Resolution No. 1980 s r � WJML:RJH:tr .9 -18 -75 10c RESOLUTION NO. 1980 A RESOLUTION AMENDING REGULATIONS GOVERNING RELOCATION ASSISTANCE AND REAL PROPERTY ACQUISITION SOUTH TAHOE PUBLIC UTILITY DISTRICT RESOLVED, by the Board of Directors of the South Tahoe Public Utility District, El Dorado County, California, that WHEREAS, by its Resolution No. 1877, adopted on April 4, 1974, this Board did adopt Regulations Governing Relocation Assistance and Real Property Acquisition, which regulations implemented Chapter 16 (commencing with Section 7260) of Division 7, Title 1 of the Government Code; and WHEREAS, Government Code Section 7267 of said Chapter 16 has been amended, effective January 1, 1976, and it is necessary that the aforesaid Regulations be amended to conform to said statutory amendment; NOW, THEREFORE, it is hereby DETERMINED and ORDERED, as follows: 1. That Section 7.5 of said Regulations be, and is hereby, amended to read as follows:. "Sec. 7.5. Incidental Expenses. Com- pensation for real property shall include, to the extent the Manager deems fair and reason- able, recording fees, transfer taxes and prepayment penalties on existing liens and other similar expenses incidental to conveying such real property to the District." 2. That Article VII of said Regulations be, and is hereby amended by adding thereto a new Section to be numbered Section 7.11 and to read as follows: "Sec. 7.11. Subsurface Water, Sewer and Drainage Easements. Sections 7.3, 7.4 and 7.6 of this Article shall not apply to the acquisi- tion of any easement, right -of -way, covenant, or other nonpossessory interest in real property to be acquired for the construction, reconstruc- tion, alteration, enlargement, maintenance, renewal, repair or replacement of subsurface sewers, water- lines or appurtenances, drains, septic tanks, or . storm water drains." 3. That the aforesaid amendments shall be, and become effec- tive on January 1, 1976.
