Resolution No. 2090R RESOLUTION NO. 2090 A RESOLUTION DIRECTING MAKING OF AMENDED ASSESS- MENT RE CERTAIN ASSESSMENTS UNDER RESOLUTION OF INTENTION NO. 497 PROJECT NO. 19_ 66-1 RESOLVED, by the Board of Directors of the South Tahoe Public Utility District, E1 Dorado County, California, that WHEREAS, an assessment and diagram was made and filed with the Secretary of said District, all pursuant to Resolution of In- tention No. 497 adopted by the Board of Directors of said Dis- trict on March 19 , 19 6k and the provisions of the Municipal Improvement Act of'1913, and said assessment was confirmed by said Board on the 10th day of August , 1964, and recorded in the office of the County Surveyor of said County on August 24 , 19 64 WHEREAS, certain lots or parcels of land upon which there are unpaid assessments against which bonds have been issued under the Improvement Bond Act of 1915, have been divided so that they no longer conform to the original parcel boundaries as shown on said assessment; NOW, THEREFORE, IT IS ORDERED, that: 1. The District Engineer shall cause to be prepared and filed with the District Secretary a report and amended assessment and diagram of the lots and parcels so divided, said parcels being designated Assessment Nos. 514 and 635 2. That the unpaid installments of said original assessments shall be segregated and apportioned in accordance with the benefits to the several parts of the original lots or parcels, and the total amount of the assessment of the several portions of the original lots or parcels shall be equal to the unpaid assessments upon said original lots or parcels of land. That Thursday, the 3rd day of November, 1977, at the hour of 8:00 o'clock P.M., at the regular meeting place of said Board, District Office, Treatment Plant, Johnson Road near junction with Black Bart Street, Tahoe valley, California, be, and the same is hereby, fixed as the time and place for hearing said amended assessment before said Board. 4. Under and by virtue of the Improvement Bond Act of 1915, Division 10 of the Streets and Highways Code, the South Tahoe Public Utility District, in the County of El Dorado, State of California, will on the second day of July, 19, out of the redemption fund for the payment of the bonds is_sued upon the unpaid portion of the assessments made for the acquisition, work and improvements more fully described in the proceedings taken pur- suant to Resolution of Intention No. 1676, adopted by the Board of Directors of said District on the 6th day of April, 1972, pay to bearer (or, if this bond is registered as herein provided, to the registered owner hereof) the sum of Dollars ($ ), with interest thereon from the 2nd day of September, 1977, at the rate of percent ( %) per annum, all as is hereinafter specified, and at Bank of America National Trust and Savings Association, the Paying Agent of the District's Treasurer, at its principal office in San Francisco, California. This bond is one of several annual series of bonds of like date, tenor and effect, but differing in maturities *(,amounts and interest rates), issued by said District under said law for the purpose of providing means for paying for the acquisition, work and improvements described in said proceedings, and is secured by the moneys in said redemption fund and by the unpaid portion of the assessments made for the payment of said acquisition, work and improvements, and, including principal and interest, is payable exclusively out of said fund. The interest is payable semiannually, to wit: on the second days of January and July in each year hereafter, upon presentation of the proper coupons therefor; provided, that the first of said cou- pons is for the interest to the second day of January, 1979, and thereafter the interest coupons are for the semiannual interest. This bond will continue to bear interest after maturity at the rate above stated; provided, it is presented at maturity and payment thereof is refused upon the sole ground that there is not sufficient money in said redemption fund with which to pay same; if it is not presented at maturity, interest thereon will run until maturity. This bond may be registered as to principal and interest or as to principal alone; if registered, it may be deregistered, reregistered or the ownership thereof transferred, upon written request of the owner and presentation of the bond to the Paying Agent and payment of any charges therefor, including any cost of reprinting the coupons, all as set forth in the resolution providing for the issuance hereof. *revise as necessary EXHIBIT C This bond may be redeemed and paid in advance of maturity k w upon the second day of January or July in any year by giving the notice provided in said law and by paying principal and accrued in- terest together with a premium equal to 5 per centum of the principal.
