RESOLUTION NO. 2646
A Resolution of the South Tahoe Public Utility District
Declaring an Emergency, Authorizing Contracts without Bids,
Delegating Authority to Order Emergency Action
and Determining CEQA Exemption
WHEREAS, the South Tahoe Public Utility District (District) is engaged in the
collection, treatment and disposal of wastewater; and
WHEREAS, severe weather conditions and excessive runoff caused damage to the
the Tahoe Keys Force Main river crossing in the Upper Truckee River between Carrow's
8 Restaurant and Tahoe Amusement Park; and
9 WHEREAS, these events have caused heavy erosion of both the river bottom and
10 river banks which caused the 16-inch Tahoe Keys Force Main river crossing in the Upper
11 Truckee River to become exposed; and
12 WHEREAS, this portion of the Tahoe Keys Force Main river crossing in the Upper
13 Truckee River next to Carrow's Restaurant needs to be repaired and protected from
\., 14 further damage; and
15 WHEREAS, it is possible most repairs can be done internally without excavation;
16 however, protection of the pipe may consist of driving sheet piling into the river and
17 backfilling behind the piling to protect the pipe; and
18 WHEREAS, a permanent repair can be done by replacing the existing line by
19 directional drilling, or installing a new line on the bridge; and
20 WHEREAS, the damaged related to the Tahoe Keys Force Main river crossing in
21 the Upper Truckee River near Carrow's Restaurant is an unexpected occurrence posing a
22 clear and imminent danger which could lead to the loss or impairment of health, property
23 and/or essential public services; and
24 WHEREAS, substantial evidence has been provided to the District which
25 demonstrates immediate action is necessary to prevent this loss or impairment, repair
26 these facilities, and enter into agreements with contractors to perform such repairs
~ 27 necessary to maintain service; and
28 WHEREAS, emergency projects are exempt from the requirements of the California

Environmental Quality Act (CEQA) pursuant to CEQA guidelines sections 15269 and
2 15369.
3 NOW, THEREFORE BE IT RESOLVED AS FOLLOWS:
4 1. The damage related to the Tahoe Keys Force Main river crossing in the
5 Upper Truckee River near Carrow's Restaurant is a sudden, unexpected occurrence that
6 poses a clear and imminent danger requiring immediate action to prevent or mitigate the
7 loss or impairment of health, property and essential services and is therefore an
8 emergency.
9 2. The emergency will not permit a delay resulting from a competitive
10 solicitation for bids,
11 3. Immediate actions directly related to the emergency, including repair or
12 replacement of the Tahoe Keys Force Main river crossing in the Upper Truckee River
13 near Carrow's Restaurant, and actions to procure the necessary equipment, services and
14 supplies are necessary to respond to the emergency and shall be made without giving
15 notice for bids to let contracts,
16 4. The General Manager of the District is hereby authorized and directed to
17 order any action necessary and appropriate to respond to the emergency including repair
18 or replacement of the Tahoe Keys Force Main river crossing in the Upper Truckee River
19 near Carrow's Restaurant, and the procurement of any necessary equipment, services and
20 supplies, without giving notice for bids to let contracts.
21 5. Emergency repairs related to the damage for the Tahoe Keys Force Main
22 river crossing in the Upper Truckee River near Carrow's Restaurant, are necessary to
23 maintain service and repair actions are necessary to mitigate the emergency and are thus
24 exempt from the requirements of CEQA.
25 6. This Resolution shall take effect immediately,
26 WE, THE UNDERSIGNED, do hereby certify that the above and foregoing
27 Resolution was duly and regularly adopted and passed by the Board of Directors of the
28 South Tahoe Public Utility District at an regular meeting held on February 6, 1997 by the
