Heise Land & Livestock Company) WHEREAS, the SOUTH TAHOE PtJBLIC UTILITY DISTRICm proposes to construct, operate and maintain a wastewater effluent storage and conveyance facility with related recreational and wildlife habitat benefits for which it is necessary to acquire by proceedings in eminent domain certain property and interests therein; WHEREAS, this Board on June 12, 1986 and after complying with the provisions of Section 1245.235 of the Code of Civil Procedure, adopted Resolution No. 2402, authorizing the commencement of condemnation proceedings to acquire certain property and interests therein for the proposed Project; and � WHEREAS, by letters sent by first-class mail on January 21, 1987, this District gave notice to each person whose property is to be acquired and to their attorneys of record that this Board on February 5, 1987 would consider the adoption of an amended Resolution of Necessity; and WHEREAS, the proposed amendments will describe the proposed Project and the specific property and interests therein sought to be condemned, specify conditions for clay removal and reclamation, and further describe how waters may be used and/or diverted and conveyed when the proposed Project is constructed and operational; NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED, AND FOUND BY THE BOARD OF DIRECTORS OF SOUTH TAHOE PUBLIC � UTILITY DISTRICT AS FOLLOWS: s� 4 � �, , �, , ., 1. The public use for which the property and '�,, interests therein are to be acquired by the District is to construct, operate, maintain and use in Alpine County, California diversion facilities, water conveyance channels and ditches, dams, access road5 and a spillway and clay material borrow site for the Harvey Dam and Reservoir, all of which are rec�uired in order to construct, operate and maintain a wastewater effluent storage and conveyance syster� and a recreational reservoir at Indian Creek Reservoir, cumulatively referred to herein as the "proposed Project." 2. The statutes which authorize the District to acquire the property a.nd interests therein are Section 16404, of the California Public Utilities Code, and the Eminent Domain Law, comprising Title 7 of Part 3 of the Cocie of � Civil Procedure commencing with Section 1230.010, including Section 1240.410. 3. The property and interests therein which the District seeks to acquire by proceedings in eminent domain are situated in Alpine County, California, and are described and depicted in Exhibits B through H, attached hereto and incorporated herein. 4. The clay borrow area described in the Exhibit attached hereto as Exhibit "B-2" shall be fenced in a manner to prevent nonauthorized individuals and cattle from entering the area. A ten foot separation between the fence and irrigation ditches and the farm access road along Indian Creek shall be maintained. The fence shall be 7 strand, 5 foot barbed wire, except the existing fence line on the west side of said area described in Exhibit "B-2" may be used. The fence.shall be maintained by contractor. . 2. After completion of the clay removal and reclamation operation, all original ditches, and diversion boxes, if any, shall be restored to at least the same size, location, and condition to that existing prior to clay removal. If dewatering trenches are used, that area shall be restored to the condition existing prior to clay removal. 3. During the removal and reclamation operation, the existing flood irrigation system shall be altered as follows: A. Waters flowing into the area from the south � (including water in culverts under Diamond Valley Road) shall be intercepted within the area and directed by check structures east or west as F. Heiae may direct. The flows directed to the west shall proceed west until near the westerly edge of the area at which point they shall flow north and into farm ditches as depicted on Exhibit "B-3", attached hereto. B. A holding pond or ponds within the area described on Exhibit "B-2" shall be constructed and maintained by the contractor and used to contain water pumped for necessary dewatering of the clay borrow pits. C. Holdin� pond waters, after settlin�, may be conveyed and used for irrigation on lands in the NW 1/4 of the N8 1/4 of Section 31 or conveyed to and used for irrigation on landa in the SW1/4 of the NW1/4 of Section 32, provided there shall be no direct discharge of said waters to Indian Creek. D. Holding pond waters after settling, map also be used to water stockpiled soils, haul roads and the compacted embankments for District Contract Nos. 5 and 6. 4. Topsoil located above clay deposits removed from said clay borrow area shall be atockpiled. Any topsoil stockpiled on the lands described on fixhibit "B-2" shall be protected from water and wind erosion by filter fence around the � . � t • . �,,, downgradient side and sprinkled or hydromulched as the season requires. 5. Topsoil taken from Harvey Place and used for reclamation on the clay borrow area shall not contain sod clamps greater than 4 inches. 6. Excavated pits in the clay borrow area shall be filled to within two feet of finish grade (to match existing grade) and compacted to at least 85X relative compaction. The top 2 feet shall be wheel packed in 6" lifts. The top 1 foot shall be topsoil previously stockpiled on site. Upon completion, the area shall be hydromulched and poked. In the following year, after winter settling, all disturbed areas within the clay borrow area shall be shaped and filled to finish grade, and then planted with a permanent crop as provided by the Clay Removal and Reclamation Plan, attached hereto as Exhibit "B-4". All other areas within the clay borrows are compacted by the clap removal operation shall be ripped, disked and also planted with the same crop. The elay borrow area shall then be returned to the landowner who shall be responsible for the irrigation of the crop. All fencing provided for the clay borrow area shall be left in place for landowner to use or remove at his discretion. 7. '' • EXHIBIT B-4 �rr HBISB LAND AND LIVE3TOCK COMPANY CLAY RBMOVAL AND RECLAMATION PLAN INTRODUCTION The South Tahoe Public Utility District (District) is planning to construct an earthen dam and auxilliary dike for the Harvey Place Reservoir. These two structures require an impervious clay core. One source of clay is located on the Diamond Valley Ranch owned by the Heise Land and Livestock Company [See Figure 1). The District will be contracting for construction of the Harvey Dam and Reservoir. The contractor will negotiate with Clarence Burr, President of the Heise Land and Livestock Company, for purchase of clay. Mr. Burr currently grazes cattle on irrigated pasture in the clay borrow area. The purpose of this plan is to specify procedures to be used by the contractor during clay removal and for restoration of the area to provide irrigated pasture. The irrigated pasture will be provided in a condition equal to or better than existing conditions. SITB ARBA CHARACTERISTIC3 The site is located in the Diamond Valley, Alpine County, Californis. The Valley is approximately two miles East-Southwest � of Woodfords, California. All maps were drawn from the USGS 7.5' Woodfords, California-Nevada Quadrangle. The clay borrow area is located in the Nortwest quarter of Section 31 as shown on Figure 1. The clay borrow area is within a 1300 acre cattle ranch. Of this approximately 900 acres are irrigated pasture. Irrigation ia accomplished by flooding from contour ditches. Irrigation water flows from the Southeast to the Northwest within the clay borrow area pareel. A slough, approximately fifteen feet wide, traverses this parcel. Irrigation ditches are located on both sides of the slough. These contour ditches capture tailwater from upper fields and redistribute it onto lower fields. Native grasses mixed with several varieties of clover are found throughout the valley. CLAY REMOVAL Prior to initiation of the clay removal process the entire parcel will be fenced, with the existing fence utilized on the westerly boundary. The parcel is described in Exhibit 1 and shown on Exhibit 2, map, both attached hereto. The fences will follow the described parcel boundaries and be at least 10 feet awap from nearby ditches. The fence will also be placed so that Heiae Land and Livestock Company personnel can continue to use the access � • Vt . � Y y � . � road along Indian Creek. The Snowshoe Thompson Historical Site will be fenced leaving a 50 foot setback from the site (the footings from his homesite). An irrigation ditch will be constructed parallel to and adjacent to the fence along Diamond Valley Road. The ditch will be level so that flows can be diverted either east or west. Details of the ditch are shown on the construction plans for Contract 6- Harvey Place Dam and Reservoir. The ditch will intercept flows from culverts under Diamond Valley Road. Through the use of check structures flows will be diverted either to the east or to the west. During the clay removal process there are several potential probems. With proper procedure� they can be avoided. These problems include soil erosion, sedimentation in Indian Creek, and dealing with F:ater from clay dewatering operations. The clay removal process requires stripping of topsoil [6-12"] from the surface and then excavation of the clay layer which ranges in thickness from 3-9 feet. The stripped topsoil will be stockpiled at one end of the field as shown on Figure 1. The topsoil will be placed back on the field prior to completion of the project. A haul road will be constructed around the borrow area. The haul road will be a dirt road and will serve as a barrier to prevent runoff from the borrow pit from entering Indian Creek [See cross section of Figure 2). At completion, the haul road•will be removed, underlying soils ripped, and the land shaped where necessary as part of the reclamation plan. As the clay is removed, dewatered and hauled to the dam site, replacement soil will be brought back to the clay borrow area. The replacement soil will be obtained from the reservoir area. After unloading clay, the truck driver will proceed to the reservoir area and load with replacement soil for return to the Heise Ranch. Diamond Valled Road, a paved county road, connects the borrow area to the dam access road [See Figure 3]. Damage to the road caused by trucks will be repaired by the contractor. The perimeter haul road will sllow convenient room to unload replacement soil and load dewatered clay destined for the dam. Dewatered clay will be stockpiled at the southerly end of the - borrow area as shown on Figure 1. To minimize surface soil disruption and potential erosion the clay will be removed one pit at a time. Figure 4 shows the three major clay deposits and are identified as sites 1, 2, 3. The clay dewatering process will result in excess water whieh must be controlled. The excess water will be collected in a pond located at the northerly end of the borrow area. The pond will allow solids to settle. The water will then be pumped out of the pond and will be used to irrigate pasture. The irrigation of the � �� f • r � pasture will provide a filter which will remove solids which do not settle out of the pond [See Figure 5]. Erosion will be controlled by excavation that will minimize slope steepness. Stockpiled soils will be bordered on the downgradient side by a filter fence. The piles will be sprayed with water during the summer months to minimize dust. Stockpiles that remain over the winter will be hydromulched no later than November 1. Off-site runofP will be routed around the borrow area to minimize water flow into and across the borrow area. In summary, the three potential problems will be controlled by positive action. The access road will prevent direct runoff into Indian Creek. Water from dewatering will be used for irrigation oP pasture. Erosion will be controlled by excavation techniques and straw. ItL�CLAMATION PLAN � The reclamation plan is needed to return the pasture to it's existing condition. The first step requires returning the finish grade to existing elevations. Replacement soil will be used to return the grade within 1 foot of existing grade. The last foot will be placed with previously stockpiled topsoil. Compaction of the subsoil (below 2-foot depth) will be at 8596 relative � compaction. The top two feet will be placed in accordance with SCS Nevada specifications 464, 464-A and 464-1, irrigation Land Leveling (fields with shallow topsoil or other depth limitations). The specifications are attached as Exhibit 3. The finish grade will be 0.2 foot above the desired final grade. The disturbed area will be hydromulched and poked. After one year the disturbed area will be disked and reseeded to the following mixture: Drummond Timothy: 3 lb/acre Meadow Foxtail: 3 lb/acre Regar Meadow Brome Grass: 5 lb/acre The above seed will be planted together, mixed with rice hulls (1 lb seed with 3 lb rice hulls) and grain drilled to 1/2 inch or less. Heise Land and Livestock Company historical sup- plemental water rights for the Scossa and Trimmer Ranches from Indian Creek (Claim Numbers 49, 50, 51, and 52 as set forth in the Final Decree entered by the United States District Court for the District of Nevada in United States of America v. Alpine Land & Reservoir Company, et al., Civil No. D-183 BRT) will be con- veyed through the Harvey Diversion Structure and Channel; (c) F. Heise Land and Livestock Company may, at its discretion, utilize the Harvey Channel to convey irrigation water normally conveyed by Millich Ditch to irrigate lands covered by water right Claim Numbers 451, 452, and 466 combined with Indian Creek Supplemental Water Rights Claim Numbers 49, 50, 51, and 52. Heise Land and Livestock Company may divert directly to on-farm ditches or use the channel in conjunction with the Millich Ditch.
