Resolution No. 2109-I, J o ' RESOLUTTON NO. 2109 A RESOLUTION OF INTENTION TO MAKE CHANCES AND MODIFICATIONS AFTER CONFIRMATION OF ASSESSMENT SOUTH TAHOE PUBLIC UTILITY DISTRICT ASSESSMENT DISTRICT 1971 -1 [Fallen Leaf Lake Area] �w RESOLVED, by the Board of Directors of the South Tahoe Pub- lic Utility District, E1 Dorado County, California, that WHEREAS, in proceedings by this Board under and pursuant to Resolution No. 1676, A Resolution of Intention to Acquire and Construct Improvements, adopted on April 6, 1972, a public hearing was duly held on July 23, 1973, and Resolution No. 1830, A Reso- lution and Order Adopting Engineer's Report, Confirming the Assessment and Ordering the Work and Acquisitions, was adopted, and the assessment and diagram were duly recorded and filed, a notice of assessment was duly recorded and notices to pay assess- ments were duly published and mailed; WHEREAS, in said proceedings, this Board adopted, on June 16, 1977, Resolution No. 2076, A Resolution of Intention to :lake Changes and Modifications After Confirmation of Assessment (to which resolution reference is made for details and particulars of said changes and modifications and the events and circumstances resulting in the adoption of said resolution), and on July 22, 1977, this Board adopted Resolution No. 2078, A Resolution Order - ing Changes and Modifications, being the changes and modifications described and set forth in said Resolution No. 2076; WHEREAS, bonds have been fications and contract documents been approved by this Board, all to in said Resolution No. 2076; sold and the final plans, speci- have been completed and have as contemplated by and referred WHEREAS, based on said plans and specifications the Substituted Engineer of Work has prepared and filed with the Clerk and ex officio Secretary of this District a Second Revised Cost Estimate (fused on CSO Sewerage System); WHEREAS, grant funding for a portion of the costs of said sewerage system has been approved by the State Water Resources Control Board; WHEREAS, unless the low bid for construction of said sewer- age system (bids for yhich are to be received on July 13, 1978) is no greater than $944,100.00 ($1,482,900 ) being the esti- mated construction cos included in said Second Revised Cost Estimate), it will be n cessary to increase the individual assess- ments heretofore levied �n these proceedings from the amounts therefor, respectively, as contemplated by said Resolution Nos. 2076 and 2078; WHEREAS, it is in the public interest that the contract for construction of said sewerage system be awarded, and work com- menced, as soon as possible after July 13,1978; WHEREAS, Assessment Parcel No. 199 (Assessor's Parcel No. 21- 251 -10) has been divided into three parcels, necessitating apportionment of the assessment levied on said parcel, amendment of the assessment dia(Iram and adjustment of the apportioned assessment to include two additional charges for right of ser- vice and two add itional basic cha rges ; NOW, THEREFORE, IT IS HEREBY DETERMINED and ORDERED, as follows: t r y J t 1. The public convenience, interest and necessity require, and it is the intention of this Board to make, the following ch anges and modifications in the proceedings under and pursuant to said Resolution of Intention No. 1676, to wit: (a) Addition of the contribution to be made by reason of said approved grant funding, estimated to be $ 600,000.00; (b) Amendment of the assessment diagram recorded in the office of the District Engineer and County Surveyor and filed in the offices of the Clerk and ex officio Secretary of this District and the E1 Dorado County Recorder by recording and filing in said offices an amendment thereto showing the division of Assessment Parcel No. 199 into assessment Parcels 214, 215 and 216 (Assessor's Parcel Nos. 21 251 16 , 21 251 17 , and21 291 1R respectively) and the one acre right of service 'area for each of said three parcels; increase of the total amount to be assessed upon said three parcels from $21,151.62 ($21,365.27 less $213.65) to $24,386.53, being an increase of $3,234.91 ($3,594.34 less $359.43); and apportionment of one -third of said $24,386.53 to each of said three parcels, i.e., $8,128.84 to each of said parcels; (c) increase in the cost estimate and total assessment as follows, to wit: increase of total costs from $1,347,012,37 to $2.485.817. 33 ; and increase in the total assessment from $1,350,247.28 ($1,347,012.37 ;plus said.$3,234.91 increase in the total amount to 1W .1ss0ssc1d upon said three parcels into which Assessment Parcel No. 199 has been divided) to $1.885.817.33 (total costs of $ 2.485.817.33 less contribution of $600.000.00 ) , being an increase of $ 535.570.05 (d) Increases in the individual assessments by their respective proportionate shares of said increase in the total assessment, i.e., increase in each individual assessment in an amount equal to 39.6646 percent of such individual assess- ment, as confirmed.und thereafter reduced pursuant to said Reso- lution Nog. 2076 and 2078, excepting only that individual assess- ment numbers 214, 215 and 216 shall each be increased by said percent of $8,128.84 (with assessment number 199 being re- placed by said assessment numbers 214, 215 and 216). 2. It is the intention of this Board that in the event the low construction bid is no greater than $ 944.100.00 , said increases set forth in paragraph 1(d) above will not be made, and that in the event said low bid is less than $ 1.482.900.00 , said increases will be based on a lower percent figure than 39.6646 . 3. NOTICE IS HEREBY GIVEN that Friday, the 14th day of July, 1978, at the hour of 8:00 p.m., in the regular meeting place of this Board, 1275 Meadow Crest Drive, South Lake Tahoe, California, are hereby fixed as the time and place when and where this Board will consider the matter of making said changes and modifications and hearing all protests and persons interested therein. 4. The Clerk of this District shall cause a copy of this resolution to be published once in the Tahoe Daily Tribune, a newspaper of general circulation published in said District and the paper in which the Notice of Improvement under said Resolu- tion of Intention was published, and to be mailed, postage pre- paid, to all owners of property assessed in these proceedings, whose names and addresses appear on the last equalized assess- ment roll for County taxes prior to such mailing or as known to the Clerk, said publication to be at least ten days before said day of hearing, and said mailing to be at least 20 days prior to said hearing date. 0 MPM f J • ` 5. In the event this Board, after the aforesaid hearing, orders the making of the aforesaid changes and modifications, either in whole or in part, the Clerk of this District shall forthwith: (a) Prepare a supplement to the assessment roll as filed with said Clerk on June 7, 1973, and recorded in the office of the District Enqineer and County Surveyor on July 27, 1973, showing thereon the amounts of the individual assessments re- sulting from said order and /or Resolution No. 2078, and cause copies of said supplement to be affixed to said assessment roll on file in said Clerk's office and to be recorded in the office of the District Engineer and County Surveyor; (b) Cause to be recorded in the office of the County Recorder a Supplement to the Notice of Assessment which was recorded in said office on July 27, 1973, in Book 1210 at page 195, which supplemental notice shall include reference to the Notice of Modification of Assessment recorded in said office on August 3, 1977, in Book 1530 at page 230, to the recorded amendment to the assessment diagram, as provided for in paragraph "1(b)" above, and to the supplement to the assessment roll re- corded in the office of the District Enqineer and the County Surveyor; (c) Cause Supplemental Notice to Pay Increased Assessments to be published and mailed; and (d) Cause Special Notice of the limited riqhts of service and use icquired in certain f with respect to parcels lar(jer than one ac to be mailed to the owners, respectively, of such parcels in the same envelope as the Supplemental Notice to Pay Increased Assessments. s/L PJza E L. 19�.SH RA President South Tahoe Public Utility District ATTEST: s/ MARY D.
