Resolution No. 1675 • • WJML:RJH;gb 3/16/72 8c RESOLUTION NO. 1675 A RESOLUTION ORDERING CANCELLATION OF ASSESSMENTS AND PROVIDING FOR MONEYS REQUIRED TO BE PAID AND /OR TRANSFERRED FROM GENERAL FUNDS BY REASON THEREOF ASSESSMENT DISTRICT 1959 -1 RESOLVED, by the Board of Directors of the South Tahoe Public Utility District, El Dorado County, California, that WHEREAS, in proceedings under and pursuant to Resolution No. 146 A Resolution of Intention to Acquire and Construct Improvements, adopted by said Board on August 20 , 1959 5 said Board has heretofore levied special assessments upon the following parcels of land, to wit: Lots 2, 3 and 4, Block 34, Al Tahoe Subdivision (being assessment par- - cel numbers 1999, 2000, and 2001 in said proceedings), which parcels are LW now located in the City of South Lake Tahoe, gl Dorado County, Cali- fornia; WHEREAS, bodies are interred in said parcels of land by reason of the use thereof as a private cemetery; WHEREAS, subsequent to the levy of said special assessments said City of South Lake Tahoe became and is now the owner of said parcels (subject to foreclosure proceedings hereinafter referred to), and said City by letter dated February 1, 1972, signed by its Mayor, Lester S. Nagy, has declared its intention to use said parcels of land as a ceme- tery and for no other purpose; WHEREAS, said special assessments on said parcels are unpaid and installments due and payable thereon have been delinquent for some years, and foreclosure proceedings have been taken with respect thereto; NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows: 1. The public convenience, interest and welfare require that said special assessments be, and the same are hereby, cancelled. 2. Subject to the provisions of paragraph 3 hereof, there shall be paid and /or transferred from unencumbered general funds of the South Tahoe Public Utility District the moneys required for the following, the to wit: (a) Payment of all penalties and costs now due and payable to the County of El Dorado, if any, by reason of said delinquent install- ments due and payable on said unpaid special assessments, and foreclo- sure proceedings taken with respect thereto; (b) Reimbursement of the County of El Dorado for all sums ad- vanced by it to the bond interest and redemption fund for payment of principal and /or interest on the bonds issued in said proceedings, if any, insofar as such advances were made pursuant to sections 4701 through 4717 of the Revenue and Taxation Code of the State of California and with respect to said delinquent installments due and payable on said unpaid special assessments; (c) Deposit to the credit of said bond interest and redemption fund of amounts equal, to the installments of principal and interest which would hereafter be due and payable on said unpaid assessments except for the cancellation thereof hereinabove ordered, insofar as necessary for payment of principal and /or interest on said bonds when same is due and payable. 3. Amounts now and /or hereafter credited to said bond interest and redemption fund for interest earned on investment of moneys in said fund from time to time, to the extent available, shall be used for the requirements specified in clauses (a), (b) and (c) of paragraph 2 above before said requirements are satisfied by use of general funds as pro- vided in said paragraph 2. 4. In the event said foreclosure proceedings have resulted, or 4 6, prior to effectuation of this order do result, in ownership of said par- cels of land becoming vested in a party or parties other than the State (by sale by the State or otherwise) and /or with the right of redemption terminated, then THIS ORDER SHALL BE NULL AND VOID AND OF NO FORCE AND EFFECT WHATSOEVER. -2- 5.
