RESOLUTION NO. 2667-98
A Resolution of the South Tahoe Public Utility District
Declaring an Emergency, Authorizing Contracts without Bids,
Delegating Authority to Order Emergency Action
and Determining CEQA Exemption
WHEREAS, the South Tahoe Public Utility District (District) is engaged in the
collection, treatment and disposal of wastewater; and
WHEREAS, a fire occurred in the tertiary building located at the wastewater
treatment plant on 1275 Meadow Crest Drive, at 11:40 a.m., February 5, 1998; and
WHEREAS, the fire caused extensive damage to the building and its contents; and;
WHEREAS, all electrical service, air lines, and pneumatics in the building were
destroyed, which severely impedes the ability to process effluent; and
WHEREAS, the fire destroyed the file room and its contents, destroyed the water
meter storage area, and caused damage to the roof and all windows; and
WHEREAS, effluent flows will be temporarily routed to the emergency retention
13 basin; and
14 WHEREAS, substantial evidence has been provided to the District which
15 demonstrates immediate action is necessary to prevent this loss or impairment, repair
16 these facilities, and enter into agreements with contractors to design and perform such
17 repairs necessary to maintain service; and
18 WHEREAS, emergency projects are exempt from the requirements of the California
19 Environmental Quality Act (CEQA) pursuant to CEQA guidelines sections 15269 and
20 15369.
21 NOW, THEREFORE BE IT RESOLVED AS FOllOWS:

1.
The damage related to the tertiary building fire is an unexpected occurrence
23 that poses a clear and imminent danger requiring immediate action to prevent or mitigate
24 the loss or impairment of life, health, property or essential services and is therefore an
25 emergency including such occurrences as fire, flood, or earthquake.

2.
The emergency will not permit a delay resulting from a competitive
27 solicitation for bids.

3. Immediate actions directly related to the emergency, including repair or
replacement of the tertiary building and its contents, and actions to procure the necessary
equipment, services and supplies are necessary to respond to the emergency and shall be
made without giving notice for bids to let contracts.
4. The General Manager of the District is hereby authorized and directed to
order any action necessary and appropriate to respond to the emergency including repair
or replacement of the tertiary building and its contents, and the procurement of any
necessary equipment, services and supplies, without giving notice for bids to let contracts.
5. Emergency repairs related to the damage for the tertiary building and its
contents are necessary to maintain service and repair actions are necessary to mitigate
the emergency and are thus exempt from the requirements of CEQA.
6. This Resolution shall take effect immediately.

Resolution was duly and regularly adopted and passed by the Board of Directors of the
South Tahoe Public Utility District at an regular meeting held on February 5, 1998 by the

AYES: Directors Wallace, Strohm, Jones, Gochnauer, Mosbacher.

ABSENT: None
