WHEREAS, the �OUTH TAHOE PUBLIC UTILITY DISTRICT
proposes to construct, operate and maintain a wastewater
effluent storage and conveyance facility with related
recreational and wildlife habitat benefits for which it
is necessary to acquire by proceedings in eminent domain
certain property and rights, including water rights;
WHEREAS, this Board on June 12, 1986 and after
complying with the provisions of Section 1245.235 of the
Code of Civil Procedure, adopted Resolution No. 2401,
authorizing the commencement of condemnation proceedings
to acquire certain property and rights, including water a
� rights for the proposed Project; and
69HEREAS, by letters sent by first-class mail on
January 21, 1987, this District gave notice to each person
whose property is to be acquired and to their attorneys of
record that this Aoard on February 5, 1987 would consider
the adoption of an amended Resolution of Necessity; and
WHEREAS, the proposed amendments will describe
the proposed Project and the specific property and rights,
including water rights sou_qht to be condemned, and further
describe how wa ters may be used and/or diverted, conveyed
or stored when the proposed Project is constructed and
operational;
NOW, THEREFO RE, IT IS HEREBY RESOLVED, DETERMINED,
� AND FOUND BY THE BOARD OF DIRECTORS OF SOUTH TAHOE PUBLIC
UTILITY DISTRICT AS FOLLOWS:
1. The public use for which the property and
� rights, including water rights are to be acquired �y the
District is to construct, ope rate, maintain and use in
Alpine County, California the Harvey Dam and Reservoir, a
wastewater effluent storage facility with related wildlife
habitat benefits, and to acquire water rights and related
diversion and conveyance rights for use in a recreational
reservoir at the Indian Creek Reservoir, cumulatively
referred to herein as the "proposed Project."
2. The statutes which authorize the District to
acquire the property and rights, including water rights are
Section 16404 of the California Puhlic Utilities Code, and
the Eminent Domain Law, comprising Title 7 of Part 3 of the
Code of Civil Procedure com mencing with Section 1230.010,
� including Section 1240.410.
3. �he property and rights, including water
rights which the District seeks to acquire by proceedings in
eminent domain are situated in Alpine County, California,
and are described and depicted in Exhibit A attached hereto
and incorporated herein.
4. This Board hereby declares that it has found
and determined each of the following:
(a) The public interest and necessity require
the proposed Project;
(b) The proposed Project is planned or located
in the manner that will be most compati�le with th.e
greatest public good and the least private inju ry;

(c) The property and rights, including water
rights described in this resolution are necessary for the

proposed Project; and
(d) The offer required by Government Code
Section 7267.2 has been made to the owners of record of
the property and rights, including water rights described
in this resolution.
5. In the event of description or other variances
or ar.ibiguities, this resolution supersedes Resolution No. 2401.
The foregoing resolution is passed and adopted
this 5th day of February 1987, on the following vote, which
is the affirmative vote of at least two-thirds (2/3rds) of
all of the members of the Board of Directors of SOUTH TAHOE
PUBLIC UTILITY DISTRICT.

EXHIBIT A
LEGAL DESCRIPTION - HARVEY PLACE PARCEL
All that certain real property in fee situate in the County of
Alpine, State of California, more particularly described as
follows:
West half of Lots 4, 10, 11 and 14 of Section 4; all of Lots 12
and 13 of said Section 4; East half of Lots 3 thru 6 inclusive of
Section 5. All in Township 10 North, Range 20 East, M.D.B.&M.
Containing 480 acres more or less.
Together with all rights, if any, of condemnees in and to the
Reservoir known �s Stevens Lake located in the above described
, real property and in the Vdest half of Lots 5 and 6 and in the
East half of Lot 11, Section 4, all in said Township 10 1Vorth,
Range 20 East, M.D.B.&M.
Together with all water rights for the above described real
property, including, without limitations, the decreed e�ater
rights referred to in claim numbers 47, 48, 453, 454, and 455, as
set forth in the Final Decree entered by the United States Dis-
� trict Court for the District of Nevada in United States of
America v. Alpine Land & Reservoir Company, et al , Civil No. D-
183 BRT, and the related rights in and to the Snowshoe Thompson
No. 1 Ditch, also sometimes referred to as the Diamond Valley
Ditch„ and Indian Creek, shown on Exhibit 1(Map of Harvey
Place) and Exhibit 2(Water Conveyance) attached hereto and in-
corporated by this reference, which said rights upon completion
of condemnor`s project as described in Paragraph 3 of the Amended
and Supplemental Complaint (Eminent Domain CCP Section 1250.310)
to which this Exhibit A is attached, include:
1. The right to the use of the full Ditch capacity of
Snowshoe Thompson No. 1 Ditch for up to 7.5 days per month during
the months of April, �tay, and June each year to convey water from
the West Fork of the Carson River through said Ditch and Indian
Creek to the Indian Creek Reservoir until the full entitlement
under claim numbers 453, 454, and 455 are fully met, provided
that no more than 40� of the total entitlements pursuant to said
claim numbers can be diverted and conveyed in any one month.
2. The right to the use of the full Ditch capacity of
Snowshoe Thompson No. 1 Ditch to convey purchased water not sub-
ject to said claim numbers 453, 454, and 455 through said Ditch
and Indian Creek to Indian Creek Reservoir during any Nevada Week
.after the Federal j9atermaster designates California-Nevada Rota-
tion pursuant to said Final Decree.

� 3. The right to change the point of diversion on In-
dian Creek for the water rights referred to in claim numbers 453,
454, and 455 and to then convey those waters to Indian Creek
Reservoir and to use said waters in said reservoir for recrea-
tional purposes.
4. The right to change the point of diversion on In-
dian Creek for water subject to claim numbers 47 and 48 and to
then convey those waters to Indian Creek Reservoir and to use
those waters for recreational purposes.
5. The F. Heise Land & Livestock Company and its suc-
cessors and assigns shall have the right to use the Upper
Dressler Ditch and Indian Creek Pipeline to convey waters subject
to claim numbers 49, 50, 51, 52, 451, and 452 af the Final Decree
entered by the United States District Court for the Distri�ct of
Nevada in United States of America v. Alpine Land & Reservoir
Company, et al., Civil No. D-183-BRT.
6. F. Heise Land & Livestock Company and its succes-
sors and assigns may utilize Indian Creek Reservoir for water
storage provided volumes do not exceed 110 acre feet annually and
provided that storage does not exceed the District operating rule
curve for total storage volumes, a copy of which is attached
hereto as Exhibit A-1. F. Heise Land & Livestock Company is
� responsible for obtaining Federal Watermaster and/or District
Court approval. South Tahoe Public Utility District will not
object. This right to utilize Indian Creek Reservoir for water
storage must also be approved by the Alpine County Water Agency
and the Board of Supervisors of Alpine County.
