RESOLUTION NO. 2 181
A RESOLUTION AUTHORIZING IN REM
VALIDATING PROCEEDINGS
FALLEN LEAF LAKE
FOREST SERVICE PERMITTEES
ASSESSMENT DISTRICT 1979-1
RESOLVED, by the Board of Directors of the South Tahoe Public Utility
District, E1 Dorado County, California, that
WHEREAS, this Council has conducted proceedings under and pursuant to
Resolution No. 2156, A Resolution of Intention to Make Acquisitions and
Improvements, adopted August 16, 1979, in which proceedings this Council has
confirmed and levied special assessments on the parcels of land to be
benefited by said improvements;
WHEREAS, said proceedings are being conducted under and pursuant to the
Municipal Improvement Act of 1913, Division 12 of the Streets and Highways
Code of the State of California, except that bonds to represent unpaid
assessments are proposed to be issued in the manner provided by the
Improvement Bond Act of 1915, Division 10 of said Code; and
WHEREAS, Section 10601 of said Code provides that an action to determine
the validity of the assessment may be brought by this Council pursuant to
Chapter 9 (commencing with Section 860) of Title 10 of Part 2 of the Code of
Civil Procedure of the State of California;
NOW, THEREFORE, IT IS ORDERED that Jones Hall Hill & White, special bond
counsel for the District, is hereby authorized and directed to initiate and
prosecute to conclusion an action under the above cited code sections to

determine the validity of said confirmed assessment, and to take such action
as may be necessary therein.
