RESOLUTION NO. 2643
A Resolution of the South Tahoe Public Utility District
Declaring an Emergency, Authorizing Contracts without Bids,
Delegating Authority to Order Emergency Action
and Determining CEQA Exemption
WHEREAS, the South Tahoe Public Utility District (District) collects, treats and
disposes wastewater, and operates and maintains an export pipeline system conveying
the treated effluent from the wastewater treatment plant over Luther Pass to Harvey
Place Reservoir in Alpine County California, and
WHEREAS, severe weather conditions caused Grass Lake Creek to overflow and
thereby exposed an approximate 150 foot section of the newly constructed B-Line which
9 conveys the treated effluent; and
10 WHEREAS, the fill material used to support the B-line was washed away leaving
11 the pipeline unsupported; and
12 WHEREAS, these events have exposed the pipeline to potential future damage;
13 and
14
WHEREAS, with the line unsupported and exposed, the ability to pump effluent out
) 5 of the Lake Tahoe Basin is in jeopardy; and
16 WHEREAS, portions of the access road and areas surrounding the B-line have
1 7 been washed out; and
18 WHEREAS, the damage related to the B-line near Grass Lake Creek is an
19 unexpected occurrence posing a clear and imminent danger which could lead to the loss
20 or impairment of health, property and/or essential public services; and
21 WHEREAS, substantial evidence has been provided to the District which
22 demonstrates immediate action is necessary to prevent this loss or impairment, repair
23 these facilities, and enter into agreements with contractors to perform such repairs
24 necessary to maintain service; and
25 WHEREAS, emergency projects are exempt from the requirements of the California
26 Environmental Quality Act (CEQA) pursuant to CEQA guidelines sections 15269 and
27 15369.
28 NOW, THEREFORE BE IT RESOLVED AS FOLLOWS:

1, The damage related to the B-line near Grass Lake Creek is a sudden,
'-' 2 unexpected occurrence that poses a clear and eminent danger requiring immediate action
3 to prevent or mitigate the loss or impairment of health, property and essential services and
4 is therefore an emergency.

The emergency will not permit a delay resulting from a competitive
6 solicitation for bids.

Immediate actions directly related to the emergency, including repair or
8 replacement of the B-line and the area around the B-Iine near Grass Lake Creek, and
9 actions to procure the necessary equipment, services and supplies are necessary to
10 respond to the emergency and shall be made without giving notice for bids to let contracts
11

The General Manager of the District is hereby authorized and directed to
12 order any action necessary and appropriate to respond to the emergency including repair
13 or replacement of sections of the B-Iine or sections and areas surrounding the B-Iine, and
14 the procurement of any necessary equipment, services and supplies, without giving notice
\., 15 for bids to let contracts,

Emergency repairs related to the damage for the 8-line near Grass Lake
17 Creek, are necessary to maintain service and repair actions are necessary to mitigate the
18 emergency and are thus exempt from the requirements of CEQA.

This Resolution shall take effect immediately.
20 WE, THE UNDERSIGNED, do hereby certify that the above and foregoing
21 Resolution was duly and regularly adopted and passed by the Board of Directors of the
22 South Tahoe Public Utility District at an emergency meeting held on January 3, 1997 by
23 the following vote:
24 AYES: Directors Jones, Mason, Mosbacher
