Resolution 2635 ~ 1 2 3 4 5 6 7 8 10 11 12 13 14 \. 15 16 17 18 RESOLUTION NO. 2635 A RESOLUTION OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT SUPERCEDING RESOLUTION NO. 2634 DECLARING AN EMERGENCY. AUTHORIZING CONTRACTS WITHOUT BIDS. DELEGATING AUTHORITY TO ORDER EMERGENCY ACTION AND DETERMINING CEOA EXEMPTION WHEREAS, the South Tahoe Public Utility District (District) collects, treats and disposes wastewater and operates and maintains an export pipeline system conveying the treated effluent from its wastewater treatment plant over Luther Pass to the Harvey Place Reservoir in Alpine 9 County, California; and WHEREAS, portions of the export pipeline system (C-Line) conveys treated effluent by gravity approximately 10.7 miles from the summit of Luther Pass to the Harvey Place Reservoir with an estimated vertical drop of 2,100 feet; and WHEREAS, portions of the C-Line are constructed across the Carson River; and WHEREAS, inspections of the C-line by District personnel and retained consultants at Carson River crossings revealed significant damage to the pipeline including a four to six foot missing section of the concrete encasement around the pipeline, probably loss or damage of the interior mortar lining, exposure of a large segment of the bare steel cylinder and dents or depressions in the steel cylinder, all which have directly and indirectly resulted from the erosive 19 effects of the Carson River; and 20 WHEREAS, the damage to the C-line could potentially result in a rupture of the pipeline at 21 any time with a consequent discharge of effluent into the Carson River; and 22 WHEREAS, the District's emergency retention basin facilities have capacities to store 23 treated effluent for approximately ten (10) days and a rupture of the pipeline could result in 24 exceeding the basin's capacity limitation; and 25 WHEREAS, the damage to the C-Line is an unexpected occurrence posing a clear and 26 imminent danger which could lead to the loss or impairment of health, property, and/or essential 27 public services; and \." 28 C 1 2 3 4 5 6 7 8 9 \.. ~ Resolution 2635 WHEREAS, substantial evidence has been provided to the District which demonstrates immediate action is necessary to prevent this loss or impairment, repair the pipeline and enter into agreements with contractors to perform such repairs necessary to maintain service; and WHEREAS, emergency projects are exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines sections 15269 and 15369. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The damage to the C-Line is a sudden, unexpected occurrence that poses a clear and imminent danger requiring immediate action to prevent or mitigate the loss or impairment of health, property and essential services and is therefore an emergency. 10 2. The emergency will not permit a delay resulting from a competitive solicitation for 11 bids. 12 3. Immediate actions directly related to the emergency, including repair or replacement 13 of sections of the C-Line, and actions to procure the necessary equipment, services and supplies 14 are necessary to respond to the emergency and shall be made without giving notice for bids to 15 let contracts. 16 4. The General Manager of the District is hereby authorized and directed to order any 17 action necessary and appropriate to respond to the emergency including the repair or replacement 18 of sections of the C-Line, and the procurement of any necessary equipment, services and supplies, 19 without giving notice for bids to let contracts. 20 5. Emergency repairs to the C-Line are necessary to maintain service and repair actions 21 are necessary to mitigate the emergency and are thus exempt from the requirements of CEQA. 22 6.
