RESOLUTION NO. 1$39
A RESOLUTION DETERMINING THAT THE PUBLIC
INTEREST AND NECESSITY REQUIRE THE ACQUISITION
OF CERTAIN LANDS AND RIGHTS OF ENTRY THEREON
AND DIRECTING THE FILING OF EMINENT DOMAIN
PROCEEDINGS - JOHNSON PUMP STATION
RESOLVED, by the Board of Directors of South Tahoe Public
Utility District, El Dorado County, California, that
WHEREAS, it is the intention of this Board to acquire,
construct, reconstruct, repair and operate facilities for holding
and pumping sewage water and underground pipelines and appurtenances,
a temporary working easement therefor, and work auxiliary thereto
to said facilities for holding and pumping sewage water, for the pur-
'rr pose of transporting sawage to and from, under and across the lands
herein described,
NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED as
follows:
1. That the public interest and necessity require the
acquisition, construction, reconstruction, repair, maintenance and
operation by said South Tahoe Public Utility District of public
improvements consisting of facilities for holding and pumping sewage
water and underground pipelines and appurtenances, a temporary work-
ing easement therefor, and work auxiliary thereto to said facilities
for holding and pumping sewage water, for the purpose of transporting
sewage to and from, under and across the lands herein described in
Exhibit A, attached hereto and made a part hereof, together with the

right of vehicular ingress and egress therefor and the taking of
right of way in fee simple for the facilities for holding and pump-
ing sewage and of easements and rights of way therefor, and the
taking of said lands, easements and rights of way therefor is necessary
for said public improvements. Said land, easements and rights of way
are situate in the County of El Dorado, State of California.

2. That said proposed acquisition and public improvements are
planned and located in the manner which will be most compatible with
the greatest public good and the least private injury, and all of said
acquisitions are situated within the County of El Dorado, State of
California.
3. That John C. Weidman, Placerville, California, Attorney at
Law, Attorney for said District, be, and he is hereby directed to
institute and conduct to conclusion an action in eminent domain for
the acquisition of said land, easements and rights of way and to
take such action as is necessary therein, and is authorized to verify
complaints in eminent domain therefor.
4. That an Order for Immediate Possession and Use be obtained
in said action, and that a warrant be issued to the County Clerk, El
Dorado County, California, in the amount determined by the Court to be
so deposited, as a condition to the right of immediate possession.
