding aspect of the
project, he will eliminate that component from their request on Thursday.

Subject: Echo Creek Ranch Site
The following memorandum summarizes the results of an initial evaluation of the subject site. The
purpose of this evaluation is to ascertain whether the Echo Creek Ranch site could potentially be
used by the District as a site for a new drinking water production well.
BACKGROUND
On November 12, 2001, an Operations Committee Meeting was convened, along with the owners
(Alex Graf and Paul Gardner) and owner's consultant (Blaise D'Angelo, JWA Consulting
Engineers), regarding the proposed Echo Creek Ranch Recreational Facility. One of the topics
discussed involved a proposal by the property owners to allow the District to potentially site a new
drinking water well on the Echo Creek Ranch property.
In order to provide an initial evaluation of the properiy for potential drinking water development, it
was agreed that the property owners would provide the District with any available documentation
describing the construction, water production and water quality of any existing wells located at the
site. It was also agreed that the property owners would allow the District to collect samples from
one of these wells (Echo Creek Ranch Well No. 2) , in order that our own water quality analyses
could be completed.
On November 13, 2001, Dolores Trebotich and myself collected water samples from the No. 2
Well, as observed by Alex Graf. The well was pumped for approximately 15 minutes prior to
sample collection in order to get a representative sample from the water producing zone. It is
estimated that approximately 560 gallons (or about 3.75 well volumes) were pumped from the well
prior to sampling. The collected samples were subsequently analyzed for general water chemistry
and the fotlowing metals: arsenic, iron and manganese.
FINDINGS & RESULTS
► The Echo Creek Ranch property is situated approximately 2,000 feet north-northwest of the
Flenderson Test Well. The property is located between US Highway 50 and Old Meyers
Grade, west of South Upper Truckee Road. The site has two existing water supply wells,
informally referred to as the Echo Creek Ranch No. 1 and No. 2 Wells.
► The Echo Creek Ranch No. 1 Well is believed to have been completed sometime during
or before 1991. It is an 8-inch diameter well completed to a depth of 77 feet. In March 1991,
a 4-hour production test for this weil showed a yield of 40 gailons per minute (gpm).
Available water quality information showed that total iron was about twice the secondary
maximum contaminant level (MCL). This well is no longer actively used.
► The Echo Creek Ranch No. 2 Well was completed in February 2001. This is a 6-inch
diameter well completed to a depth of 182 feet. The well driller's completion report indicates
that this well produces from inter-layered volcanic mud flow and stream deposits at a depth
of between 170 to 182 feet. Basin-fill materials overlie these inter-layered deposits and
occ�r from ground surFace to a depth of about 80 feet. The inter-layered volcanic deposits
are typically grouped with the bedrock materials underlying the basin-fill aquifer. In February
2001, a 4-hour production test for this well showed a yield of 18 gpm. During recent
sampling, the well produced at a calculated rate of about 37.5 gpm.
► Results of analyses perFormed on the Echo Creek Ranch No. 2 Well water samples shows
a Calcium Bicarbonate water type, with relatively low alkalinity. Arsenic levels were about
five times greater than the primary MCL. Total iron levels were more than six times greater
than the secondary MCL (see attached summary}.
CONCLUSIONS
► Well information provided by the properly owners and results of recent water quality
analyses indicate that the Echo Creek Ranch property is not a viable site for drinking water
` well development. The basin-fill aquifer is relatively thin at this location and anticipated
yields from this aquifer are relatively low. Anticipated well yield from the underlying bedrock
aquifer is also relatively low. Results of available water quality test data indicates that
groundwater from both the shallow and deep water aquifers underlying this site, does not
meet California drinking water standards.

The curjent limit for arsenic is 50 Ng/L; in 2006 the limit will be reduced to 10 Ng/L. It is
a primary maximum contaminant level (MCL)and is health-based.
Iron has a secondary MCL of 300 �g/L. Secondary MCL's are set to assure a supply of
aesthetically pleasing water. Iron and manganese at levels above the MCL will cause
red or brown staining of plumbing fixtures and laundry.

Project Ovcrview
The Project Iocation is the Ech� �reek Ranch property (APN 035- 010- 23) located at the base of
Echo summit; lyins more specifically between U.S 50 and Old Meyers Grade, and south of 5outh
Upper ?ruckee Rd. The Project, termed the Echo Creek Group Center, wi11 consist of tw�

buildings, totaling approximately 35,000 sf, which will function as a group center for retreats or
similar special event functions. The Project site has one existing st�ucture which is �erved from an
existing on- site well.
Due to the substantial increase in floor space in the Project, and because the Project will function
as a commercial facility when completed, the Fire Marshall has required the installation of a fire
hydrant at the entrance to the Project, in addition to the installation of fire sprinklers within the
buildings. While the Owners possess substantial water rights from Echo Creek, the installation of
a wdter treatment system, and a designated fire suppression storage tank on site with fire drivers,
required for a commercial enterprise would prove to be cost prohibitive and would require
significant annual maintenance costs.
Fur this reason, attention has turned to connecting to STPUD's system. However. Connection
to �TPUD's system will require special consideration; as i}�e shortest aiternative would require
the si�nificant structurai feat of crossing a pristine Echo Creek. While technically feasible, the
rrnite would be costly, environmentally sensitive, and leave a crossinb which would be vulnerable
potcntially to falling trees, insurance claims stemming from trespassers falling off crossing, and
unc�ermining of the crossing in a major flooding event.
, Uc�cription of Alternatives �
In �rder to provide adequate fire flow to the Project, on the assumption that service would be
provided by $TPUD, tha following three alternative alignments were considcred:
Alternative A: South Upper Truckee Rd. Approach. While several hundred feet longer
than the following alternative, this alignm�nt would start at the intersection of U. S. 50 and
S. Upper Truckee Rd., and extend along S. Upper Truckee Rd. to Old Meyecs Grade.
'1'he alignment would then proceed south along Old Meyers Grade to the entrance to the
Project. While a creek crossing would also be requu�ed in this alternative, the north side of
the existing South Upper Truckee bridge at Echo Creek appears to provide a straibht
forward method of crossing, and would not present near the technicat chalen�es for a
Creek crossinb, as posed in Alternative B,
Alternative B: Bridge Crossing across Echo Creek, south ofKOA campground. White
the shortest alibnment on paper, a significant impediment to the feasibility of this
alternative is the need for a new bridge to support t}�e water line � the Creek. The
crossing wouid be approximately l UU feet long. Directional borinb and open excavation
are not feasihle here due to the pristine nature of the Creek, the depth of the creek channel
at this location, and the fact that numerous large boulders are visiUle within and
surrounding the Creek. While it is technically possibJe to engineer and construct a bridge
- to suit the crossing, the permitting facets of such a project lead the Project Team to look
- ' to a more conventional approach, as outlined in Alternative A.
Alternative C: Extend and Inter-tie Christmas Valley and Flagpole Zones. This

STATEMENT OF INVESTMENT POLICY
I. Statement of Intent
This statement of investment policy is adopted to establish an overall policy and
procedures for the management and investment of surplus or idle funds of the South
Tahoe Public Utility District. This policy is effective as of its adoption by the Board of
Directors. It will be reviewed by the Boazd and readopted at least once each yeaz.
II. Scope of Policy
This policy covers all funds and investment activities under the direct authority of the
District. It does not cover funds related to District borrowing, which aze controlled by
documents related to each debt issue.
IIL Objectives
The basic objectives of the District's investment policy aze, in order of priority:
■ Safety: Investrnents shall be made in a manner which first seeks to ensure the
preservation of capital in the overall portfolio. Each investment transaction shall
seek to Srst ensure that capital losses are avoided, whether they be from securities
defaults or erosion of market value.
■ Liquidity: Investments shall be made whose maturity date is compatible with cash
flow requirements. An adequate percentage of the portfolio should be maintained in
liquid short-term securities which can be converted to cash if necessary to meet
disbursement requirements. Since all cash requirements cannot be anticipated, in-
vestments in securities with active secondary or retail markets is highly recom-
mended. Emphasis is on mazketable securities with low sensitivity to mazket risk.
■ Return on Investment: Yield should become a consideration only after the basic
requirements of safety and liquidity have been met.
■ Diversification: The investment portfolio shall be diversified to avoid incurring
unreasonable and avoidable risks regarding specific security types or individual
financial institutions. The portfolio shall also be diversified with respect to the term
of individual investments purchased by the District.
■ Public Trust: All participants in the investment process shall act as custodians of
the public trust. Investment officials shall recognize that the investment portfolio is
. subject to public review and evaluation. The overall program shall be designed and
> managed with a degree of professionalism that is worthy of the public trust.

■ Term of Investments: The term of any investment may not exceed three yeazs
without express authority from the Board of Directors for each such investment.
■ Prohibition on Fioating Rate: The Disfict may purchase U. S. government securi-
ties which are discount or securities bearing interest at a fixed rate; no floating rate
securities may be purchased for investment of District funds.
■ Investment Poticies of Pools: The District shall review at least annually the invest-
ment policies of LAIF and the El Dorado County investment pool to ascertain that its
funds in these pools aze invested in accordance with the District's investment objec-
tives. The Disfict shall also review the provisions of these investment policies
requiring intemal controls on the investment process to ascertain that there is a
division of responsibility in the investment procedures. The District sha11 not invest
in pools which do not provide adequate information on their investment policies and
practices.
IX. Leveraging
, No representative of the District is authorized to engage in margin transactions nor
',, reverse repurchase agreements or any other form of borrowing money for investment
purposes under any circumstances.

X. Banks and Securities Dealers
In selecting financial institurions for the deposit or investment of District funds, the
Chief Financial Officer shall consider the creditworthiness of institutions. The Chief
Financial Officer sha11 continue to monitor financial institutions' credit characteristics
and financial history throughout the period in which District funds are deposited or
invested.
Each financial insritution must certify to the District in writing that it has received and
read a copy of the District's investment policy and that it will comply with that policy in
its investment recommendations to the District.
XI. Ethics and Conflicts of Interest
Oi�cers and employees involved in the investment process shall refrain from personal
business activity that could conflict with proper execution of the investment program, or
which could impair their ability to make impartial investment decisions. Such
employees and investment officials shall disclose to the District Boazd and the General
Manager any material financial interests in financial institutions that conduct business
within the District, and they shall further disclose any lazge personal financiaUinvest-
ment positions that could be related to the performance of the District's portfolio.

REQUESTED BOARD ACTION: Authorize staff to send letters to the Governor and the
California Legislature in support of having California tax law comply with EGTRRA
DISCUSSION: New federal deferred compensation plan provisions of EGTRRA have currently
not been adopted by the State of California This will complicate the District's tax reportinq and
our employees' tax reporting of deferred compensation. A number of organizations are workin,g
with the State legislature to have a bill introduced when the session begins in January (retroactive
to Januarv 1, 2002).
If California dos not conform theirtax code to EGTRRA. it could have significant implications
for the District and other California local governments that are in the process of updating their 457
deferred comaensation plans.
Here are some of the possible ramifications:
(1) Contributions by 457 plan participants in excess of the pre-EGTRRA contribution limits
could be considered excess contributions for state income tax purpose For example amounts
. contributed over $8.500 (as indexed) to a 457 plan in 2002, could be permitted forfederal income

tax purposes but considered excess contributions for state tax purposes;
(2) Contributions made by a 457 plan participant based on EGTRRA "age 50 catch-u�
provision also could be considered excess contribution for state income tax purposes:

taxable distributions for state income tax purposes. For example, a rollover in 2002 by a 457 plan
participant to a Traditional IRA could be considered a taxable distribution for state income tax

Due to the State's current budget shortfall there is concern that there mav be some

DISCUSSION: On 11/15/01, the Board authorized staff to enter into an agreement with
Zavidow-Shows Insurance Service Network. Inc.. to provide Prescription drug Card Plan benefits
through PAID Prescriptions (ZS Paid Prescriptions). effective January 1. 2002.
Staff has reviewed the template Agreement provided by ZS Paid Prescriptions (ZS). and
obtained verbal understandina of the provisions of the Agreement. Staff then prepared a
proposed revision to the Agreement which documented verbal agreements, and which added
standard, generic, contract language. ZS Paid Prescriptions would not accept the proposed
Aareement chanaes without review by their legal counsel, whose fees ZS was unwillina to pay.
ZS Paid Prescriptions has therefore elected to decline accepting the District as a client.
The District had not yet remitted the $7.770 deposit for claims reserves. pendinq acceptance
of the Agreement. Although some savinqs were expected to be realized by changing to ZS Paid
Prescriptions, staff is not comfortable with an Agreement which does not clearly state a rq eed upon
terms, and which does not have standard contract language.
Staff therefore recommends continuing prescription benefits through the current provider.

DISCUSSION: The Economic Growth and Tax Relief Reconciliation Act of 2001 (EGTRRA)
requires certain changes be made to the District's Plan to be in compliance with the current
Internal Revenue Code. In addition, EGTTRA has certain optional provisions that allow a larger
amount of voluntary contributions and qreat flexibility for distributions. The Plan trustees. (Baer,
McFarlane. and Hussmann) are recommendina changes that are available when they do not add
to the District's administrative effort and do not increase the complexity of the Plan.
Due to the number of changes involved, the trustees plan to utilize the Great West proto-
type document as the District's new Plan document. Great West is one of the District's investment
and record keeping providers for the Plan.

I. Issue
EGTRRA permits 457 plan assets to remain tax deferred until actually distributed
from the plan. Under amended section 457(a), the participants' account
balances are no longer taxable when "made available." The special distribution
rules under 457(d) are repealed such that payments are no longer required to be
paid in substantially non-increasing amounts paid at least annually. Non-spouse
beneficiaries may now take distributions over life expectancy, not just 15 years.
II. Discussion
Adopting these provisions requires deleting plan language taxing a participant's
457 account balance at separation from service prior to an amount being paid to
the participant or other beneficiary. The provisions requiring an irrevocable
election at separation from service and requiring annual payments in
substantially non-increasing amounts paid at least annually must be deleted. All
current irrevocable elections should be treated as null and void. Amend the plan
to comply with the new minimum distribution regulations.
II1. Great-West/BenefitsCorp Comments
While making this change will provide participants with greater flexibility, it will
involve additional work by the plan sponsor and Great-West/BenefitsCorp when
participants request changes to existing irrevocable election dates and/or
payment amounts. Great-West will permit up to two changes in payout amounts
per calendar year from each participant, free of charge. Subsequent changes in
the same calendar year may involve an additional fee paid by the participant.

Plans are allowed to cash out small account balances (typicaliy $5,000 or less)
without the participant's consent upon separation from senrice. EGTRRA
, requires Treasury to issue regulations within three years of the date of enactment
that will require all plans with a mandatory cash-out provision to designate an
IRA provider to receive unclaimed small accounts. If the participant does not
request the distribution in cash or direct it to another plan or IRA, the plan must
send all amounts of $1,000 or more to the designated IRA provider and
determine the default option for such amounts to be invested in.
I1. Discussion
Each plan sponsor must determine whether the plan will allow sma[1 accounts to
remain in the 457 plan when a participant separates from service until age 70 '/�.
If the plan sponsor chooses to force immediate cash outs of small account
balances at separation from service, the plan must provide that, upon issuance of
Treasury regulations, such amounts will be sent to a designated !RA provider
and the default option to receive these amounts.
III. Great Comments
It will be up to three years before the Treasury issues regulations requiring plans
to transfer mandated cash-out amounts to an IRA provider. The only accounts
that will be transferred are those of participants who refuse to take the cash or
tell the plan where to send the money. Great-West/BenefitsCorp will make an
IRA product available to our plan sponsors when the regulations are issued, and
will advise of any fees applicable to the IRA product when it is availab[e.

EGTRRA does not contain any provision allowing loans to participants
from their 457 plan accounts. The Treasury is expected to issue
regulations in the near future that will either permit or prohibit such loans.
II. Discussion
Adopting a provision to allow participant loans from a 457 plan would have
to be contingent upon and consistent with Treasury regulations permitting
such loans. Loans should be account reduction loans with repayments
made via payroll deduction. The number of outstanding loans per
participant should be limited.
III. Great-West/BenefitsCorp Comments
Our experience with loans under 401(k) plans is that participants may
damage their future retirement security if repayments are not made by
payroll deduction and they default on the payments. If your plan has a fee
structure that is sensitive to asset levels, the availability of loans may
impact your plan administrative fees by reducing plan assets by 5%-10%
in the first year if loan demand is high. The positive impact of 457 plans
may be a reduction in the number of unforeseeable emergency requests.
Each plan sponsor will have to carefully weigh the benefits and drawbacks
of offering a loan provision. If this provision is adopted, we suggest each
participant be permitted no more than finro outstanding loans at any one
time. Great-West charges a fee to initiate the loan, and .to service the loan
each year. These fees vary from plan to plan depending on the type and
number of investment options under your plan. A specific fee basis will be
quoted for your plan before this provision is effective.

Dear Jim:
Carollo Engineers (Carollo) is pleased to submit this Proposal to evaluate replacement
alternatives for the Keller Water Storage Tanks. This proposal is based on our understanding of
the engineering services requested by the District staff at our meeting of November 29.
The services to be provided by Carollo under this proposal are presented in our Scope of
Services (Exhibit A, attached). This Scope has been divided into tasks based upon our
understanding of the project. The proposed engineering cost for the completion of the tasks
contained in the Scope is $28,000. The development of this cost is detailed in the attached Labor
Hour and Cost Proposal (Exhibit B). It is our understanding that this project will be administered
under the 1988 Master Agreement (as amended to allow the engineer to carry errors and
omissions insurance not less than $5,000,000 aggregate with a deductible of not more than
$500,000) between Carollo Engineers and the South Tahoe Public Utility District. Engineering -
fees will be based on the current fee schedule (Exhibit C).
The project team for the completion of this project will be Mr. Robert Gillette, Principal-in-Charge,
Jack Burnam, Project Manager, Don Pawluk, Project Engineer. Please review the material
contained herein and, if acceptable, submit them to the Board of Directors for approval.

SLUDGE HANDLING FACILITIES AND ODOR CONTROL PACKAGE
Scope of Services
The following describes the Scope of Services for the engineering effort to complete the
evaluation of alternatives for the replacement of the Keller Water Storage Tanks. This scope of
services covers only the evaluation phase of the replacement project. A separate scope of
services will be developed and submitted to the South Tahoe Public Utility District (District) once
a replacement alternative is chosen. These engineering services are to be provided by Carollo
Engineers (Engineer) as requested by the South Tahoe Public Utility District (District).
INTRODUCTION
The completion of this project will address District concerns over the security and reliability of the
two existing bolted steel water storage tanks at this location. The existing tanks are located on a
shelf that was cut into a steep hillside covered in boulders ranging from less that 1 foot in
diameter to several yards in diameter. The tanks appear to be in serviceable condition but have
no foundation, differential settlement has occurred in one tank and, are well over twenty years
old. Boulders have rolled down the hillside and across the cut shelf in the past. The existing tanks

slope. The District's intent is to replace the existing tanks with a single 300,000 gallon new tank
situated on the property to reduce the potential for impact. Additionally, the District is looking to
include in the project structures to protect the tank from rolling boulders. The existing tanks would
be dismantled and possibly used elsewhere in the District water system.
Once the chosen alternative is identified, a revised scope of services will be submitted to
complete the design and construction phases of the project.
PROJECT TASKS
The following Tasks are included in the Scope of Services for this analysis.
Task 1- Alternative Identification and Evaluation
Engineer will evaluate two types of tanks to replace the existing bolted steel tanks. The two tank
types will be welded steel and reinforced concrete. While welded steel has been the material of
choice for the other tank replacement projects that have been completed, the potential structural
requirements for this project make it necessary to evaluate the use of reinforced concrete.
, Engineer will evaluate three potential replacement alternatives. These are:
1) New 300,000 gallon welded steel tank designed to withstand the impact of roughly a 3 ton
boulder.
2) New 300,000 gallon reinforced concrete tank designed to withstand the impact of a(roughly)
3 ton boulder.

3) New 300,000 gallon tank that includes the construction of a protective barrier separate from
the tank to protect it from being impacted by a rolling 3 ton boulder. This alternative will have
two subalternatives.
a) Welded steel tank.
b) Reinforced concrete tank.
The evaluation criteria will include:
1) Requirements for cathodic protection
2) Constructability
3) Material Advantages/Disadvantages
4) Planning level estimates of probable construction cost
Each of the alternatives will be evaluated in a matrix format in each of the above categories. A
preferred alternative will be developed and presented. The work herein will be presented in a
technical memorandum to the District. One additionat site visit with structural personnel is
envisioned prior to completing the development and evaluation of alternatives.
DISTRICT PROVIDED INFORMATION
1. Topographic Survey of the storage tank site. If at all possible it would be helpful to have the
survey extend up the slope above the tank site as far as possible.
2. Geotechnical report for the soils in the area of the water storage tanks. (District will provide a
backhoe for potholing as required.)
3. Plans for the utilities that will have to be avoided or tied into.
4. Review comments on the Draft Technical Memorandum.

I�ear Members,
It is our understanding that you want some input on the future of
the ef�u�ent from Tahoe.
Sinc� I have bee� involved in the waters of Tahoe sinc� 1�55, I
wi11 briefly review some of the history of events leading up to the
use o�' your effluent on lands in Alpine County. I was a me�nber of
the Cali�ornia-Nevada �ornpact Commission on water that divide�.
t�e water of Tahoe between the two states. +Our studies made us
awa,re of the use of water and the problems that may have existed
in every area of the Lake in both states.
1�s most of you know, the top six fe�t or sa of Tahoe is claime�i
by interests in Nevada. When the C�.lifornia leg�slatu�e requested
that al1 effluent be exported from the basir�, the Nevada interests
bevame very concerned.
I was appointed chairman of a committee consisting of repre-
sentitives from both states with the purpose of finding a satisfac-
tory method of export and avoiding a prolonged court battle. In
short, our conclusion was that any water exported from the south
end of the Lake must reach the Carson R.iver and be used in
Nevada. All arrangements were made and documents were signed
permitting STPUD to pump the effluent over Luther Pass and to
pipe it through Diamond Valley and discharge it into Indian Creek
beyond any ranches in Alpine Co. Shortly before work was to
begin � received a call from Sacramento saying that they had dis-

cove�e� �n a�reement between the two states rr�ade earlier that
prohibited either sta.te from discharging treated effluent into any
inters�ate str�am. That call was from Orville Abbott, a g�ntleman
with whom I had previously worked, and who was at that time the
executive officer of the Davis Grunsky Funds. I�e also told me that
if we could find a storage site and people willing to use the effluent
for irrig�tion, Davis Grunsky would fund a rese�-voir i� Alpine Co.
In order for that plan to work, we had to reneg�tiate with Ne�ada.
I personally went back to the Nevada people to try to v�ork out
an agre�ment allowing the effluent to be used in Californi�.
Althoug� it took several months to g�t the original a�reement to
export, it took only a one day mee�ting for Nevada to agre� for the
ef�luent to be used in California.. We should appreciate the fact th�.t
. Nevada was agreeable. �
My neighbor, Chris Gansberg, and I had in the previous two years
take� e�gine��s to every possible site in this area for the purpose �f
building our own private reservoir. The only sit�e that we found
would not be able to take the effluent and for a time we we�e
at a total loss. The other two routes that your district had
consider�d, one over Echo and one over Dag��t Pass into Carson
Valley, had be�n prohibited for various reasons.
One night I woke up about midnight and somehow thoug�t about
, the site where the original Indian Creek Reservoir was built. This
happened to be the best part of our cattle range which we had to
give up. I asked the local soil conservation engineers if they could
investigate to se� if it would accommodate the effluent. About
three months later the dam was underway. Some of the
landowners including myself did considerable research before
agre�ing to ta,ke the effluent and as a result felt it would be very
acceptable. Other people felt differently. We were the targets of
unlimited criticism. We would not only ruin our own land but
would also reduce the value of other land in the area. Alpine Co.
should not be the septic tank for Tahoe and many other things. We
received telephone calls and letters urging us not to take it.

Over the years we have enjoyed significant be�efits from the use
of effluent for irrigation, especially in the dry years. At the same
time there were some hardships. In the early years, we were
basically on our own. We accepted the risks, built and maintained
the ditch sys�em and fought the public r�lation and political battles.
We applie� e�f'iue�t to our fields in the winter and spring when we
did not ne�d it to preyent your reservoir from spilling and the
substantial fines that would have resuited.
We believe that we took the district out of an impossible situation.
When we ag�r��d to tak� the effluent, your district was faced with
a deadline after which you would have faced se�vere financial
pe�alties. At that time, there was not a single person connecte�l
with your district that had the slightest clue of what to do. I
r�member attending meetings in Sacramento dealing solely with
the effluent proble�n in South Tahoe, where there was not even a
representative of S'TPUD present.
�lith respe�t to the re�ommendation to charge us to dispose of
the ef�iuent, I personally find that to be somewhat unrealistic in as
much as our taking it has benefited the district financially much
rnore than it has us. Also, it would be very difficult, if not
impossible, for some of the current users to contract for purchased
water. We can all use supplementa.l water, but not for the whole
s�ason and not at the same time every year. We surly would not
continue to let fresh water go down the river early in the season
just so we could buy effluent.
We believe that we have cooperated with the district through the
years and would sincerely appreciate having our contracts
extended as the district offered and we agreed to a few months ago.
We well recogni2e that the district must be assured that they have
a reliable place to adequately dispose of.their effluent in the future
and will certainly cooperate to that end. We do wonder why those
of us who have disposed of the effluent in a mutually beneficial
relationship for some 30 years were not a participant in the process
that resulted in these elaborate options in your `master plan' .

. Lastly, I would like tv address the districts' acquisition of the
: I-�eise property. Obviously that would be a tremendous advantage
for STPUD. However, I would urge you to cansider the
downstream users on Indian Creek. Even though it is not
addr�ss�d in the EIR, if you change the historical use of water in
Diamond Valley you will s�verely impact the downs�tream users.
The elimination of tail water and ground water recharg� that othe�s
have depended on for over a hundred years will definitely cause a
negative i�pact.

CC-450 as stated in Addendum No. 2.

The South Tahoe Public Utility District (District) pre-qualified your companies to supply
equipment for its Centrifuge Replacement Project (Project). The District received timely
proposals from your respective companies.
When evaluating the proposals, the District noted that none of the bidders provided the
required irrevocable letter of credit (Letter of Credit) with their proposal as required by the
Contract Documents. The District's staff intends to recommend waiving this irregularity since
all bidders failed to comply with this requirement. If waived by the District's Board of
Directors, it is the District's stafPs opinion that none of the bidders would receive a competitive
advantage over the other bidders. The District will require the lowest responsive and responsible
bidder to submit the Letter of Credit after award of the Contract with the other documents to be
submitted by it.

DISCUSSION: Due to customer confidentiality issues, staff recommends that disconnection
notices and lists should only contain the APN number, not the customers' names or addresses.
This matter was assiqned to the Planning Committee and the following issues were reviewed:
(1) Does implementation of disconnection procedures required Board a�,proval? A survey
of similar agencies showed that STPUD is the only District who puts their disconnections on an
aqenda for Board approval. The survey participants felt this is a staff level responsibility.
(2) If the Board decides disconnection procedures requires action by the Board, should the
customers names and addresses be deleted from the lists and notices to ensure customer
confidentialitv?
It is the staffs recommendation to eliminate the need forthe Board to a�prove disconnections
as this is a routine duty and to amend the Administrative Code to reflect this is a staff level
procedure. The Planning Committee will report their recommendations at the Board meetina

Re: Listing Customers Subject to Disconnection
BACKGROUND
An issu� recently came up at a Board meeting as to whether customer names, addresses
and/or assessor parcel numbers should be included on the disconnection list for Board approval.
In the past, the District has, from time to time, varied its practice from including names,
addresses and/or APN numbers. Currently, the District only lists assessor parcel numbers of the
customers subject to disconnection.
The purpose of this memorandum is to provide the Boaxd with an analysis and
recommendation upon which to make a decision as to the type of information that should be
included on the list of customers subject to disconnection. In preparing this memorandum, staff
reviewed research prepared by the District's attorney.
DISCUSSION
The primary issue is to determine the type of information the District may provide when
listing customers and/or properties subject to disconnection. In making such a decision, the
Board must balance a customer's right to privacy against the purpose(s) sought to be achieved by
the Board identifying customers and properties subject to disconnection.

As a general rule, a customer has a right to privacy unless, as in this case, a reason for
additional information (names and/or addresses) outweighs that right. In this situation, the listing
of names and/or addresses of properties subject to disconnection does not appear to further the
District's purpose of providing a list of properties subject to disconnection. The District has
already provided notice to these customers regardi.ng disconnection. The only purpose for listing
the properties is to allow the Board to authorize disconnection for specific listed
properties/customers as required by the District's Administrative Code. While the listing of
additional information (names and addresses) may provide some opportunity for interested
persons to be aware that water and/or sewer service may be disconnected, that interest does not
appear significant since the District has already provided the requisite notice of disconnection
directly to these customers. Accordingly, a customer's right to privacy seems to outweigh any
marginal benefit to the customer by avoiding disconnection. The disclosure of a customer's
name may prove to be quite embarrassing, especially in a sma11 community like South Lake
Tahoe.
Staff also understands that some Board members prefer that the names and/or addresses
be included so that if they knew someone listed for disconnection, they could contact them
personally. VVhile the best of intentions undoubtedly underlie this practice, the District could be
exposed to liability for not treating a11 customers equally. In other words, some customers are
getting special notice (treatment) from the District in order to avoid disconnection while others
are not.
RECOMMENDATION
Staff recommends that the Board continue its current practice of only listing assessor
parcel numbers for the properties subject to disconnection. Staff also recommends that the Board
adopt a policy re�arding the type of information that should be listed with respect to customer
disconnection of services. After the Board decides the type of information to include in the
customer disconnection list, staff will prepaze a policy for adoption by the Board.

I. ISSUE
Determine whether the South Tahoe Public Utility District (District) may disclose the
names of their customers who are at risk of disconnection. Disclosure of names would occur in
the agenda for Board members' meetings.
II. ANSWER
It is likely that a court would find the customers' names should not be disclosed. Article I,
Section 1, of the California Constitution guarantees all people the right to privacy. The Public
Records Act ("Act"), the California equivalent of FOIA, was created to shed light on the internal
operations of government. The "catchall exemption" of Government Code section 6255 allows a
government agency to withhold records if it can demonstrate that, on the facts of a particular
case, the public interest served by withholding the records clearly outweighs the public interest
served by disclosure." (City of San Jose v. Superior Court (1999) 74 Ca1.App.4th 1008, 1017.)
The Act is designed for situations involving a party requesting information from a government
agency, rather than a situation involving the desire of an agency to disclose information
spontaneously, as in this case. However, it is applicable, at least by analogy, in that the two
exemptions, listed above, state when an agency may disclose private information about
individuals. I was not able to find any case law exactly on point, so it is necessary to use general
principles and similar cases to provide guidance in this situation.
The balancing test of the catchall exemption appears to favor nondisclosure in the present
case because no additional light would be shed on the operations of the District by disclosing the
names of customers at risk of disconnection. Listing the APNs of those properties at risk serves
exactly the same function as listing the names of the customers at risk because it alerts interested
parties to the fact that the District's Board of Directors (Board) is about to decide whether or not
to disconnect water service to the listed parcels. Listing the names of the owners of those parcels
would have no greater effect on informing observers of this activity by the Board. Rather, it may
instead embarrass customers at risk of disconnection. The purpose of listing the parcels is not to

provide notice to the owners of those pazcels (notice has already been provided by the District)
but simply for the Board to authorize disconnection as required by the District's Administrative
Code.
It has been argued that publishing the names of customers at risk of disconnection will
allow concerned Board members to notify those customers one more time before their water is
shut off. However, those customers have been notified at least twice prior to the publication of
their APN numbers in the Board agenda. The additional opportunity for providing notice to those
customers is most likely outweighed by those customers' right to privacy. However, this is by no
means a certain conclusion as the at risk customers may benefit by having one more opportunity
for notice being given in that their water supply may not be cut off if they act in time to avoid
disconnection. However, as a side note, if Board members are contacting selected at risk
customers, they may be exposing the District to liability for not contacting all at risk customers
listed for disconnection.
Alternative means aze available for obtaining the information sought. (Id. at 1024.) If
certain Board members wish to obtain names, they can use the already published APN numbers
to find the owners of those parcels. Though this may entail more work, it will save the potential
embarrassment and threat to privacy that disclosing names will likely cause.
III. DISCUSSION
A. General Principles
Article I, Section 1, of the California Constitution guarantees all people the right to
privacy. (Scull v. Superior Court (1988) 206 Cal.App.3d 784, 790.) Section 6250 et seq. of the
Government Code contains the Public Records Act ("Act"), the California equivalent of the
federal Freedom of Information Act ("FOIA"). Federal jurisprudence may be used in construing
California's Act. (Times Mirror Co. v. Superior Court (1991) 53 Cal.3d 1325, 1338.) The Act
expressly sets forth its purpose: "In enacting this chapter, the Legislature, mindful of the right of
individuals to privacy, fmds and declares that access to information concerning the right of
individua.ls to privacy, finds and declares that access to information concerning the conduct of
the people's business is a fundamental and necessary right of every person in this sta.te." (Gov.
Code § 6250.) Courts have added that the Act was passed "to ensure public access to vital
information about the government's conduct of its business." (CBS, Inc. v. Block (1986) 42
Ca1.3d 646, 656 (emphasis added).)
Disclosure of public records involves two fundamental, sometimes contradictory,
interests: 1) prevention of secrecy in government, 2) protection of individual privacy. (Black
Panther �arty v. Kehoe (1974) 42 Cal.App.3d 645, 651.) Therefore the public's right to know is
not absolute. (City of San Jose v. Superior Court (1999) 74 Cal.App.4th 1008, 1017.) Further,
there are two express exemptions from the general disclosure requirements: 1) "materials

expressly exempt from disclosure ..., 2) the `catchall exemption' of section 6255, which allows
a govemment agency to withhold records if it can demonstrate that, on the facts of a particular
case, the public interest served by withholding the records clearly outweighs the public interest
served by disclosure." (Id.) .
It is the balancing test of the catchall exemption that is probably applicable to the present
situation. The burden of proof is on the party seeking nondisclosure. That party must demonstrate
a"clear overbalance on the side of confidentiality. (Id. at 1018.) "The purpose of the party
seeking disclosure cannot be considered." (Id. )
The U.S. Supreme Court has stated that "disclosure of records regarding private citizens,
identifiable by name, is not what the framers of the FOIA had in mind." (Id. ) Courts ha.ve found
that individuals have a substantial interest in keeping their home addresses secret. (Id ) This rule
is applicable to the present situation because disclosing the names of those at risk of being
disconnected is similaz to disclosure of their home addresses. The basic principle to keep in mind
when requesting individuals' names and addresses is the Act information requests should be
designed to "shed light on any agency's performance of its statutory duties." (Voinche v. F.B.I.
(D.D.C. 1996) 940 F.Supp. 323, 330.) "Courts have also recognized that the public interest in
disclosure is minimal, even when the requester asserts that personal contact is necessary to
confirm government compliance with mandatory duties, where the requester has alternative, less
intrusive means of obtaining the information sought." (Ciry of San Jose, supra, 74 Ca1.App.4th
1008, 1020.) Finally, where "disclosure of names and addresses is necessary to allow the public
to determine whether public officials have properly exercised their duties by refraining from the
arbitrary exercise of official power, disclosure has been upheld. (CBS, supra, 42 Cal.3d at p. 656
[revealing identity of concealed weapons permit holders permits public ascertainment of whether
law applied evenhandedly]. ... New York Times v. Superior Court (1990) 218 Cal.App.3d 1579,
1585 [disclosure of excess water users will ensure individuals do not receive special privileges]."
(Ciry of San Jose, supra, 74 Ca1.App.4th 1008, 1020.)
In City of San Jose, supra, 74 Ca1.App.4th 1008, the court found that a newspaper was
not entitled to receive the names and addresses from the City of San Jose of individuals who had
complained about noise from the local airport. The court found that the individuals' interest in
privacy clearly outweighed the public interest in disclosure under the particular facts of the case
because airport noise complainants had a significant interest in nondisclosure of their names,
disclosure of such information would have a chilling efFect on future complaints, the public
interest in disclosure of personal information about complainants was minimal, and the
newspaper had alternative means of contacting and interviewing the complainants. (Id. at 1023-
1024.)
City of San Jose is not directly applicable because it involves a party seeking to disclose
the names of individuals contained in the public record. In the present case, it is Boazd members
that seek disclosure. In effect, our client seeks to determine whether it may disclose such

information if it wants to, as opposed to determining whether it must disclose such information
when it is requested from an outside party. Even though City of San Jose is not exactly on point,
the general legal principles cited by this case are applicable. Under these principles, (see Section
III(B) below) it is advisable that the Boazd should not disclose individuals' names threatened
with disconnection.
In New York Times v. Superior Court, the court reached the opposite conclusion as in Ciry
of San Jose. In this case, plaintiff sought to obtain the names of people who violated a local water
rationing ordinance. The court applied substantially the same analysis as that in City of San Jose
and found that "the mere assertion by the water district of possible hazassment or physical
endangerment does not `clearly outweigh' the public interest in disclosure of' the names. (New
York Times, supra, 218 Ca1.App.3d 1579, 1581.) The court also stated: "The [Water] District's
fear that outraged citizens will misunderstand the information sought is speculative and does not
outweigh the public's right to be informed of the District's implementation of the [rationing]
ordinance." (Id. at 1586.) The court was concemed about accountability of the Water District to
the public if names were not released because anonymity would prevent concemed parties from
checking on the District's enforcement of the ordinance. (Id. at 1587.) This case supports
permissive disclosure of at risk customers' names by the Tahoe Water District, but may be
distinguishable (see discussion below).
B. Applying General Principles and Appropriate Cases to the Present Case

government, it is likely that a court would find the customers' names should not be disclosed.

New York Times is distinguishable from the present case and from City of San Jose
because the latter two cases deal with government functions that will benefit minimally or not at
all from disclosure of individuals' names. In New York Times, the court found that disclosing
names of people who had violated the rationing ordinance may further the purpose of the
ordinance in that it would provide an additional incentive to people not to violate the ordinance.
In the present case, no benefit, or at most a minimal benefit, will result from disclosing the names
of at risk customers at Board meetings. When considered in conjunction with the other
opportunities for receiving notice prior to disclosure of the customers' names at the Board
meeting, it is likely that one more opportunity for notice is a marginal benefit at best. In addition,
City of San Jose, a later case than New York Times, states that even when a governmental
function may be improved through greater public disclosure, if this improvement can be achieved
through less intrusive means then such disclosure should not be allowed. (City of San Jose,
supra,74 Ca1.App.4th 1008,1020.)
