A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
SOUTH TAHOE PUBLIC UTILITY DISTRICT
DECLARING AN EMERGENCY, AUTHORIZING CONTRACTS WITHOUT BIDS,
DELEGATING AUTHORITY TO ORDER EMERGENCY ACTION
AND DETERMINING CEQA EXEMPTION
(STEVEN LANE WATERLINE REPLACEMENT)

5 WHEREAS, the South Tahoe Public Utility District (District) is engaged in the
6 production, treatment and distribution of potable water; and
7
WHEREAS, fatigue failures of an over-stressed waterline have caused four leaks
8
within the past seven days on Steven lane; and

WHEREAS, the waterline on Steven lane needs to be replaced and the street
repaved to protect the health and safety of the public; and
WHEREAS, the damage related to the Steven lane waterline is an unexpected
13 occurrence posing a clear and imminent danger which could lead to the loss or
\., 14 impairment of health, property and/or essential public services; and

WHEREAS, substantial evidence has been provided to the District which
demonstrates immediate action is necessary to prevent this loss or impairment, repair
these facilities, and enter into agreements with contractors to perform such repairs
18
19 necessary to maintain service; and

WHEREAS, emergency projects are exempt from the requirements of the
California Environmental Quality Act (CEQA) pursuant to CEQA guidelines sections
15269 and 15369.
NOW, THEREFORE BE IT RESOLVED AS FOllOWS:

The damage related to the Steven lane waterline is a sudden,
26 unexpected occurrence that poses a clear and imminent danger requiring immediate
\... 27 action to prevent or mitigate the loss or impairment of health, property and essential
28 services and is therefore an emergency.

The emergency will not permit a delay resulting from a competitive
2 solicitation for bids.

Immediate actions directly related to the emergency, including replace-
4 ment of the Steven Lane waterline and actions to procure the necessary equipment,
5
6
services and supplies are necessary to respond to the emergency and shall be made
without giving notice for bids to let contracts.

The General Manager of the District is hereby authorized and directed to
9 order any action necessary and appropriate to respond to the emergency including
10 repair or replacement of the Steven Lane waterline, and the procurement of any
11
necessary equipment, services and supplies, without giving notice for bids to let
Emergency repairs related to the damage for the Steven Lane waterline,
15
are necessary to maintain service and repair actions are necessary to mitigate the
16 emergency and are thus exempt from the requirements of CEQA.

This Resolution shall take effect immediately.

Resolution was duly and regularly adopted and passed by the Board of Directors of the
South Tahoe Public Utility District at a regular meeting held on August 5, 1999 by the
following vote:
