Resolution No. 1783 c t WJML:RJH:gbl 4/26/73 10c RESOLUTION NO. 1783 A RESOLUTION DETERMINING AND ORDERING ACTION TO BE TAKEN CONCERNING ASSESSMENT NO. 634 ASSESSMENT DISTRICT 1968 -3F RESOLVED, by the Board of Directors of the South Tahoe Public Utility District, El Dorado County, California, that WHEREAS, pursuant to Resolution of Intention No. 1340, adopted on October 2, 1969, as subsequently amended, an assessment was confirmed and levied upon the private possessory interest in assessment parcel No. 634 (the fee simple interest in such parcel being owned by the United States Department of Agriculture, Forest Service, and subject to a written Special Use Permit granted to a private permittee by the U. S. Forest Service), which assessment was in the amount of $2,336.00; WHEREAS, pursuant to that certain agreement between the United States Department of Agriculture, Forest Service, and this Utility District, pertaining to said assessment district, the U. S. Forest Service has given this Utility District notice of intention to terminate said permit due to abandonment by the permittee; WHEREAS, it is the opinion of this Board that by reason of the condition of the permittee's improvements upon said parcel, and the unlikelihood of anyone being interested in acquiring a new permit for said parcel, no purpose can be served by action to fore- close the lien of said assessment upon such improvements; WHEREAS, there is a surplus in the Bond Redemption and In- terest Fund for said assessment district which is more than suffi- cient to cover the amount of principal and interest remaining unpaid on said Assessment No. 634; NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows: to That no foreclosure of the lien of said assessment be made. 2. That upon notification from the U. S. Forest Service that said permit has been cancelled or terminated: (a) the County Auditor and County Treasurer shall be noti- fied that the United States Department of Agriculture, Forest Service, is now the only party owning any interest in the land sub- ject to said Assessment No. 634, so that continued billing of installments due and payable thereon is unnecessary and useless and sale of the possessory interest in said parcel for default is no longer possible since said interest no longer exists, and that said surplus in said Bond Redemption and Interest Fund should be used to make up the moneys that remain payable upon said Assessment No. 634; and (b) the U. S. Forest Service shall be advised that this Utility District continues to rely on the covenants of the United States as contained in paragraphs 3(a) and 3(d) of the aforesaid agreement with this Utility District, which pertain to future issu- ance of a permit or exchange or sale of the land which was subject to said terminated permit. 3. That certified copies of this resolution shall be for- warded to the U. S. Forest Service, the County Auditor and the County Treasurer.
