Resolution 2428 � RE5ULUTION N0. 2428 RESOLUTION OF NECESSITY (Melvin Schwake, Jr., et al.) WHEREAS, the SOUTH TAHOE PUBLIC UTILITY DISTRICT proposes to construct, operate and maintain a wastewater effluent storage and conveyance facility with related recreational and wildlife habitat benefits for which it is necessary to acquire by proceedings in eminent domain certain property and interests . therein; and i�dHEREAS, this Board on June 19, 1986 and after comply- ing with the provisions of Section 1234.235 of the Code of Civil .� Procedure, adopted Resolution No. 2403, authorizing the commence- ment of condemnation proceedings to acquire certain property and interests therein for the proposed Project; and WHEREAS, by letters sent by first-class mail on January 21, 1987, this District gave notice to each �erson whose property is to be acquired and to their attorneys of records that this Board on February 5, 1987 would consider the adoption of an amended Resolution of Pdecessity; and WHEREAS, at the request of the persons whose property is to be acquired, the date that this Board would consider the adoption of an amended Resolution of Necessity was continued to February 12, 1987, and then to February ?_3, 1987; and WHEREAS, the matter was heard on February 23, 1987 and �„ set for further hearings on March 5, 1987; and 1 �: WHEREAS, Melvin Schwake, Jr. and his Attorney, Suellen Fulstone, appeared at the hearing on March 5, 1987 and objected to a proposed Exhibit A and Exhibit C with respect to the time which the District proposed to use the full capacity of and flow in Snowshoe Thompson No. 1 Ditch from the existing diversion box located near the Diamond Valley School after Federal Watermaster designation of California-Nevada Rotation; and WHEREAS, said Attorney Suellen Fulstone, on behalf of Melvin Schwake, Jr., proposed that the District have said full capacity of and flow in Snowshoe Thompson No. 1 Ditch during the period of Monday, 6:00 A.t�., to the following Thursday, 6:00 P.M., during Caliornia-Nevada Rotation rather than as proposed � from Thursday, 6:00 P.M., to Monday, 6:00 A.M.; and WHEREAS, said Attorney Suellen Fulstone, on behalf of Melvin Schwake, Jr., further objected at said P+Iarch 5, 1987 hear- ing, to the flow provisions of Indian Creek diverted through Har- vey Diversion Structure for Claim Numbers 49, 50, 51, and 51 (Heise), and Claim Numbers 47 and 48 (Harvey Place) as described in the proposed Exhibits A, B, and C; and WHEREAS, District has accommodated the option offered on behalf of Melvin Schwake, Jr. regarding the use of the full capacity of and flow in Snowshoe Thompson No. 1 Ditch after California-Nevada Rotation and the objection regarding diversion of flows of Indian Creek through Harvey Diversion Structure in this Resolution of Necessity; and � 2 ., 4 � WHERE�S, the proposed amendments will describe the proposed Project and the specific �roperty and interests therein sought to be condemned. NOW, THEREFORE, IT IS HEREBY RESOLVED� DETERMINED, AND FOUND �Y THE BOARD OF DIRECTORS Or� SOUTH TAHOE PUBLIC UTILITY DISTRICT AS FOLLOWS: 1. The public use for which the property or interests therein are to be acquired by the District is to construct, operate, maintain and use the Harvey Diversion Structure, and ap- purtenant facilities, the Harvey Channel, the Upper Dressler Ditch Channel, and the Harvey Diversion Access Road, all of which are required in or�er to construct, operate and maintain a was- � tewater effluent storage and conveyance system, including a recreational reservoir in Alpine County, California, cumulatively referred to herein as the "proposed Project". 2. The statutes which authorize the District to ac- quire the property or interests therein are Section 16404 of the California Public Utilities Code, and the Fminent D�main Law, Comprising Title 7 of Part 3 of the Code of Civil Procedure com- m�ncing with Section 1230.010. 3. The property or interests therein which the Dis- trict seeks to acquire by proceedings in eminent domain are situated in Alpine County, California, and are described and depicted in Exhibits A through D, attached hereto and incor- porated herein. � 3 w � 4 �''� 4. This Board hereby declares that it has found and determined each of the following: (a) The public interest and necessity requir� the proposed Project; (b) The proposed Project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury; (c) The property or interests therein described in this Resolution are necessary for the proposed Project; (d) The offer required by Government Code Section 7267.2 has been rnade to the owners of record of the property or interests therein described in this Resolution. � 5. In the event of description or other variances or ambiguities, this Resolution supersedes Resolution No. 2403. This permanent easement is for the purposes of construction, repair, maintenance, improvement, reconstruction and operation of the Harvey diversion structure and other facilities related to the South Tahoe Public Utility District's wastewater storage and transmission project. The "Harvey diversion structure area" includes the diversion structure itself, any road built thereon, and the area extending out from the diversion structure to a distance of 20 feet from � its exterior edge. The "diversion structure" includes the chan- nel and berm, substantially as depicted on Exhibit 13 attached hereto. The South Tahoe Public Utility District shall have the � right to fence the Harvey diversion structure area. �}� The following rights in the Harvey diversion structure area are � reserved to the fee owner: � ' 1. The right of vehicular access for the sole purpose of � installing and maintaining a twelve inch irrigation pipeline. This right shall not be exercised without prior natice to Dis- trict and shall not interfere with the District's project or project-related activities. The irrigation pipeline shall be lo- � cated pursuant to mutual agreement between District and Melvin H. Schwake, Jr. 1 � 2. The right of pedestrian access on the diversion struc- ture itself necessary for ranching purposes. The following right in the land above described containing 4.66 acres which lies outside the "Harvey diversion structure area" as above defined is reserved to the fee owner: 1. The right of use for agricultural purposes only, provided, however, such use does not interfere with the main- tenance and operation of District project nor impair the water rights of others. Exhibit 11 (Schwake Location Map), Exhibit 12 (Schwake Irrigation System Conceptual Map), and Exhibit 13 (Harvey Diversion Struc- ture Easement Map) are attached hereto and incorporated herein by this reference. Upon completion of condemnor's project as described in Paragraph 3 of the Amended and Supplemental Complaint (Eminent Domain CCP Section 1250.310) to which this Exhibit A is attached: a. F. Heise Land and Livestock Company historical sup- plemental water rights for the Scossa and Trimmer Ranches from Indian Creek (Claim Numbers 49, 50, 51, and 52, as set forth in the Final Decree entered by the United States District Court for � the District of Nevada in United States of America v Alpine Land & Reservoir Company, et al , Civil No. D-183 BRT) will be con- veyed into the Harvey Diversion Structure and through the Harvey Channel, or under the Harvey Diversion Structure and divert this water into the Upper Dressler Ditch to Indian Creek Reservoir at the option of the Claims owner. One-half of the flow of Indian Creek between April 1 and October 1 of each year may be so diverted for said Claim Numbers 49, 50, 51, and 52, and Claim Numbers 47 and 48 of said Final Decree. Any use of the Harvey Channel for said Claim Numbers 49, 50, 51, and 52, and Claim Num- bers 47 and 48 of said Final Decree shall not be exclusive. Such use shall not preclude irrigation flows in said Channel for ir- rigation of the lands subject of Claim Numbers 45, 46, 456, 457, , and 458 of said Final Decree. , b. Indian Creek flows will be diverted through the Harvey Diversion Structure into the Harvey Channel and then into ; Indian Creek downstream from the Harvey Place Dam and Reservoir. ; South Tahoe Public Utility District may, at its discretion, be- . tween October 1 and April 1, return up to 30 cfs under the diver- ' sion structure into the Indian Creek Channel, and divert this water into the Upper Dressler Ditch. (2) To use each year after the Federal Water- master designation of California-Nevada Rotation under said Final Decree, the full capacity of and flow in Snowshoe Thompson No. 1 Ditch from the existing diversion box located near the Diamond Valley School on said Snowshoe Thompson No. 1 Ditch during the period Monday, 6:00 A.M., to the following Thursday, 6:00 P.M., or at an otherwise mutually agreed upon time, in California Week to convey West Fork of the Carson River water, subj ect of Claim Numbers 453, 454, and 455 as set forth in said Final Decree, to and under Harvey Diversion Sructure, into Indian Creek Channel, and divert this water into Upper Dressler Ditch to Indian Creek Reservoir until the full District entitlement under said claim � numbers is fully met. (3) To the use of the full Ditch capacity af Snowshoe Thompson No. 1 Ditch to convey purchased water not sub- ject to said claim numbers 453, 454, and 455 of said Final Decree through said Ditch under the Harvey Diversion Structure into In- dian Creek Channel, and divert this water into the Upper Dressler Ditch to Indian Creek Reservoir during any Nevada j4eek after the Federal Watermaster designates California-Nevada Rotation pur- suant to said Final Decree. (4) To change the point of diversion on Indian Creek for the water rights referred to in claim numbers 453, 454, and 455 of said Final Decree and to then convey those waters to Indian Creek Reservoir and to use said waters in said reservoir for recreational purposes. (5) To change the point of diversion on Indian Creek for water subject to Claim Numbers 47 and 48, and Claim Numbers 49, 50, 51, and 52 of said Final Decree and to then con- vey those waters under the Harvey Diversion Structure into Indian Creek Channel, and divert this water into the Upper Dressler Ditch to Indian Creek Reservoir and to use those waters for recreational purposes. Heise Land & Livestock Company and its suc- cessors and assigns shall have the right to use the Upper Dressler Ditch and Indian Creek Pipeline to convey waters subject to claim numbers 49, 50, 51, 52, 451, and 452 of the Final Decree entered by the United States District Court for the District of Nevada in United States of America v. A1 ine Land & Reservoir Companv, et al., Civil No. D-183 BRT. 6. F. Heise Land & Livestock Company and its succes- sors and assigns may utilize Indian Creek Reservoir for water storage provided volumes do not exceed 110 acre feet annually and provided that storage does not exceed the District operating rule curve for total storage volumes, a copy of which is attached hereto as Exhibit A-1. F. Heise Land & Livestock Company is � responsible for obtaining Federal Watermaster and/or District Court approval. South Tahoe Public Utility District will not object. F. Heise Land and Livestock Company historical sup- plemental water rights for the Scossa and Trimmer Ranches from Indian Creek (Claim Numbers 49, 50, 51, and 52 as set forth in the Final Decree entered by the United States of America for the District of Nevada in United States of America v Alpine Land & Reservoir Company et al , Civil No. D-183 BRT) may be conveyed into the Harvey Diversion Structure and through the Harvey Chan- nel at the option of the claims owner. This easement is nonexclusive. It is for the purposes of con- struction, repair, maintenance, improvement, reconstruction and operation of a channel ior the conveyance of water, exclusive of treated wastewater from the South Tahoe Public Utility District � facilities, and of other facilities associated with such channel.
