RESOLVED, by the Board of Directors of South Tahoe Public
Utility District, E1 Dorado County, California, that
WHEREAS, it is the intention of this Board to acquire,
construct, reconstruct, complete, repair, maintain and operate
public improvements consisting of underground sewer pipelines
and appurtenances, underground sewer pumping stations and work
auxiliary thereto, and above ground sewer pumping stations and
work auxiliary thereto, for the purpose of transporting sewage,
under and across the lands hereinafter described, together with
the right of vehicular ingress and egress thereon and therefor,
NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED as
follows:
1. The Board of Directors of South Tahoe Public Utility
District has duly noticed a hearing after giving each person
whose property is to be acquired by eminent domain a reasonable
opportunity to appear and be heard on the following matters
referred to:
a. Whether or not the public interest and necessity
require the Fallen Leaf Lake, 19 -1 Special Assessment District
project.
b. Whether or not the Fallen Leaf Lake project is
planned or located in the manner that will be most compatible
with the greatest public good and the least private injury.
c. Whether or not the property sought to be acgidi — e

2. A general statement of the public use for which the
1 property is to be taken and a reference to the statutes that
2 authorize the South Tahoe Public Utility District to acquire the
3 property by eminent domain are as follows:
4 a. To construct, reconstruct, complete, repair,
5 maintain and operate public improvements consisting of underground
6 sewer pipelines and appurtenances, underground sewer pumping sta-
7 tions and work auxiliary thereto, and above ground sewer pumping
8 stations and work auxiliary thereto, for the purpose of transport -
9 ing sewage, under and across the lands hereinafter described,
10 together with the right of vehicular ingress and egress thereon
and therefor.

12 b. The statutes that authorize the South Tahoe
13 Public Utility District to acquire the properties by eminent
14 domain are: Section 1640 of the Public Utilities Code and
15 Section 10102 of the Streets and Highways Code.
16 3. A description of the general location and extent of
17 the property to be taken, with sufficient detail for reasonable
18
identification is contained in Exhibits A, B and C, attached here -
19 to, made a part hereof, and incorporated herein by reference.
k. The Board of Directors of South Tahoe Public Utility

b. The proposed Fallen Leaf Lake project, Assess-
ment District No. 19 71 -1, is planned or located in the manner
that will be most compatible with the greatest public good and
the least private injury, and specifically, that portion of said
proposed project which requires the properties described in
Exhibits A, B & C, attached hereto, incorporated herein, and
made a part hereof, is planned or located in the manner that
will be most compatible with the greatest public good and the
least private injury.to said property so described.
c. The properties described in Exhibits A. B & C,
attached hereto, incorporated herein and made a part of this
resolution,are necessary for the proposed Fallen Leaf Lake
project, Assessment District No. 1971 -1.
5. All of the acquisitions are situated within the
South Tahoe Public Utility District, County of El Dorado, State
of California.
6. That 4ohn C.. Weidman, who is the attorney for
said District, be, and he is hereby directed to institute and
conduct to conclusion an action in eminent domain for the acquisi-
tion of said easements and rights -of -way and to take such action
as is necessary therein.
7. That an Order for Immediate Possession and Use be
obtained in said action, and that a warrant be issued to the
County Clerk, El Dorado County, California, in the amount deter-
mined by the Court to be so deposited, as a condition to the
right of immediate possession.

thereto, for lifting and transmitting sewage, together_ with the
right of ingress and egress thereto over a practicable route.
3. The easement and right of way in Parcel 21- 410 -11 is for
the purpose of constructing, operating, using, maintaining, repairing
and replacing sewer pipelines and appurtenances, together with the
right of ingress and egress thereto over a practicable route.
4. The District shall promptly backfill any excavation made
by it on said easements so as to leave the surface of the ground as
nearly as possible in the condition prior to commencement of work,
with the exception of the above ground building.
5. The District will not unreasonably interfere with any use
by the Grantor of said Parcel(s) that is not inconsistent with the
District's full enjoyment of the rights hereby granted.
6. The District hereby agrees to indemnify and hold harmless
the Grantor, its agents and employees, from any loss or damage and
from any liability on account of personal injury, death, or property
damage, or claims for personal injury, death, or property damage of
any nature whatsoever and by whomsoever made arising out of the
District's activities under this easement.
