RESOLUTION NO. 2124 _
A RESOLUTION RESCINDING RESOLUTION NO 2108, AND
CALLING FOR SEALED PROPOSALS AND FIXING LIQUIDATED DAMAGES
FOR FAILURE TO COMPLETE THE WORK
WITHIN SPECIFIED TIME
SOUTH TAHOE PUBLIC UTILITY DISTRICT

RESOLVED, by the Board of Directors of South Tahoe Public
Utility District, El Dorado County, California, that
WHEREAS, on April 6, 1972, this Board adopted Resolution No.
1676, A Resolution of Intention to acquire and Construct Improvements;
WHEREAS, on June 16, 1977, this Board adopted Resolution No.
2076, A Resolution of Intention To Make Changes and Modifications
After Confirmation of Assessment, and on July 22, 1977, this Board
adopted Resolution 2078 ordering said changes and modifications,
which included substitution of a different type of sanitary system
for the sanitary sewage system contemplated by said Resolution No.
1676;
WHEREAS, plans and specifications for said substituted system
suitable for calling for bids for construction of said improvement
have been submitted and approved by this Board;
WHEREAS, on June 1, 1978, this Board adopted Resolution No.
2108, A RESOLUTION CALLING FOR SEALED PROPOSALS AND FIXING LIQUIDATED
DAMAGES FOR FAILURE TO COMPLETE THE WORK WITHIN SPECIFIED TIME and
thereafter, prior to the date specified in said Resolution No. 2108
for receipt of sealed proposals, the call for said sealed proposals
was cancelled, with the approval of this Board;
WHEREAS, modifications of said approved plans and
specifications for said substituted system have been made since said
cancellation of said call for sealed proposals, which modifications
have been submitted for approval by this Board;
NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:
1. That said Resolution No. 2108 be and the same is hereby
rescinded.

2. That said plans and specifications for the construction
of said substituted sanitary sewerage system, as modi.fie, on file in
the office of the Clerk and ex officio Clerk of this District, are
hereby approved.
3. Said Clerk is hereby directed to publish once a week for
two weeks in the Tahoe Daily Tribune, a newspaper published and
circulated in this District, a notice inviting sealed proposals for
bids for the construction of said improvements, and referring to the
plans and specifications on file in the office of said Clerk, the
first publication of which notice shall be at least fourteen days
prior to the time fixed for opening bids.
4. All proposals or bids shall be accompanied by cash, a
cashier's or certified check payable to the order of this District
amounting to ten percent of the bid, or by a bond in said amount and
kaw payable to this District signed by the bidder and a corporate surety
or by the bidder and two sureties who shall justify before any
officer competent to administer an oath, in double said amount over
and above all statutory exemptions. The amount so posted shall be
forfeited to this District in case the bidder depositing the same
does not, within fifteen days after written notice that the contract
has been awarded to him, enter into the contract to construct said
improvements.
5. Pursuant to Section 1773 of the Labor Code of the State
of California, the South Tahoe Public Utility District has obtained
from the Director of the Department of Industrial Relations the
general prevailing rate of per diem wages and the general prevailinq
raate for holidays and overtime work for each craft, classification,
or type of workman required to execute the contract. A copy of said
prevail.ing rate of per diem wages is on file in the principal. office
of the South Tahoe Public Utility District, to which reference is
herehy made for further particulars. said prevailing rate of per
diem wages will be made available to any interested party upon
requested, and a copy thereof shall be posted at the job site.
6. That in the event the contractor, contracting owners

. ;ncluded, does not complete the work within the time limit specified
in the proposed contract or within such further time as this Board
shall have authorized, the contractor-or contracting owners, as the
case may be, 'shall pay to this District liquidated damages in the
amount of Three Hundred Fifty and no /100 dollars ($350.00) per day
for each and every day's delay in finishing the work beyond the
completion date specified in said contract. Additional provisions
with regard to said time of completion and liquidated damages and
special damages are set forth in the specifications, which provisions
are hereby referred to and incorporated herein by reference.
Said sealed proposals or bids shall be delivered to the Clerk
and ex officio Secretary of this District
