With the consent of the Alpine County Board of Supervisors and the District's Board of Directors, Alpine County has agreed to prepare the MOU. Staff and the District's legal counsel will review the agreement to ensure it covers all necessary details of the arrangement. Key points of the agreement will be discussed at the Board meeting. The present Agreement for Services of Grant Coordinator expires June 30, 2003. Staff is also requesting that the present agreement be extended on a month-to-month basis until such time as an agreement is signed with Alpine County for sharing a full-time employee to provide grant services. DISCUSSION: At the May 15, 2003 Board Meeting, the Board received the annual report on the 2002 Plan Year from BB&H Benefit Desiqns (BB&H). During that meeting, staff informed the Board of experiencing high claims costs during the first four months of 2003, and that research would be performed to determine the appropriate Plan funding level. Staff met with the Finance Committee on June 4, 2003, and provided BB&H's estimated funding level of $924.54 per employee per month. BB&H's estimate includes a 16.5% industry inflation factor for medical claims and a 9% industry inflation factor for dental claims. The District is currently funding the Plan at $725 per employee per month. Staff recommends increasing the funding level to $900 per employee per month, retroactive to January 1, 2003. This will replenish diminished reserves by $98,000, and more accurately reflect estimated actual costs. While reviewing the District's claims procedures, Hatch & Parent discovered that the District has not adopted procedures for claims by other public entities against the District. The law authorizes the District to adopt procedures for state and local entities and in doing so can protect the District from unanticipated and stale claims brought by other public entities. While reviewing the District's claims procedures, we discovered that the District has not adopted procedures for claims by other public entities against the District. Therefore, we have attached a proposed Ordinance of the Board, adding Division 2.9 to the Administrative Code, which would adopt the same procedures that apply to private claimants for public entities. Discussion A. Tort Claims Forms The Tort Claims Act" (Government Code section 810 et seq.) provides, with few exceptions, that prior to suing a public agency for monetary damages, a claim must first be filed with the public agency. Prior to the recent amendment, section 910.4 provided that: The [board] may provide forms specifying the information to be contained in claims against the public entity. A claim presented on a form provided pursuant to this section shall be deemed to be in conformity with Sections 910 and 910.2 if the claim complies substantially with the requirements of the form or with the requirements of Sections 910 and 910.2. The courts have held that to the extent a claimant provides the information required by a form provided pursuant to this section, the public agency has waived any defect in the claim for claimants failure to provide necessary information and that any claim so filed meets the threshold notice requirement for a claim under the California Tort Claims Act. (Martinez v. Los Angeles County (App. 2 Dist. 1978) 144 Cal. Rptr. 123; Mabe v. San Bernardino County, Dept of Public Social Services (2001) 237 F.2d 1101.) AB 3000, chapter 1124, statutes of 2002, amended section 910.4 to say: (a) The board shall provide forms specifying the information to be contained in claims against the public entity. The person presenting a claim shall use the form in order that his or her claim is deemed in conformity with Sections 910 and 910.2. A claim may be returned to the person if it was not presented using the form. Any claim returned to a person may be resubmitted using the appropriate form. (Emphasis added.) This amendment took effect on March 30, 2003. We have prepared a claim form for your review and adoption to comply with this provision. The form should be adopted as soon as possible. B. Procedures For Tort Claims Generally, the Tort Claims Act ("the Act") requires that a claim be presented to a public agency before a lawsuit is instituted. The Act's purpose is to give a public agency a timely opportunity to investigate a claim and determine facts, and reduce public costs by giving the parties the opportunity to settle meritorious claims without going through trial. (Lacy v. City of Monrovia (1974) 44 Cal. App. 3d 152 [118 Cal. Rptr. 277.) A claim must contain the following information: "(a) The name and post office address of the claimant. SB 329693 v 1; 007627.0001 Adoption of Claims Procedures for Public Entities and Tort Claims Form for Claims Against the District June 10, 2003 Page 3 (b) The post office address to which the person presenting the claim desires notices to be sent. (c) The date, place and other circumstances of the occurrence or transaction which gave rise to the claim asserted. (d) A general description of the indebtedness, obligation, injury, damage or loss incurred so far as it may be known at the time of presentation of the claim. (e) The name or names of the public employee or employees causing the injury, damage, or loss, if known. (f) The amount claimed .... "(Gov. Code, § 910 [section citations hereafter are to the Government Code].) Claims must be "signed." (§ 910.2.) Additionally, as of March 30, 2003, claim forms must be provided by public agencies and claims must be submitted on such claim forms. (§ 910.4.) Claimants may amend their claims either before the agency acts on the claim or before the time period in which a claim must be filed expires, whichever is later. (§ 910.6.) If the District finds that the claim does not "comply substantially" with the above-noted requirements, the District may, within 20 days after the claim is "presented," provide the claimant with a written notice of insufficiency. (§ 910.8.) A claim is "presented" on the date it is deposited in the mail, however, any period of notice and any duty to respond after receipt of service of a claim, amendment, application, or notice is extended five days upon service by mail, if the place of address is within the State of California, 10 days if the place of address is within the United States, and 20 days if the place of address is outside the United States. (§ 915.2.) Such notice must "state with particularity the defects or omissions" in the claim. (§910.8.) Notices of insufficiency must be either personally served or mailed to the address provided in the claim. (See §§ 910.8,914.5.) The District may not take action until 15 days following the giving of a Notice of Insufficiency. The failure to provide the claimant with a notice of insufficiency waives any defense by the public agency based on a defect or omission in the claim. (§ 911.) Form Number 1, serves as a sample Notice of Insufficiency; it must be provided within 20 days of the presentation of the claim. Claims must be presented either within six months or one year of the date of "the accrual of the cause of action." (§ 911.2.) Generally, claims involving personal injury and damage to personal property must be brought within six months of the date of injury of damage. (See § 911.2.) (§ 911.2.) If a claim is late, the agency has either 20 days or 45 days to reject it on those grounds (§ 911.3), although the claimant may apply to the agency for leave to present a late claim. (§ 911.4.) Form Number 2 should be used to provide notice that the claim was rejected because it was not filed within the six-month period for the filing of claims. However, should the claim be subject to the one-year period for filing claims, Form Number 1 should be used. Following the "presentation" or the amendment of a claim, the agency has 45 days to act. (§ 912.4, subd. (a).) If the 45-day period expires and the agency has not acted, the claim is "deemed rejected." (§ 912.4, subd. (b).) In acting on a claim, the agency may take the following actions: "(1) If the board finds the claim is not a proper charge against the public entity, it shall reject the claim. (2) If the board finds the claim is a proper charge against the public entity and is for an amount justly due, it shall allow the claim. (3) If the board finds the claim is a proper charge against the public entity but is for an amount greater than is justly due, it shall either reject the claim or allow it in the amount justly due and reject it as to the balance. (4) If legal liability of the public entity or the amount justly due is disputed, the board may reject the claim or may compromise the claim." (§ 912.6, subd. (a).) Whether the agency takes action or a claim is "deemed rejected" by the agency's failure to act within the statutory period, the agency should provide written notice to the claimant of its action. (§ 913.) The following statutory paragraph is suggested: "'Notice is hereby given that the claim which you presented to the (insert title of board or officer) on (indicate date) was (indicate whether rejected, allowed, allowed in the amount of $ and rejected as to the balance, rejected by operation of law, or other appropriate language, whichever is applicable) on (indicate date of action or rejection by operation of law).'" C. Tort Claims Act Claims by Public Entities Generally, the Tort Claims Act ("the Act") requires that all actions against a public entity seeking money or damages must be preceded by a proper claim. Only if the action is exempted can a claim be omitted. Government Code §905 provides an exception from the claims requirement for public entities. The legislature has specifically exempted claims by public entities from the claim requirement. (§905(i); City of Ontario v. Superior Court (1993) 12 Cal. App.4th 894.) A public entity includes the State or a state department or agency or another local public entity. A local public entity includes "a county, city, district, public authority, public agency, and any other political subdivision or public corporation in the State, but does not include the State." (§900.4.) Section 935 provides a means for a public entity to override the §905 exceptions. Section 935 specifically empowers local public entities to establish their own polices and procedures for thc, presentation of those claims which are excepted by §905, provided that the local claims requirements are similar to, and no more restrictive than, those established by the Act. (§935; City of Ontario, supra.) In City of Ontario, the court considered whether the State, exempt from filing a claim under §905(i), was nevertheless required to file a claim with the local public entity when that entity had enacted an ordinance pursuant to §935 establishing its own policies and procedures for the presentation of claims against it which were excepted from §905. The Court held that the State was required to file a claim with the local agency. In its decision the Court stated: Sections 905 and 935, read together, are clear. Section 905 creates exemptions from the state-mandated claims procedure; section 935 permits local public entities to enact their own procedures to cover the exempted claims. Section 935, by its terms, covers all "[c]laims against a local public entity for money or damages which are excepted by Section 905 .... "It does not incorporate any suggestion whatsoever that it does not apply to claims by the State. Subdivision (i) exempts not only claims by the State but also those by local public entities. However, pursuant to §935, a local public entity may bind other public entities, both state and local, to the claims provisions it establishes. (City of Ontario, 12 Cal.App.4th at 901-902.) The District could likewise require state and local agencies to file claims pursuant to procedures adopted by the District. However, the District has not yet adopted procedures for the presentation of claims by public entities pursuant to §935. The attached resolution would make public entities subject to the same requirements as private individuals. The Board - The Board of Directors of the South Tahoe Public Utility District. C. Administrative Code - The compilation and codification of all of the Administrative, Water, Sewer, Street Lighting and Groundwater Management Plan Ordinances of the District, which establish the authority and the principles for decisions of the District, and provide the public with guidelines applicable to District operations. SECTION III - FINDINGS The Board of Directors of the South Tahoe Public Utility District, County of E1 Dorado, State of Califomia, make the following findings: 1. Generally, the Tort Claims Act requires that all actions against a public entity seeking money or damages must be preceded by a proper claim. Only if the action is exempted can a claim be omitted; and, 2. Government Code section 905 exempts certain enumerated claims, including claims by other public entities, from the claim presentation requirements of the Tort Claims Act, Government Code sections 900 et seq.; and, 3. Claims 2.9.1 General Tort Claims Procedures The California Tort Claims Act sets out the procedures for filing a claim against the South Tahoe Public Utility District for money damages. The applicable provisions of law can be found in California Government Code sections 810-996.6. The District provides a claim form which, pursuant to Government Code section 910.4, must be used for all tort claims against the District. 2.9.2 Tort Claims by Public Entities Pursuant to the authority contained in Government Code section 935, the following claims procedures for those claims against the South Tahoe Public Utility District for money or damages not now governed by state or local laws shall be as follows: Notwithstanding the exemptions set forth in Government Code section 905, all claims for money or damages against the South Tahoe Public Utility District, when a procedure for processing such claims is not otherwise provided by state or local laws, shall be presented within the time limitations of Government Code sections 910 through 915.2. Such claims shall further be subject to the provisions of Government Code sections 945.4 and 945.6 relating to the prohibition of actions in the absence of the presentation of claims and action thereon by the District. SECTION V- SEVERABILITY If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance and its implementing rules and regulations is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance or the Administrative Code. The items included in this amendment request all reflect changes in scope that are required as a result of the ongoing Environmental Impact Report/Statement (EIR/S) process. An explanation for each item contained in this amendment request is presented in the following. The associated costs for each item and the total cost for this amendment are presented in the attached Labor Hour and Cost Estimate. Survey - G.S. Concepts requires additional funds to complete the survey on the alignment that will be recommended in the final EIR/S. We have complete surveys on Routes A and B. However, Route E, the recommended route uses: · a portion of Route A (from the Luther Pass Pump Station to State Highway 89) and, · a portion of Route B (from State Highway 89 at the intersection with the Campground Road to the tie in further up the Campground Road) and, · a new, previously unsurveyed connection between the two original routes (A & B). The additional work included in this amendment is to complete a detailed survey on State Highway 89 to connect the lower half of Route A to the upper half of Route B. This survey will include cross sections every 25 feet from top of bank to toe of bank. It will also extend at least 150 feet beyond the Route intersection points to provide the information required to build any transition that may be necessary between the project and the highway. The additional survey work in this amendment also includes a more detailed survey centered on the crossing of Grass Lake Creek on the Campground Road. This work is necessary to design the bridge over the creek as requested by the Forest Service. The bridge will serve as partial mitigation for environmental disturbance created by the completion of this project. Previous surveys in this area did not include the detail necessary to design and construct a bridge. Geotechnical Investigations - AMEC Earth and Environmental, Inc. has to complete seismic testing and drill test bores along the recommended Route for the design of the new pipeline. Work done previously on Route B will be used. However, work was held off on Route A waiting for the final alignment decision to be reached. The work included under this amendment includes the required seismic testing and test bores on the portion of Route A being used and along State Highway 89 to the Campground Road. Revegetation - Western Botanical Services has been involved in responding to Forest Service, Tahoe Regional Planning Agency (TRPA) and Lahontan Regional Water Quality Control Board (Lahontan) questions, comments and concerns in support of the EIR/S process. The flow figure for the 100 year design flow will be provided by Parsons HBA and reviewed by the Forest Service. Developing the anticipated 100 year storm flow is not included in this scope of work. The requirement to design a bridge instead of replacing the existing culvert requires: 4. additional, more detailed survey (which is included in this amendment request under survey, above), 5. detailed design of the new bridge structure including footings, crossing slab, pipeline installation slope and associated structural details. The above was not included in the original scope of work for this project. Our Scope of Work (Exhibit A, attached) includes just the items contained in this amendment and is based upon our understanding of the revised alignment. The amended engineering cost for the completion of the tasks contained in the Scope is $144,600. The development of this cost is detailed in the attached Labor Hour and Cost Estimate (Exhibit B). Engineering fees will be based on the current fee schedule (Exhibit C). Proiect Manager RAG/JLB:dmr Enclosures: Exhibit A H:\BD_SAC\STPUD\B-LINE PhaSE 3\B-LINEPHASE3PIPELINEADDENDUM#3A-DOC EXHIBIT A SOUTH TAHOE PUBLIC UTILITY DISTRICT AMENDMENT #1 TO THE B-LINE REPLACEMENT PHASE 3 PROJECT Scope of Work The following describes the added Scope of Work for the engineering effort to complete the design of the B-Line Phase 3 Project on the new alignment. Bidding and construction services associated with the replacement of the existing export pipeline (B-Line) between the Luther Pass Pump Station and the new pipeline installed in the Forest Service Campground (at approximately existing Station 45+00) will be completed as part of the original contract. The pipeline will follow a new route between the tie in locations at either end. The new route developed as part of the EIR/S process has been named Route E and can be described as follows. Route E generally parallels the existing force main from the Luther Pass Pump Station to State Highway 89. Route E then turns and runs parallel to State Highway 89 to the intersection of State Highway 89 and the upper Campground Road. At this point Route E turns and runs up the Campground Road to the intersection with the new pipe installed in the Campground in 1996. The new alignment includes two crossings of Grass Lake Creek, one in State Highway 89 and one in the Campground Road. As a mitigation measure the Forest Service is requiring that the crossing in the Campground Road be completed using a bridge instead of replacing the CMP culvert currently being used. An export system shut down will be required to connect the new pipeline to the existing discharge at the Luther Pass Pump Station and at the connection in the Forest Service Campground. Traffic control will be required to complete the installation of the new pipeline where it parallels State Highway 89 and (possibly) to maintain homeowner access on Grass Lake Road (assuming the Luther Pass Pump Station is used as a staging area). The completion of this project will conclude the replacement of the B-Line between the Luther Pass Pump Station and the top of Luther Pass and will also finish the replacement of the entire force main within the Lake Tahoe Basin. The amendment includes a geotechnical investigation of the new alignment and a new route survey. The geotechnical investigation will be completed by AMEC Earth and Environmental, Inc.. Information from the geotechnical investigations will include boring and soil testing to determine the requirements for pipe bedding/installation, blasting and, the corrosion potential of the soils to be encountered. The new route survey will be completed by G.S. Concepts and will be used to develop the required plan and profile for the construction drawings. Revegetation requirements will be completed by Western Botanical Services. Except as noted herein, all other engineering services contained within the following tasks are to be provided by Engineer as required by the District. Task 1 - New Pipeline Evaluation - to be completed as indicated under the original design contract. Task 2 - Geotechnical Investigation A geotechnical investigation will be conducted by AMEC Earth and Environmental, Inc. as a subconsultant to the Engineer to classify the soils that will be encountered during the installation of the new pipeline. The completion of this task shall be based on the completion of surface seismic lines within the proposed new alignment and soil borings. Spacing will be based on the review of available soils information along the project route as researched by the subconsultant and access for equipment. A geotechnical evaluation report shall be prepared by AMEC. The report shall include: 1. The identification of possible excavation problems due to the existing geology. The geotechnical consultant shall comment on the probable need for blasting and the rip-ability of the rock for pipeline installation. 2. Soil stability during excavation. Recommendations will be made regarding required side slopes to prevent caving during pipeline installation and the use of a trench box or shoring. 3. The location of groundwater (if encountered). Comments shall also address possible seasonal fluctuations of groundwater that may be expected at each bore hole location. 4. The location of other materials encountered that may effect the installation of the new pipeline as well as the reconstruction of the effected roadway and recommended procedures for accommodating these materials during pipeline installation and roadway reconstruction. 5. An evaluation of the corrosiveness of the soils along the chosen pipeline route including recommendations for protecting the new pipeline (if required). 6. Recommend bedding materials and methods based on the results of the geotechnical analysis. 7. Seismic information required to complete design of high pressure steel pipe. The geotechnical report, prepared for purposes of the design, including the results of the boring and soil testing, will be provided to the District. Task 3 - Survey The additional work included in this amendment is to complete a detailed survey on State Highway 89 to connect the lower half of Route A to the upper half of Route B. This survey will include cross sections every 25 feet from top of bank to toe of bank. It will also extend at least 150 feet beyond the Route intersection points to provide the information required to build any transition that may be necessary between the project and the highway. The additional survey work in this amendment also includes a more detailed survey centered on the crossing of Grass Lake Creek on the Campground Road. The additional survey will extend at least 150 feet above and below the creek crossing and extend at 2 least 50 feet beyond the edge of pavement on each side of the existing road. This work is necessary to design the bridge over the creek as requested by the Forest Service. The additional survey shall be completed using 1 foot contours. Previous surveys in this area did not include the detail necessary to design and construct a bridge. The results of the survey will be provided to the Engineer by the subconsultant in AutoCAD, release 14.0 compatible format, such that the information can be laid out on plan and profile sheets at 40 scale for the construction drawings and can be easily incorporated into the original survey. The surveyor will also be required to: 1) Stake the construction easement and center line of pipe for the Contractor layout at 100 foot stations and at standard angle points (11 lA, 22 Y2, 45 and 90 degree angles). Staking construction easement and center line of pipe will be required at least three times: a) for final agency walk prior to finalizing the plans for the project, b) for the prebid walk and, c) just prior to Contractor start of construction. The surveyor shall establish offsets and control points as required to re-establish the easement and centerline should they be damaged or lost in the interim between agency walks, prebid and the beginning of construction. It is important to note that there could be up to 8 months between the different walks. The Contract Documents shall require the Contractor to be responsible for maintaining all monuments and control points after construction begins. Task 4A- Structural Bridge Design This item has been designated 'q'ask 4A" because it was not part of the original design concept so it is an out of scope item, however, it will be completed as part of the pipeline design in the overall project. The additional work to be completed under this item includes: · Preparation of plan and profile construction drawings of the new pipeline based on the survey completed under Task 3 and comments received from the District, other utilities and environmental process documentation through the bridge crossing area. · Structural construction drawings of the bridge for the crossing of Grass Lake Creek. Bridge design will be based on accommodating the 100 year flow as provided by Parsons HBA and reviewed by the Forest Service. Development of the anticipated 100 year storm flow is not included in this scope of work. · Preparing construction specifications and contract documents. Construction specifications and contract documents will incorporate any requirements developed during the environmental process and any grant requirements. Task 5 - Bidding Services- to be completed as indicated under the original design contract. Task 6 - Construction Services- to be completed as indicated under the original design contract. 3 Task 7 - Meetings/Site Visits Engineer shall attend and prepare minutes for 4 additional meetings/site visits upon the request of the District. Compliance with Law. The County shall comply and conduct its activities in accordance with all local, state and federal laws. The County shall obtain, at its sole cost and expense, any and all permits and consents from any such governmental agencies having jurisdiction that are necessary for performance of its rights and obligations pursuant to this License Agreement. 4. Insurance. Notwithstanding ~at the County is Self-insured, the c°unty shall require, me3udmgqts agents, contractors and consultants, t° shall procure and maintain during the Term, at its/their own cost and expense automobile liability insurance with limits not less than One Million Dollars ($1,000,000) per occurrence, comprehensive general liability insurance with limits of not less than One Million Dollars ($1,000,000) per occurrence and statutory workers' compensation insurance. The provisions of this Agreement should be liberally construed to effectuate its purposes. If any term, provision, covenant or condition of this Agreement shall be or become illegal, null, void or against public policy, or shall be held by any court of competent jurisdiction to be illegal, null or void or against public policy, the remaining provisions of this Agreement shall remain in full force and effect and shall not be affected, impaired or invalidated thereby. The term, provision, covenant or condition that is so invalidated, voided or held to be unenforceable shall be modified or changed by the parties to the extent possible to carry out the intentions and directives stated in this Agreement. 6.4 Signatures - Counterparts. This Agreement may be executed in two or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. This Agreement shall not be effective until the execution and delivery between each of the parties of at least one set of counterparts. The parties authorize each other to detach and combine original signature pages and consolidate them into a single identical original. Any of such completely executed counterparts shall be sufficient proof of this Agreement. 6.5 Assignment. A party shall not voluntarily or by operation of law assign, hypothecate, give, transfer, mortgage, sublet, license, or otherwise transfer or encumber all or any part of its fights, duties, or other interests in this Agreement or the proceeds thereof (collectively, Assignment), without the other party's prior written consent, which consent shall not be unreasonably withheld or delayed. Any attempt to make an Assignment in violation of this provision shall be a material default under this Agreement and shall be null and void. Absent an express signed written agreement between the parties to the contrary, no assignment of any of the rights or obligations under this Agreement shall result in a novation or in any other way release the assignor from its obligations under this Agreement. 6.6 Successors and Assigns. This Agreement shall be binding on and shall inure to the benefit of the parties and their respective heirs, legal representatives, successors and permitted assigns, except as restricted by this Agreement. 6.7 Waiver. No waiver of any provision or consent to any action shall constitute a waiver of any other provision or consent to any other action, whether or not similar. No waiver or consent shall constitute a continuing waiver or consent or commit a party to provide a waiver in the future except to the extent specifically stated in writing. Any waiver given by a party shall be null and void if the party requesting such waiver has not provided a full and complete disclosure of all material facts relevant to the waiver requested. Rhonda McFarlane reported the District's Union and management employees voted to approve participation in the CalPERS retirement system and to adopt two side letters that were previously approved by the Board. She introduced Myles Margady, Public Agency Retirement Planning, Inc., who reviewed the benefits of CalPERS. RESOLUTION OF INTENTION TO ENTER INTO A CONTRACT WITH CALPERS (CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM) Moved Schafer / Second Wallace / Passed Unanimously to: (1) Adopt a Resolution of Intention to approve a contract between South Tahoe Public Utility District and CalPERS; and (2) Authorize execution of Certification of Governing Body's Action. Board members commended staff for their diligence in bring this to fruition. Staff thanked the Board for their cooperation and support. The District is entering into Letters of Agreement with the management staff and Stationary Engineers, Local 39. In one of the Letters of Agreement, the District agreed to SOUTH TAHOE PUBLIC UTILITY DISTRICT DEFERRED COMPEN- SATION PLAN AMENDMENT REGULAR BOARD MEETING MINUTES - MAY 15, 2003 PAGE - 4 allow participant loans from the Deferred Compensation Plan. Participant loans are an optional provision allowed for under the Economic Growth and Tax Relief Reconciliation Act of 2001. The District requested that the Christiana Inn install a 320 gallon grease interceptor, based upon a study of grease producers in South Lake Tahoe. The owner, Gerald Mershon, has been granted an extension on several occasions. He has requested another extension due to financial reasons. Lisa Coyner reported Mr. Mershon presented this issue to the Operations Committee at their May 13 meeting. It was agreed that Mr. Mershon will attend the June 2 Operations Committee to continue discussion of this issue. In order to ensure the interceptor is installed during this construction season, the committee requested Mr. Mershon bring a time line of installation progress and a plumbers estimate to the meeting with him. No Board action. The District has been working with El Dorado County (County), California Tahoe Conservancy (CTC), and the City of South Lake Tahoe (City) regarding use and maintenance of the Al Tahoe access road. The County and CTC have entered into an agreement for the County to construct recreational and related improvements on the CTC property. The County has requested the District grant a license over the District's property to construct and install the improvements. The District is currently in negotiations with the City to determine if it would accept a dedication of the road from both the District and CTC. A dedication of the road would significantly simplify the required arrangement since the access road would be a public road (no agree- ments for its use would be necessary). The County anticipates commencing construction in June which would not allow sufficient time to finalize arrangements concerning the access road. Accordingly, staff recommended that the Board approve a License Agreement between the District and the County to allow the County to use the access road for construction and installation of ballfields. Director Mosbacher disqualified herself from participation in this item per a previously disclosed potential conflict of interest. Richard Solbrig reported he sent a letter to TRPA request- ing their assistance in keeping the project on schedule to allow construction in the 2004 building season. Since the final route alternative still has not been approved, and in order for the District to keep on schedule, it is necessary to commence with final design ahead of approval. Administration Ad Hoc Committee: The committee met with the architect regarding building and site design. There are many regulatory requirements the building must conform to. Deborah Babineau and Soozie Brooks, BB&H Benefit Design, Inc., gave an overhead presentation that reviewed administrative and privacy requirements of the Health Insurance Portability and Accountability Act of 1996. They also distributed a handout to the Board containing an Executive Summary of the medical self- insurance program's 2002 Plan Year Experience. Funding levels for the self-insured medical plan will be discussed at a future Finance Committee meeting. Interim General Manager: Richard Solbrig reported the waterline replacement project was underway. Manager of Water Operations: Rick Hydrick distributed results of the lab tests taken on the Bakersfield Well, Extremely Iow levels of MTBE were detected while modifying the well to comply with future arsenic standards. Further investigations will be done. Hydrick reported MTBE was also detected in the Paloma sentinel well. Staff has met with Lahontan and an investiga- tion will be done. District Information Officer: Dennis Cocking reported he will meet with Assemblywoman Kehoe regarding the water metering bill, Director Wallace reported he will attend a special Board meeting of the agency on May 16 to resolve the General Manager situation. They now have five Board members (Rusty Dupray replaced Carl Borelli). In 1997, a Grease Mana(lement Work Group was created to develop a program to reduco .the (lrease problem within our District. The District is located in an extremely environmentally sensitive area and sewer spills are unacceptable. With the implementation of the Grease Mana(lement pro.qram, the maintenance crews have noticed significant decreases in (lrease deposits in the sewer lines. This means less required maintenance resulting in public resources savin(ls. The payback for restaurants is a savin(ls on insurance, no interruption in business due to blocked sewer lines, and minimizin(l of plumbing problems. For all customers, the District's savings in maintenance and liability claims will help keep sewer rates down.
