Resolution No. 1817 ' y WJML :RJH:ap 6 -13 -73 8c , ,t) RESOLUTION NO. 1817 1" A RESOLUTION APPOINTING TIME AND PLACE OF HEARING PROTESTS IN RELATI;QN TO PROPOSED ACQUISITIONS AND IMPROVEMENTS, AND DIRECTING NOTICE ASSESSMENT DISTRICT 1971 -1 RESOLVED, by the Board of Directors of the South Tahoe Public Utility District, El Dorado County, California, that WHEREAS, pursuant to Resolution of Intention No. 1676 , adopted on April 6 , 1972,, by the Board of Directors of said District, as subsequently amended, and pursuant to the Municipal Improvement Act of 1913, the District Engineer of said District has filed with the Clerk of this District the written report called for under said Act and by said Resolution of Intention which report has been presented by said Clerk to this Board for consideration, and this Board has considered and preliminarily approved and confirmed said report and ordered that the same stand as the report for the purpose of all subsequent proceedings had pursuant to said Resolution of Intention. NOW, THEREFORE, IT IS ORDERED that Monday , the 23rd day of July , 1973, at the hour of 8:00 o'clock p.m., district office, Treatment Plant, Johnson Road near junction with Black Bart Street, Tahoe Valley, California (P. 0. Box AU, South Lake Tahoe, California 95705), be, and the same are appointed and fixed as the time and p1ade when and where the Board will consider and finally determine whether the public interest, convenience and necessity re- quire said acquisitions and improvements, and when and where it will consider and finally act upon the engineer's report under said Resolution of Intention. IT IS FURTHER ORDERED that the Clerk of this District be, and he is hereby directed to give notice of said hearing once a week for two weeks in the Tahoe Daily Tribune, a newspaper published and circu- lated in said District, and by conspicuously posting a notice thereof along all the open streets within the assessment district at not more L L than three hundred feet apart, and not less than three in all; said posting and first publication to be had and completed at least twenty days before the date herein set for hearing of protests. IT IS FURTHER ORDERED that said notices shall be headed "Notice of Improvement" in letters of not less than one inch in height and shall, in legible characters, state the fact and date of the passage of said Resolution of Intention and of the filing of said report and of the date, hour and place set for the hearing of said protests, and briefly describe the acquisitions and improvements pro- posed to be made, and refer to said Resolution of Intention and report for further particulars. IT IS FURTHER ORDERED that the Clerk of said District shall mail or cause to be mailed notice of the adoption of said Resolution of Intention and the filing of said report, postage prepaid, at least twenty days before the date set for hearing of said protests, to all persons owning real property to be assessed, whose names and addresses appear on the last equalized assessment roll for County of El Dorado taxes prior thereto or as known to the Clerk, which notice shall contain a statement of the time, place and purpose of the hearing on said Resolution of Intention and report and a statement of the total estimated cost of the proposed acquisitions and improvements, the amount as shown by said report to be assessed against the particular parcel covered by the notice, together with a statement that any person interested may file a protest in writing illbw as provided in said Act. IT IS FURTHER ORDERED that the Clerk shall include with said notices to be mailed to such persons owning the property identified in said report as assessment parcels 46, 47, 49, 52, 53, 54, 55, 60, 61, 72, 76, 82, 84, 87, 89, 90, 102, 104, 106, 117, 118, 119, 122, 124, 125, 168, 170, 171, 174, 181, 185, 189, 194, 195, 19 197, 199, -2- 200, 201, 203 and 204, a special notice concerning the limited rights of service and use in existing facilities which are proposed to be acquired for such parcels.
