'-' 4.. ~ RESOLUTION NO. 2588 2 3 A RESOLUTION OF THE BOARD OF DIRECTORS OF SOUTH TAHOE PUBLIC UTILITY DISTRICT AUTHORIZING CONDITIONAL EXCHANGE OF SEWER CAPACITY WITH THE SOUTH TAHOE REDEVELOPMENT AGENCY 4 BE IT RESOLVED, by the Board of Directors of the 5 South Tahoe Public Utility District, County of EI Dorado, State of 6 California, as follows: 7 WHEREAS, the South Tahoe Public Utility District 8 (District)' currently holds sewer capacity exclusively for use by 9 Affordable Housing projects; and 10 WHEREAS, the South Tahoe Redevelopment Agency (Agency) II currently has 566 sewer units banked for future development 12 associated with Redevelopment Project No.1, and will identify 150 13 sewer units that will not be needed for construction of 14 Redevelopment Project No.1; and 15 WHEREAS, the District wishes to exchange sewer capacity 16 from its Affordable Housing reserve with sewer capacity acquired by 17 the Agency through the redevelopment process to provide capacity 18 for the 1994 residential construction season; arid 20 charges on banked sewer capacity and the ability to establish an 19 WHEREAS, the Agency will benefit from reduced service 2] equitable fee for sewer capacity for an affordable housing 22 developer; and 23 WHEREAS, it is the intention of both Agency and District, 24 as well as the City of South Lake Tahoe, to facilitate new 25 residential construction in 1994; 26 27 NOW, THEREFORE, BE IT RESOLVED, that the South Tahoe Public Utility District agrees to exchange 150 sewer units held in 28 reserve for affordable housing projects for 150 sewer units '-' \. \. , Resolution No. 2588 Page 2 acquired by the South Tahoe Redevelopment Agency, under the 2 following terms and conditions; 3 4 5 6 7 8 9 10 II .2 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Of the 150 sewer units from the District's 1. affordable housing reserve, 98 shall be the units allocated for the Tahoe pines Apartments. The Agency shall sell these units to the Tahoe Pines developer for whatever price it chooses; a transfer fee of $1,330 per sewer unit will be payable to the District upon final review of plans and issuance of a sewer permit; and 2 . Of the remaining unallocated 52 sewer units obtained from the District's affordable housing reserve, the Agency shall be free to sell these units for approved affordable housing projects for whatever price it chooses, and no transfer fee will be owed to the District upon the sale and/or allocation of these units; and 3. The District will not charge Agency sewer service charges for any of the sewer units obtained from the affordable housing reserve so long as the sewer units are under control of the Agency and no physical connection is made to the sewer collection system; and 4.
