Resolution No. 2081r' RESOLUTION NO. 2081 A RESOLUTION BY THE SOUTH TAHOE PUBLIC UTILITY DISTRICT BOARD OF DIRECTORS AUTHORIZING FILING OF APPLICATION SUPPLEMENT FOR PUBLIC WORKS GRANT FOR JOHNSON BOULEVARD INTERCEPTOR SEWER EXTENSION AND MAKING COMMITMENTS TO ADEQUATELY TREAT FLOWS FROM THE UNITED STATES FOREST SERVICE, CALIFORNIA STATE PARKS, AND FALLEN LEAF LAKE COMMUNITY RESOLVED, the the Board of Directors of the South Tahoe Public Utility District, El Dorado County, California, that WHEREAS, the Board of Directors of the South Tahoe Public Utility District hereafter called Board did authorize filing of application for a Public Works Grant under the Local Public Works Capital Development and Investment Act of 1976, P.L. 94 -369, and WHEREAS, there has been presented to this Board an application supple- ment which has been prepared by District staff and has been reviewed by this Board, and WHEREAS, the South Tahoe Public Utility District, hereafter called District, has contractual Agreements with the United States Forest Service and the California State Department of Parks and Recreation wherein the District has agreed to provide wastewater treatment and disposal services to specified land and up to specified amounts, and WHEREAS, the South Tahoe Public Utility District and the Fallen Leaf Lake Protective Association have entered into a Memorandum of Understanding which provides for the District to provide sewer service to the Fallen Leaf Lake area for parcels subject to assessment by the District, and WHEREAS, the Board has modified the Fallen Leaf Lake Assessment District 1971 -1 to provide for the construction, operation and maintenance of a small diameter pipe - pressure, and /or vacuum sewage system to provide sewer service to the area for the parcels subject to present assessment by the District, and WHEREAS, Mr. C. Mark Smith, Regional Director Economic Development Administration has required as a condition of an Economic Development Grant under P.L. 94 -369 to construct the Johnson Boulevard Interceptor Sewer Project, that the District submit a letter which expressly states that commitments to M adequately treat flows from the U.S. Forest Service, California State Parks, and the Fallen Leaf Lake Community can and will be honored, NOW, THEREFORE, it is hereby determined and ordered as follows: 1. That execution and the filing of said application supplement by David W. Callahan, Assistant General Manager, be and is hereby authorized, directed and approved. 2. That the District can and will honor its commitments to adequately treat and dispose of sewage flows from the U. S. Forest Service and California State Parks for specified lands and up to specified amounts in existing District agreements with the Forest Service and California State Department of Parks and Recreation and in accordance with the terms of said existing agreements. 3. That the District can and will honor its commitments to adequately treat and dispose of sewage flows from the Fallen Leaf Lake area for parcels of land subject to present District assessment in District Assessment District 1971 -1 when facilities therefore are constructed pursuant to said Assessment District Agreements. * * * * * * * * * * * * * * ** PASSED AND ADOPTED, at a regular meeting of the Board of Directors of the South Tahoe Public Utility District on the 4th day of August, 1977, by the following vote: AYES, Directors: Hegarty, Kashuba, Fieldcamp and Cocking NOES, Director: Fesler ABSENT, Directors: None Edward Hegarty, Pr6sideqK ATTEST: SOUTH TAHOE PUBLIC ILI ISTRICT David W.
