RESOLUTION NO. 2634
A RESOLUTION OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT
DECLARING AN EMERGENCY. AUTHORIZING CONTRACTS WITHOUT
BIDS. DELEGATING AUTHORITY TO ORDER EMERGENCY ACTION
AND DETERMINING CEOA EXEMPTION
WHEREAS, the South Tahoe Public Utility District (District) collects, treats and disposes
wastewater and operates and maintains an export pipeline system conveying the treated effiuent from
its wastewater treatment plant over Luther Pass to the Harvey Place Reservoir in Alpine County,
California; and
WHEREAS, a portion of the export pipeline system (C-Line) conveys treated effiuent by
gravity approximately 10.7 miles from the summit 0 f Luther Pass to the Harvey Place Reservoir with
an estimated vertical drop of 2, 1 00 feet; and
WHEREAS, a portion of the C-Line is constructed across the Carson River at Crystal
Springs; and

WHEREAS, an inspection of the C-Line by District personnel and retained consultants at
the Carson River crossing revealed significant damage to the pipeline including a four to six foot
missing section of the concrete encasement around the pipeline, probable 10ss or damage of the
interior mortar lining, exposure of a large segment of the bare steel cylinder and dents or depressions
in the steel cylinder, all which have directly and indirectly resulted from the erosive effects of the
Carson River; and
WHEREAS, the damage to the C-Line could potentially result in a rupture of the pipeline
at any time with a consequent discharge of effluent into the Carson River; and
WHEREAS, the District's emergency retention basin facilities have capacities to store
treated effluent for approximately ten (10) days and a rupture of the pipeline could result in exceeding
the basin's capacity limitation; and
WHEREAS, the ~amage to the C-Line is an unexpected occurrence posing a clear and
imminent danger which could lead to the loss or impairment of health, property and/or essential public
services; and
WHEREAS, substantial evidence has been provided to the District which demonstrates
immediate action is necessary to prevent this 10ss or impairment, repair the pipeline and enter into
agreements with contractors to perform such repairs necessary to maintain service; and '

WHEREAS, emergency projects are exempt from the requirements of the California
Environmental Quality Act (CEQA) pursuant to CEQA Guidelines sections 15269 and 15359.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

imminent danger requiring immediate action to prevent or mitigate the loss or impairment of health,
property and essential public services and is therefore an emergency.

are necessary to mitigate the emergency and are thus exempt from the requirements of CEQA.
6. This Resolution shall take effect immediately.
WE, THE UNDERSIGNED, do hereby certify that the above and foregoing Resolution
was duly and regularly adopted and passed by the Board of Directors of the South Tahoe Public
Utility District at a regular meeting duly held on the 15th day of August, 1996 by the following vote:
