A RESOLUTION OF THE BOARD
OF DIRECTORS OF SOUTH TAHOE
PUBLIC UTILITY DISTRICT
AMENDING SECTION 23, SICK
LEAVE WITH PAY OF PERSONNEL
DOCUMENTS OF SOUTH TAHOE
PUBLIC UTILITY DISTRICT
WHEREAS, Ron Wood, Business Representative, Stationery
Engineers Local No. 39, representing the recognized employee organ-
ization of SOUTH TAHOE PUBLIC UTILITY DISTRICT, and John C. Weidman,
attorney for said District, have met and conferred in good faith
about the amendment to District Personnel Documents, Section 23,
Sick Leave With Pay, as hereinafter specified;
NOW THEREFORE, BE IT RESOLVED by the Board of Directors
of SOUTH TAHOE PUBLIC UTILITY DISTRICT as follows:
There shall be added to Section 23, of the SOUTH TAHOE
PUBLIC UTILITY DISTRICT Personnel Documents relating to Benefits
and Working Conditions of Employees of the District, effective
forthwith, the following:
(h) When an employee has a terminal illness, as here-
inafter defined and has exhausted all accumulated vacation and
sick leave in connection with treatment and disability for said
terminal illness, said employee shall have extended his or her
sick leave under the following terms and conditions:

(1) Extended sick leave shall accrue on the basis
of one month's salary at the employee's classification rate for
each full year of District service up to a maximum of six months
of extended sick leave with pay.
(2) Extended sick leave with pay shall be at the
rate of the employee's classification, including all benefits,
less any state and /or federal disability income benefits paid to

said employee by the state and/or federal government by reason
of said terminal illness during the period of extended sick leave
with pay.
(3) Terminal illness shall mean at the time of
extended sick leave with pay there is a reasonable medical prob-
ability that the illness or injury of the employee who is afflicted
or suffers is expected to be terminal within one year from the
time the employee is eligible for extended sick leave with pay.
(1.i.) The employee or his or her representative shall
furnish the General Manager with medical evidence of reasonable
medical probability as defined before extended sick leave benefits
are paid.
(5) If the General Manager questions the medical
evidence submitted for the employee to qualify for extended sick
leave pay, the District may secure its own medical evidence either
by medical reports and /or an independent medical examiner selected
by the District who shall examine the employee and/or review said
employee's medical records, and file a written report with the
General Manager. The employee or his or her representative shall
cause to be furnished all medical records required for District
review and /or examination. The General Manager and the Board of
Directors shall then determine the employee's qualification for
extended sick leave benefits.
PASSED AND ADOPTED at an adjourned regular meeting of
the Board of Directors SOUTH TAHOE PUBLIC UTILITY DISTRICT on
the 10th day of October, 1971, by the following vote:
