Resolution No. 1468 0 0°. 1 RESOLUTION NO. 1468 2 A RESOLUTION DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN 3 LANDS AND RIGHTS OF ENTRY THEREON AND DIRECTING THE FILING OF EMINEI'T DOMAIN PROCEEDINGS 4 (United States Forest Service Sewer System Stage III) 5 6 RESOLVED, by the Board of Directors of South Tahoe 7 Public Utility District, El Dorado County, California, that 8 WHEREAS, it is the intention of this Board to acquire, 9 construct, reconstruct, complete, repair, maintain and operate 10 public improvements consisting of an underground sewer pipeline, 11 and appurtenances and work auxiliary thereto, for the purpose of 12 transporting sewage, under and across the lands hereinafter 13 described, together with the right of vehicular ingress and 14 egress thereon and therefore, 15 NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED as 16 follows: 17 1. That the public interest and necessity require the 18 acquisition, construction, reconstruction, completion, repair, 19 maintenance and operation of public improvements consisting of an 20 underground sewer pipeline, and appurtenances and work auxiliary 21 thereto, for the purpose of transporting sewage, under and across 22 the lands more particularly described in Exhibit A, and attached 23 hereto, and made a part hereof, together with the right of 24 vehicular ingress and egress thereon and therefore, and taking 25 of easements and rights of ways under and across said lands is 26 necessary for said public improvements. Said parcels of lands r 27 are situate in the County of El Dorado, State of California. 28 2. That said proposed acquisition and public improve- 29 ments are planned and located in the manner which will be most 30 compatible with the greatest public good and the least private 31 injury, and all of said acquisitions are situated within the 32 County of El Dorado, State of California. Weidman, Placerville, California, 2 attorney at law, and the firm of Wilson, Jones, Morton F.c Lynch, 3 San Mateo, California, who are attorneys for said District, be, 4 and they are hereby directed to institute and conduct to 5 conclusion an action in eminent domain for the acquisition of 6 said easements and rights of way and to take such action as is 7 necessary therein, and they shall be paid a reasonable fee 8 therefor. 9 4. That an Order for Immediate Possession and Use be 10 obtained in said action, and that a warrant be issued to the 11 County Clerk, El Dorado County, California, in the amount 12 determined by the court to be so deposited, as a condition to the 13 right of immediate possession. 14 15 16 PASSED AND ADOPTED by the Board of Directors of South 17 Tahoe Public Utility District at a duly held regular meeting on 18 August 6, 1970, by the following vote: 19 AYES: Directors Fesl.e.r, Hegarty, Wakeman,and Ream. 20 NOES: None 21 ABSENT: Direcotr Kortes 22 23 l/T Robert W.Fesler, President of the 24 Board of Directors of South Tahoe Public Utility District. 25 26 ATTEST: 27 28 - r ( _..c�j� 29 David W.
