RESOLUTION NO. 1593
A RESOLUTION ORDERING MODIFICATION OF THE REPORT AND
ASSESSMENT AND THE DIAGRAM, REDUCTION OF ASSESSMENTS,
AND DELETION OF PORTION OF WORK AND PORTION OF ACQUI-
SITIONS OF RIGHTS OF SERVICE AND USE
ASSESSMENT DISTRICT 1970 -2
RESOLVED, by the Board of Directors of the South Tahoe Public
Utility District, El Dorado County, California, that
WHEREAS, the estimated cost of the project under Resolution of In-
tention No. 1554, adopted by the Board of Directors of said District on
May 6, 1971, as subsequently amended, was $933,107.16 of which the esti-
mated amount of $458,080.00 was to be contributed by the U. S. Forest
Service and the State of California, leaving a balance to assessment of
kbe$475„027.16;
WHEREAS, it is the intention of this Board that a contribution be
made to this project by the South Tahoe Public Utility District in the
amount of $100,000, in addition to the aforementioned estimated contribu-
tions to be made by the U. S. Forest Service and the State of California,
such contribution by the South Tahoe Public Utility District being in-
tended to cover a portion of the costs of the improvements described in
said Resolution of Intention, as amended, which improvements do not at
this time but in the future should benefit land not included in this as-
sessment district (being the improvements described in clauses (a)(2) and
(a)(4)(A) and (B) in Amended Exhibit A to said Resolution of Intention,
as amended), thereby relieving the assessment parcels within Area D, as
shown on the map entitled "Revised Proposed Boundaries of Assessment
District 1970 -2" on file in the office of the Clerk, from assessment for
the portion of the cost of the above described improvements deemed attrib-
utable to the aforesaid lands which should in the future be benefited by
said improvements and for which benefits said lands shall be appropriately
charged at such time as same become so benefited;
WHEREAS, the public interest, convenience and necessity require

that with respect to assessment parcels within Areas B, C AND D, as shown on said
k ii revised boundary map, which contain more than one acre of land, the acquisition
of the rights of service and use as described in clause (b) of said Amended Exhibit
A and as described in clause (c) of said Amended Exhibit A with respect to that
portion of the facilities described in said clause (c) which consist of trunk sewer
mains extending westerly from the Tahoe Keys pump station to State Highway 89 and
thence westerly along said Highway 89 to the terminus of the segment thereof known
as the B Trunk at a point near where said highway turns northward toward Lake Tahoe
and Emerald Bay, including the Tallac and Taylor pumpstations, should be limited at
this time to acquisition of said rights of service and use for only one acre of such
parcels, being one acre adjacent to and immediately benefited by the facilities de-
scribed in said clause (b) and said portion of the facilities described in said clause
(c) , with acquisition of said rights of service and use for the additional acreage
within each such parcel being deferred until such time as all or any portion thereof
may be benefited by and require said rights of service and use;
WHEREAS, the District Engineer has prepared and filed with the Clerk an Amend-
ment to the Assessment Diagram heretofore filed in these proceedings on June 17, 1971,
which amendment consists of three sheets, on which are shown each of the assess-
ment parcels in said Areas B , C and D which contain more than one acre of land, with
the one acre of each such parcel for which acquisition of said rights of service and
use will be of immediate benefit clearly delineated thereon;
WHEREAS, it appears that the "collection units" attributable to all assessment
parcels in said Area D should be adjusted, and that the portions of said assessments
i hw on said parcels, respectively, which are for "trunk charges" should be included in
the "collection unit charges" and be based on said "collection units , " with resulting
changes in the portions of said assessments on said parcels, respectively, which are
based on said "collection units" (being the "collection unit charges"); and that the
"collection unit" attributed to assessment parcel 23 should be reduced to zero, with
the ' bollection unit charge" portion of the assessment on said parcel being reduced to

WHEREAS, it appears that the laterals to serve assessment parcels 23, 98
and 99 should be deleted from the work to be done, and the assessments on said
parcels reduced by elimination of the "lateral charge" portion of said assessments,
and that the assessment on assessment parcel 49 should be reduced to zero;
WHEREAS, it appears that the area of assessment parcel 1 should be cor-
rected from 1.998 acres to 1 .016 acres, with resulting changes in the portion of
the assessment on said parcel which are based on area, and that the portion of
assessment 52 based on "trunk sewer charge" was erroneously included therein and
should be eliminated therefrom, with resulting changes in said assessment;
WHEREAS, the District Engineer has prepared and filed with the Clerk a Revised
Report And Assessment, dated August 26, 1971, in which the estimated costs of the
k w project, the total amount to be assessed and certain of the individual assessments
have been changed to reflect (a) reductions in the estimated construction costs and in
assessments by reason of the construction bids received on August 10, 1971, (b) reduction
in the amounts to be assessed by reason of the aforesaid contribution by the South
Tahoe Public Utility District and the aforesaid limitation with respect to acquisition of
rights of service and use , (c) changes in assessments by reason of the aforementioned
changes in "collection units" and "collection unit charges," deletion of laterals, re-
duction of assessment 49, and errors in area and inclusion of "trunk sewer charge ";
NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:
1. That the estimated cost of the project shall be and is hereby
reduced to $ 775,892.78, of which $ 535,080.00 will be contributed ($ 187,980.00
t ilw by the U. S. Forest Service, $ 247,100.00 by the State of California and $ 100,000
by the South Tahoe Public Utility District) leaving a balance to assessment of
$ 240,812.78, to which amount the total assessment shall be and is hereby reduced.
2. That the estimate of project costs and contributions and
the assessment in these proceeding be and the same are hereby modified in
the manner set forth in said Revised Report And Assessment, and that

each of the individual assessments, except assessment numbers 41, 42, 45,
46, 47, 48, 50, 51 and 111 (each of which shall remain the same as in
the Assessment filed herein on June 17, 1971), be and the same are hereby
reduced to the amounts set forth in said Revised Report And Assessment.
3. That the laterals to serve assessment parcels 23, 98,
and 99 be deleted from the work to be done.
4. That said Amendment to the Assessment Diagram be affixed to the
diagram filed in these proceedings on June 17, 1971, and that said dia-
gram be and the same is hereby modified in the manner shown on said
amendment thereto; that the District Engineer shall note on the face of
said diagram the following:
(a) On sheet 1 the words: "See Amendment (3 sheets) affixed hereto
pursuant to Resolution No. 1593 , adopted by the Board of Direc-
tors of South Tahoe Public Utility District on August 26, 1971,
on which are shown for certain assessment parcels portions
thereof for which no rights of service and use in existing sani-
tary sewerage facilities of the South Tahoe Public Utility Dis-
trict, including portions of such facilities constructed by said
Utility District for the United States of America, will be ac-
quired. For particulars with respect thereto see said Resolu-
tion No. 1593 ."
(b) On sheets 2, 4, 5 and 6 for each assessment parcel shown thereon
which is shown on the sheets of the Amendment to the Assessment
Diagram the words: "See Amendment To Assessment Diagram affixed
hereto ".
k low 5. That acquisitions of said rights of service and use, as de-
scribed in clause (b) and the above mentioned portion of clause (c) in
said Amended Exhibit A, for the portions of assessment parcels in said
Areas B, C and D which contain more than one acre of land be and the
same are hereby deleted from the acquisitions to be made in these pro-
ceedings, said portions of said parcels for which said acquisitions are

deleted being as shown on said Amendment to the Assessment Diagram
(indicated thereon by shading thereof).
