Resolution 2397 RESOLUTION NO. 2397 "\. A RESOLUTION TO ESTABLISH DISTRICT RELOCATION BENEFIT APPEAL PROCEDURES RESOLVED, by the Board of Directors of the South Tahoe Public Utility District, El Dorado County, California, that, WHEREAS, the regulations implementing the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, 40 Code of Federal Regulations Section 4.104 (b), provides that agencies undertaking EPA-assisted projects shall establish procedures for appeals by aggrieved applicants for relocation benefit payments; and WHEREAS, the South Tahoe Public Utility District is undertaking the Alpine County Project with EPA ~ assistance; NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED, and ORDERED that the Board hereby adopts the appeal procedures set forth in the attached Exhibit A, which procedures are incorporated by reference as if set forth in full herein. HAMATH Clerk and Secretary of the South Tahoe Public Utility District -2- '-' '-' \.., SOUTH TAHOE PUBLIC UTILITY DISTRICT RELOCATION BENEFIT PAYMENT APPEAL PROCEDURES Applicants for relocation benefit payments relating to the South Tahoe Public Utility District Alpine County proj ect who are aggrieved by the District's determination as to the applicant's eligibility for payment or the amount of the payment may appeal that determination in accordance with the following procedures. A. The District's relocation benefit payment decision may be appealed to the South Tahoe Public Utility District Board of Directors. B. Notice of such an appeal shall be made in writing by the applicant to the South Tahoe Public Utility District Board within thirty (30) days after the date that a written record of the District's decision is deposited in the mail, addressed to the applicant's address of record. C. The District Board of Directors shall set such appeal for hearing wi thin thirty (30) days of receipt of applicant's notice of appeal. The Board of Directors shall render a decision on each appeal within sixty (60) days of the District's receipt of applicant's notice of appeal, unless the applicant-appellant elects to continue any hearing on the appeal. D. Each appellant shall be provided the opportunity for oral and written presentation and the right to have counsel participate in such presentation before the district board of directors. Each decision on an appeal shall be supported by a written statement of the reasons upon which the decision is based, and a copy of such decision and supporting statement shall be furnished to the appellant. F. The District shall promptly pay any amounts determined to be due the claimant. G. The District shall retain all documents associated with each appeal for a period of at least three (3) years after completion of the project. EXHIBIT A, Page 2 of 2
