Resolution 2647 RESOLUTION NO. 2647 A Resolution of the South Tahoe Public Utility District Declaring an Emergency, Authorizing Contracts without Bids, Delegating Authority to Order Emergency Action and Determining CEQA Exemption WHEREAS, the South Tahoe Public Utility District (District) is engaged in the collection, treatment and disposal of wastewater; and WHEREAS, severe weather conditions and excessive runoff caused the A-Line at Elk's Club to become exposed along the river bank of the Upper Truckee River; and WHEREAS, the A-Line erosion damage needs to be repaired to protect the line 8 from harm; and 9 WHEREAS, it is possible most repairs can be done internally without excavation; 10 however, protection of the pipe will consist of rock lining the bank of the river to protect the 11 pipe line from further erosion; and 12 WHEREAS, the damage related to the A-Line by Elk's Club is an unexpected 13 occurrence posing a clear and imminent danger which could lead to the loss or impair- \.., 14 ment of health, property and/or essential public services; and 15 WHEREAS, substantial evidence has been provided to the District which 16 demonstrates immediate action is necessary to prevent this loss or impairment, repair 17 these facilities, and enter into agreements with contractors to perform such repairs 18 necessary to maintain service; and 19 WHEREAS, emergency projects are exempt from the requirements of the California 20 Environmental Quality Act (CEQA) pursuant to CEQA guidelines sections 15269 and 21 15369. 22 NOW, THEREFORE BE IT RESOLVED AS FOLLOWS: 23 1, The damage related to the A-Line by Elk's Club is a sudden, unexpected 24 occurrence that poses a clear and imminent danger requiring immediate action to prevent 25 or mitigate the loss or impairment of health, property and essential services and is 26 therefore an emergency, ,- '-' 2 3 4 5 6 7 '" 27 2. The emergency will not permit a delay resulting from a competitive 28 solicitation for bids, 16 following vote: 17 AYES: 18 NOES: 19 ABSENT: 20 21 22 23 24 25 26 ... 27 28 \. 5 6 7 8 9 10 11 12 13 ~ 14 15 Resolution 2647 Page 2 1 3, Immediate actions directly related to the emergency, including repair or 2 replacement of the A-Line by Elk's Club and actions to procure the necessary equipment, 3 services and supplies are necessary to respond to the emergency and shall be made 4 without giving notice for bids to let contracts. 4. The General Manager of the District is hereby authorized and directed to order any action necessary and appropriate to respond to the emergency including repair or replacement of the A-Line by Elk's Club, and the procurement of any necessary equipment, services and supplies, without giving notice for bids to let contracts, 5. Emergency repairs related to the damage for the A-Line by Elk's Club, are necessary to maintain service and repair actions are necessary to mitigate the emergency and are thus exempt from the requirements of CEQA. 6. This Resolution shall take effect immediately.
