DISCUSSION: On April 13, 2010, the District received seven (7) bids for the project named above. Bids ranged from $1,198,153.50 to $1,508,880.00. The engineer's estimate for the project is $1,885,680.00. Staff is currently reviewing the top three bids for compliance with funding requirements for disadvantaged business outreach (DBE) and other contractual requirements (Buy American), and will make a recommendation to the Board for award of the bid, which will be distributed prior to, and at the Special Board Meeting. Bids ranged from $1,198,153.50 to $1,508,960. The engineer's estimate was $1,885,680. A careful review and analysis of the three lowest bids showed only minor deviations. See Lisa Hamm's attached spreadsheet and list of deviations for full breakdown of each bid. Staff has completed a careful review and approved the Good Faith Effort submitted by Teichert Construction and recommends the Board waive the minor bid deviations and awards the above contract to the lowest responsive responsible bidder Teichert Construction for $1,198,153.50. I contacted the Contractors License Board and was given the following information: License Number 8 is current and active and expires 04/30/2011. The company is a corporation. Teichert Construction holds a Class A — General Engineering Contractor license. Only the name of the agent was on the first blank, the brokers name on the second blank and third paragraph; therefore failing to provide the name of the insurance company. Campbell Construction • Bid Book, under subcontractor list, contractor listed a supplier due to confusion with the spec wording. • Certification by Contactor's Insurance Broker was filled out incorrectly with only the name of the agent in the first blank. White Rock Construction Inc. • Bid Book, under subcontractor list, contractor did not provide surveyor license number. • Bidder's General Information, under item 5, contractor failed provide surety company information, only the brokerage information was provided. • Certification by Contractor's Insurance Broker has only an agents name in the first blank.
