RESOLUTION NO. 1906
A RESOLUTION ORDERING CORRECTION OF ERROR AND
TRANSFER OF FUNDS TO THE BOND REDEMPTION FUND
ASSESSMENT DISTRICT 1970 -1
RESOLVED, by the Board of Directors of the South Tahoe
Public Utility District, El Dorado County, California, that
WHEREAS, in the proceedings conducted by this Board pursuant
to Resolution of Intention No. 1500, adopted by this Board on
February 15, 1970, by reason of clerical error the amount of Asess-
ment No. 50, as confirmed and levied, and set forth on the List of
Unpaid Assessments certified by the Clerk of this District on Janu-
ary 19, 1971, and filed with the Treasurer of the County of El Dorado
and the ex- officio Treasurer of South Tahoe Public Utility District
on January 21, 1971, and also set forth in Exhibit A to Resolution
No. 1542, adopted by this Board on February 4, 1971, was $16,865.33,
which error resulted from using $96,050 instead of $13,300 as the
assessed value of land and improvements for said parcel in computing
the portion of said assessment for acquisition of the right of ser-
vice and use in the existing sanitary sewerage and sewage treatment
and disposal facilities of this District;
WHEREAS, said figure of $13,300 should have been used in
making such computation and use of said $96,050 figure resulted in
including in said Assessment No. 50 the amount of $13,731.16 for
acquisition of said right of service instead of $2,407.92;
WHEREAS, said amount of $2,407.92 was the correct amount that
should have been used in said Assessment No. 50 for acquisition of
said right of service;
WHEREAS, said assessment was not paid in whole or in part
within the 30 -day statutory period during which cash payments on
assessments could be made, and bonds have been sold and delivered
•
to represent the unpaid assessments, including said Assessment
No. 50; and
WHEREAS, by reason of said clerical error, the original
amount of said Assessment No. 50 exceeds the correct amount therefor
by $11,323.24, and the amount heretofore transferred from the Con-
struction Fund for said assessment district to the General Fund of
this District for acquisition of said right of service exceeded the
amount that should have been so transferred by $11,323.24;
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:
1. That there shall forthwith be transferred from the
General Fund of this District to the Construction Fund of this
assessment district the amount of $11,323.24, and there shall be
transferred from said Construction Fund to the Bond Redemption Fund
for said bonds heretofore sold and delivered the sum of the following:
(a) $11,323.2 being the principal amount now
remaining unpaid on said assessment on said parcel;
(b) $566.162, being five percent (5%) of said
principal amount;
(c) $ 8.70 , being the unpaid interest on
$323.24 for the period between July 2, 1975, and
January 2, 1976. Total $11,898.10
2. Said sum shall be used in the same manner as prepayment
of an unpaid assessment, together with other funds available in the
redemption fund from prepayment of unpaid assessments, if any, for
the purpose of calling bonds in the manner provided in the Improve-
ment Bond Act of 1915.
3. The Clerk of this District shall forward certified
copies of this resolution to the Treasurer and County Auditor of
