A RESOLUTION BY THE BOARD OF DIRECTORS OF THE
SOUTH TAHOE PUBLIC UTILITY DISTRICT SUPPORTING
MIENDMENTS TO THE PORTER- COLOGNE WATER QUALITY
ACT TO ALLOW WASTEWATERS TO BE RECLAIMED AND
USED FOR BENEFICIAL PURPOSES WITHIN THE LAKE
TAHOE BASIN.
RESOLVED, by the Board of Directors of the South Tahoe
Public Utility District, E1 Dorado County, California, that
WHEREAS, Section 13512 of the Porter - Cologne Water
Quality Act states - "It is the intention of the Legislature
1 "` that the State undertake all possible steps to encourage
development of water reclamation facilities so that reclaimed
water may be made available to help meet the growing water
requirements of the State ", and
WHEREAS, Sections 13950 and 13951 of the Porter- Cologne
Water Quality Control Act require that wastes from within the
Lake Tahoe watershed shall be placed into a sewer system and
treated and the resultant effluent transported outside the Lake
Tahoe watershed, and
WHEREAS, Sections 13950 and 13951 are not consistant with
the encouragement of water reclamation as stated in Section 13512
of the Porter - Cologne Water Quality Control Act, and
WHEREAS, it is now the stated policy of the Governor of
the State of California to encourage reuse of treated waste-
water with an objective of achieving 400,000 acre feet of reuse
per year by the year 1982, and
WHEREAS, recently, Governor Brown established the State
Office of Water Recycling, which will coordinate all future
activities in the State of California regarding the reuse and
recycling of treated wastewater, and

WHEREAS, the California State Water Resources Control
Board and Department of Health have, in a draft memorandum of
understanding, proposed to evaluate reuse of treated wastewater
for groundwater recharge on a case by case basis as the only
practical means of achieving the stated goal of reuse of 400,000
acre feet per year by the year 1982, and
WHEREAS, the State Water Resources Control Board requires
that all facilities plans for improvements in wastewater treat-
ment and disposal systems give serious consideration to
alternatives providing for the reuse of treated wastewater, and
WHEREAS, the South Tahoe Public Utility District in its
Facilities Planning Program is considering an alternative
which would include a demonstration in -basin reuse program
designed to provide needed information on the treatment levels
and the uses of treated wastewater in the basin such that the
integrity of Lake Tahoe is maintained, and
WHEREAS, reuse of highly treated wastewater must be

considered in the South Tahoe Public Utility District's long
range planning program because of: uncertainty in available
water supplies due to institutional constraints, limitations
in the capacity of the export pipeline, which is needed to
transport treated wastewaters out of the Tahoe Basin; need to
develop alternative wastewater treatment and disposal programs
as contingency against future changes in conditions and costs
of treatment and disposal outside the Lake Tahoe Basin; and
WHEREAS, the amendment of the Porter- Cologne Water
Quality Control Act to allow reuse of treated wastewater within
the Lake Tahoe Basin would still require approval of any such
reuse by: The Regional Water Quality Control Board - Lahontan
Region; the State Water Resources Control Board and the State
Department of Health, and

WHEREAS, the Board of Directors of the South Tahoe
Public Utility District recognize the exisiting contractual
obligations to Alpine County to export all wastewater to
Alpine County until November 1984 and to the State of California
and the United States to maintain a minimum storage pool at
Indian Creek Reservoir until the year 2024, and
WHEREAS, the South Tahoe Public Utility District is
meeting with Alpine County in connection with the Facilities
%4W Planning Program process and the Utility District is consider-
ing in connection with a Facilities Planning alternative,
proposing amendments to the existing contracts to allow for
possible changes in storage and disposal of treated wastewater
in Alpine County and providing for reclamation demonstration
programs within the Lake Tahoe Basin.
NOW, THEREFORE, BE IT RESOLVED, that the Board of
Directors of the South Tahoe Public Utility District does
herein take the following actions:
(1) Request that Assemblyman Norman S. Waters
introduce legislation to amend the Porter - Cologne Water Quality
Control Act to allow for the reclamation and reuse of treated
wastewater for beneficial purposes within the Lake Tahoe Basin
by the addition of Section 13952 which reads as follows:
11 13952. Notwithstanding the provisions of Sections
13950 and 13951, water containing waste which has been placed
in a sanitary sewer system for treatment and transportation
outside of the Lake Tahoe Basin may be reclaimed and used for
beneficial purposes within the Lake Tahoe Basin in accordance
with the provisions of the Water Reclamation Law (Chapter 7
(commencing with Section 13500 of this division) and

provided that any use of reclaimed water within the Lake Tahoe
Basin shall not directly or indirectly affect the quality of
water of Lake Tahoe, and shall not have a damaging effect
upon the environment of Lake Tahoe.
(2) Direct the Research, Conservation and Training
Committee of the Board of Directors to meet with representatives
of the North Tahoe Public Utility District, Tahoe City Public
Utility District, City of South Lake Tahoe, and El Dorado
County to discuss the proposed amendment.
(3) Direct the staff to communicate with the Alpine
County Officials to inform them of the proposed amendments and
then relay to them the assurances that the Board of Directors
of the South Tahoe Public Utility District intends to honor the
provisions of the contracts with Alpine County, the State of
California and the United States, and the Board will not proceed
with implementation of any in -basin demonstration program without
first amending the District's existing contractual obligations
by mutual agreement of the parties involved.
