Resolution No. 1810 V f • WJML:RJH:gb •3`/31/72 8c ( RESOLUTION NO. 1810 A RESOLUTION CALLING FOR SEALED PROPOSALS AND FIXING LIQUIDATED DAMAGES FOR FAILURE TO COMPLETE THE WORK WITHIN TIME SPECIFIED ASSESSMENT DISTRICT 1971 -1 RESOLVED, by the Board of Directors of the South Tahoe Public Utility District, El Dorado County, California, that WHEREAS, t'ilis Board did on the 6th day of April , 1972, adopt its Resolution of Intention No. 1676 to order the construction of sanit. y sewerage systems, including trunk sewers, collection sewers, necessary pumping stations and force mains, man - , holes, flushing devices, r'dholes, wye branches and all appurte- nances, all as more particularly described and set forth in said Resolution of Intention; NOW, THEREFORE, the Clerk of said District is hereby directed to publish once a week for two wee s in the Tahoe Daily Tribune, a newspaper published and circulated it said District, a notice invit- ing sealed propoals or bids for the construction of said improve- ments, and referring to the plans and sp-cifications on file in the office of said Clerk, the first publicatio\ of which notice shall be at least fourteen days prior to the time 'fixed for opening bids. All proposals or bids shall be accompa ned by cash, a cash- ier's or certified check payable to the order of\ \the District amounting to twenty percent (20 %) of the bid, or b a bond in said amount and payable to said District signed by the bid er and a cor- porate surety or by the bidder and two sureties who sha 7. justify before any officer competent to administer an oath, in double said amount and over and above all statutory exemptions. The amount so posted shall be forfeited to said District in case the bidder de- positing the same does not, within fifteen days after written f c-ft— fit/l-v% A 97, // AP/ If r • • notice that the contract has been awarded to him, enter into a con- tract with the District. It is hereby determined that in the event the contractor, contracting owners included, does not complete the work within the time limit specified in the proposed contract or within such fur- ther time as this Board shall have authorized, the contractor or contracting owners, as the case may be, shall pay to the District liquidated damages in the amount of One Hundred Thirty Dollars ($ 130.00 ) per day for each and every day's delay in finishing the work beyond the completion date specified in said contract. Additional provisions with regard to said time of com- pletion and liquidated damages are set forth in the specifications, which provisions are hereby referred to and incorporated herein by reference. Said sealed proposals or bids shall be delivered to the Clerk of said District on or before 2:00 o'clock p .m. on the 12th day of July , 1973, said time being not less than fourteen days from the time of the first publication of said notice. Bids will be publicly opened, examined and declared on said day and hour, and referred to and considered by the Board at its meeting at 8 : o'clock p.m. on July 12th 19'73.
