Resolution No. 2061 1 ^1 ` RESOLUTION NO. 2061 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT REGARDING ISSUANCE OF WILL SERVE LETTERS - WATER AND SEWER SERVICE WHEREAS, the South Tahoe Public Utility District receives requests from property owners and developers for the District to issue a letter stating that water and /or sewer service is available and that service will be provided to the petitioner, and WHEREAS, issuance of a "Will Serve Letter" represents a committment of capacity in the water and /or sewer facilities of the District, and WHEREAS, the District is anticipating the need to modify and /or expand both the water and the sewer facilities, and WHEREAS, before completion of the modification and /or expansion of the water and sewer facilities the District may experience capacity limitations in the water and sewer systems which may require a temporary hold on issuance of service connections until such time as the facilities are capable of handling the additional capacity, and WHEREAS, the District's staff is in need of a Policy and Guideline for processing will serve requests. NOW, THEREFORE, BE IT RESOLVED, by the Board of Directors of the South Tahoe Public Utility District, they do hereby adopt the attached Policy and Guide- line Statement of processing of water and sewer service requests. BE IT FURTHER RESOLVED, the Board of Directors of the South Tahoe Public Utility District do declare that any "Will Serve Letter" issued by the District prior to January 1, 1976, in which the service has not been activated as of January 1, 1977, is hereby canceled and the applicant shall be required to file a new application with the District to obtain a connection service. POLICY AND GUIDELINES PROCESSING OF WATER AND SEWER SERVICE REQUESTS STATEMENT: It has been the policy of the Board of Directors of the South Tahoe Public Sime Utility District to provide water and sewer service within the service areas of the District. It is recognized, however, that in attempting to respond to the water and sewer service needs of the District that modifications and /or expansions of the District facilities may be required. It is further recognized that the accomplishment of the required facilities, modifications, and /or expansions may be delayed be- cause of institutional, financial, or other constraints outside the control of the District. Should the District experience uncontrolled delays in the completion of needed facilities, modifications, and /or expansions, there is a danger of over committment of the water and /or sewer system capacity, which could result in 1. r r shortages of water supply or failure to meet waste discharge requirements. POLICY: It is the policy of the Board of Directors of the South Tahoe Public Utility District to provide water and sewer service within the District's service areas. It is the further policy of the Board of Directors to accomplish such modifications and /or expansions of the District's facilities so as to continue to meet the expand- ing needs of the District's service areas. It is also the policy of the Board of Directors to protect the environment and the quality of life within the District's service area. In the implementation of this protective policy the Board of Directors recognize the need to avoid over committments of the District's facilities which could result in water shortages or violations in waste discharge standards. It is the policy of the Board of Directors to provide responsible manage- ment of the District's committments to provide water and sewer service to avoid over committments of the District's facilities. GUIDELINES: The Board of Directors hereby establish the following guidelines for the processing of water and sewer service requests. ANNUAL REPORT: On an annual basis the District will conduct an investigation of the service capabilities of the District's water and sewer facilities. A report on the findings of the investigation will be submitted to the Board of Directors at their regular meeting held in April of each year. Among the items to be discussed in the report will be the following: (1) Estimated effective capacity of the wastewater collection, treatment, and disposal system. (2) Identification of committments for sewer service (i.e. existing connections, will serve letters) . (3) Projection of anticipated sewer service needs for the next ten and twenty year periods. (4) Identification of needed modifications and /or expansions in the sewer facilities to meet the anticipated needs of the next ten and twenty year periods. (5) Estimated cost and tentative implementation schedules for the anticipated facilities, modification and /or expansions. (6) Estimated effective capacity of the water supply system. (7) Identification of committments for water service (i.e. existing connections, will serve letters) . (8) Projection of anticipated water service needs for the next ten and twenty year periods. (9) Identification of needed modifications and /or expansions in the water facilities to meet the anticipated needs of the next ten and twenty year periods. 2. x 1 • lbw (10) Estimated cost and tentative implementation schedules for the anticipated facilities, modifications and /or expansions. ISSUANCE OF WILL SERVE LETTERS: In order to maintain an effective control on committments to provide water and sewer service the District staff shall follow the following guidelines in the issuance of will serve letters. (1) Create a "Will Serve" active file, in which copies of all letters stating service can be provided, will be filed. The information in the letter must contain at least the following: (a) date of letter (b) location of property by assessor's parcel number, lot, block, subdivision, and street address (c) type of proposed improvement (d) Sewer units (e) date the "Will Serve" letter becomes invalid (six month period to perfect the claim by obtaining a construction permit and /or requesting an extension based upon reasonable need) . (2) A recap of the "Will Serve" active file shall be made quarterly. in preparing the recap all "Will Serve" letters would be checked for expiration and those still valid would then be checked against permits issued. (3) Construction permit must be obtained within 30 days of issuance of sewer permit, otherwise permit is canceled. Applicant must reapply for a sewer permit. (4) A recap to be made monthly on permits issued and not yet connected. This procedure would include a summarization of permits issued for the month by type of improvement (single family dwelling unit, apartments, and others) , and sewer units. The permits issued will be added to the previous months total and the summary of connections (finals) made would be subtracted. At least quarterly, or when needed, a review of the applications (permits) would be reviewed to reduce the possibility of errors. (5) Maintain a monthly tabulation of the number of connections by type of improvements with sewer units. The correctness of the total shall be verified 4 4I10- annually by the computer when the annual invoice for sewer service charges is prepared. (6) If a building or structure is demolished or removed from a parcel, the water or sewer connection shall be canceled and a new approved permit shall be required before service is reinstated. (7) If a water and /or sewer connection is made to a foundation outline and then the owner cancels the building permit, and requests that water and sewer service charges be stopped, the connection shall be canceled and a new approved permit shall be required before service is reinstated. (8) All will serve letters will be approved by the Board of Directors prior to issuance. 3. • r (9) The Board of Directors may consider extension of the time limit on an issued will serve letter upon receipt of a written request from the applicant.
