ITEM - PROJECT NAME: SCADA Improvements
REQUESTED BOARD ACTION: (1) Waive bidding procedures, as outlined in the
Purchasing Policy, for standardized equipment requiring compatibility with existing
equipment, and to be purchased from the existing supplier; and (2) Authorize purchase
of three Moscad RTU's from Global Data Specialists, Inc., in the amount of $15,003
plus tax.
DISCUSSION: New MOSCAD Remote Terminal Units (RTUs) are needed at several
sewer lift stations. The new RTUs will enable the transfer of detailed pump station flow
data to a central database at the treatment plant. The Board authorized standardization
of MOSCAD equipment for field RTUs in 2001.
The District's Purchasing Agent has reviewed this item.

ITEM - PROJECT NAME: Wellhead Treatment Facilities Design
REQUESTED BOARD ACTION: Approve District staff entering into negotiations with
Carollo Engineers to complete an Arsenic Treatment Facilities Design for the
Arrowhead Well NO.3.
DISCUSSION: On June 1, 2006, the Board approved the May 24, 2006 Phase II Scope
of Services and Budget from Carollo Engineers (CE) to complete those tasks required
to complete a California Department of Health Services (CaDHS) - approved Treatment
Study Report. Pilot testing of both coagulation/filtration and adsorptive media systems
was completed in November 2006. Pilot testing data evaluation, economic cost
analyses and conceptual treatment system design was completed in January 2007, with
delivery of a draft Pilot Test Report. Submittal of the final Treatment Study Report to
CaDHS is anticipated by the end of this month.
The next phase of engineering services for this project will involve developing a final
Arsenic Treatment Facilities Design. CE was originally selected to conduct the Arsenic
Treatment Study on a competitive basis. During the treatment study, CE has met or
exceeded staff expectations within project budget and schedule constraints. In order to
ensure continuity on this project, District staff seeks approval to broaden the existing
scope of work to include the Treatment Facilities Design. Staff will present a summary
of the CE proposal for these services at the March 15, 2007 Board Meeting.

ITEM - PROJECT NAME: Reimbursement to the Department of Health Services (DHS)
Drinking Water Treatment and Research Fund
REQUESTED BOARD ACTION: Authorize repayment of $827,626 the DHS provided
the District in 2000 and 2001 to assist with replacing lost water production from MTBE
contamination.
DISCUSSION: The DHS has requested the District repay $827,626 to their Drinking
Water Treatment and Research Fund. In 2000 and 2001 the DHS provided the District
with $827,626 in funding for the Arrowhead and Gardner Mountain (aka Valhalla) wells.
The funding was given to assist the District with replacing lost water production from
MTBE contamination. State law required the District to pursue the responsible parties
for recovery of the state funds and to repay the state with the recovered monies.
This repayment is required by state law unless despite all reasonable efforts, recovery
from a responsible party is not possible, or that a responsible party cannot be identified.
The District did successfully recover money from the parties responsible for the MTBE
contamination and therefore is obligated to return this money to the state. Repayment
is recommended by staff and the Finance Committee.

RECOVERY OF FUNDING PROVIDED BY THE DRINKING WATER TREATMENT
AND RESEARCH FUN,D (DWTRF); SOUTH TAHOE PUBLIC UTILITY DISTRICT
(STPUD); GARDNER MOUNTAIN AND ARROWHEAD WELLS REPLACEMENT
PROJECTS.
The Department of Health Services (Department) has reviewed the files for the
funding provided by the Department to STPUD for the construction of the Gardner
Mountain And Arrowhead Wells Replacements Projects. The files indicate that the
Department provided STPUD with $370.225 for' the Arrowhead Wells Project and
$457,401 for the Gardner Mountain Project for a total reimbursement of $827,626,
Pursuant to Section 116367(f)(1) of the Health and Safety Code, "The Department
shall be reimbursed by a public water system that has received funds pursuant to
this section, to the extent that the public water system receives payment from any
source to cover the costs for which it received funding under this section."
The Department is informed that, in August of 2002, STPUD reached a $69 million
settlement atter suing the oil companies for selling fuel with MTBE, which was the
source of contamination for the Arrowhead and Gardner Mountain wells. Therefore,
STPUD is required by law to reimburse the Department in full for all amounts
received by STPUD from the DWTRF.

ITEM - PROJECT NAME: Lake Tahoe Wastewater Infrastructure Partnership (L TWIP)
REQUESTED BOARD ACTION: Authorize contract with the L TWIP to assist with
wastewater infrastructure capital improvement and replacement in the Lake Tahoe
basin and committing in-kind services for the District's share.
DISCUSSION: The L TWIP is a collaborative group consisting of the public utility
districts and general improvement districts in the Lake Tahoe basin, working in
conjunction with the U.S. Army Corps of Engineers (Corps). The purpose of the group is
to work synergistically to establish a programmatic approach to the Lake Tahoe basin
wastewater infrastructure capital improvement and replacement, with the possibility of
funding assistance from the Corps.
In December 2005, the District signed a MOU with the L TWIP with the intent to work
together and share resources for the common goal of the group. Through discussions
and negotiations, the attached agreement was developed to commit all the participants
to either in-kind services or funding to meet the cost distribution of the project (see
attached). It is probable that the District's entire obligation will be funded by current
staff activities and/or the expenditure associated with the 2007 Collection System
Master Plan, which is currently underway.

LAKE TAHOE WASTEWATER INFRASTRUCTURE PARTNERSHIP (L TWIP)
This Agreement is entered into this _ day of ,2007, by and between Douglas

(IVGID), Kingsbury General Improvement District (KGID), North Tahoe Public Utility District
(NTPUD), Round Hill General Improvement District (RHGID), South Tahoe Public Utility District
(STPUD), Tahoe Douglas District (TOO) and Tahoe City Publi tility District (TCPUD),
collectively referred to herein as the "Parties" or "Partnership".

7. The Parties wish ft\1(~rtner with the US Army Corp of Engineers (USACOE) to complete
planned tasks undet the Project Management Plan in addition to enhancing the regulatory
interface, and other related activities. NTPUD is recognized as the lead local agency in the
partnership with USACOE
8. NTPUD has executed a Technical Assistance Agreement between the Department of the
Army and the North Tahoe Public Utility District (herein the "TAA") dated May 3, 2006 to
implement the Project Management Plan dated January 20, 2006. The TAA is intended to
benefit all of the Parties and each of the Parties has responsibilities to the USACOE through
the NTPUD as the primary contracting party with the USACOE as a condition of obtaining
said benefits. The initial purpose of this Agreement is to administer and obtain benefits from
the T AA.

NOW, THEREFORE, based upon the foregoing, the Parties hereto agree as follows:
ARTICLE 1 - INTENT
1.1 With the execution of this Agreement. it is the intent of the Parties to provide for the
establishment of the L TWIP to assist the Parties in:

ARTICLE 2 -- CREATION OF THE tlAHOs;. ~TEW~ TER INFRASTRUCTURE

shall serve as Board $hairman until his term ends in 2007. Thereafter, the position of
Board chairll'l8h will be elected annually by the Board members. The chairman will be
responsible for $C)l'aeduling all meetings and distributing information to Parties.
2.4 Duties. The Board shall be responsible for implementing the terms and conditions of
this Agreement including, without limitation, the following:
2.4.1 Setting of periodic meetings to ensure dissemination of information and
discussion of issues;
2.4.2 Providing for cooperation among the Parties and with local, state and federal
agencies and private entities with respect to wastewater operations, maintenance
and capital planning;

2.4.3 Providing for the prevention of degradation of Lake Tahoe water through
advertising and education; and
2.4.4 Developing a budgeting and funding process that ensures that the Partnership's
cooperative efforts will be adequately staffed and funded to meet the cost share
funding goal of the parties in fulfillment of the Project Management Plan for
Technical Assistance-Lake Tahoe Watershed Restoration.
2.5 Appointment Alternatives. Each of the Parties to this Agreement shall name an
alternate Board member representative to act in the event a Party's appointed Board
representative is not in attendance at a meeting. Each alternate shall receive notices of
meetings with an invitation to attend. In the event that the Party's appointed Board
member is not in attendance at the meeting, the aU~"te Board member shall be

meeting shall be required to take action.

2.11 Location of Principal Office: Books and Records. The principal office of the
Partnership shall be the offices of the NTPUD, 875 National Avenue, Tahoe Vista,
California. The Board shall keep correct and complete books and records of account,
minutes of its proceedings and record giving the names and addresses of the members
entitled to vote. All books and records of the Board shall be kept at a location determined
by the Board and may be inspected by any Board member, or that member's agent or
attorney, for any proper purpose at any reasonable time. The accounts and records
relating to the TM will be held by the North Tahoe Public Utility District as signatory to
the Technical Assistance Agreement with the USACOE on behalf of the Parties.

ARTICLE 3 -- CHARGES
3.1 Establishment. Consistent with this Agreement, thfBoar I establish participation

ACCOU~. The Pa~ership Manager will establish and maintain records of the cash

budgeted in the'.ount. The budget will be prorated for the Parties according to Section
3.2 and provided to the Chief Financial Officer (CFO) of the NTPUD. The CFO shall
maintain an account for receipt of cash and shall transmit cash received and in kind
program costs to the USACOE on or about the first day of every other month beginning
with February 2007 for any cash and in kind services that occurred in the proceeding
period.

Cost Share and In Kind Service Credits Pursuant to the TAA. It is the intent of this
Agreement that each Party hereto shall contribute their share of the non-federal paid
costs to the TM such that no Party hereto is subsidizing the share of another. Nothing
herein shall preclude one or more of the Parties that have eligible costs exceedings their
cost share from authorizing that excess to be applied toward the cost share of another

Party in a manner agreeable to the affected Parties and without affecting the remaining
Party's share. Where allowable under the provisions of the TAA (Technical Assistance
Agreement) with the USACOE or other similar agreements with other federal partners,
parties' costs can be met with "in-kind" services if previously approved by the Board and
adequately documented. The cost basis for in-kind services for each Party shall be
approved by the Board for equipment costs, labor overhead, and any administrative
charges. Credit for Parties cost share by use of "in-kind" services shall require Parties to
prepare documentation and records in accordance with the Federal Single Audit Act.
Otherwise, payment shall be made in legal tender. Failure of any Party to budget or
provide funds or in kind service credits or receive credits from other Party pursuant to
the T AA on a schedule approved by the USACOE shall, in to being grounds for
termination of said Party's benefits pursuant to the TAA, said Party liable for any
damages or costs suffered by any other Party to this t due to said failure.
ARTICLE 4 - MISCELLANEOUS
4.1 No Joint Venture. The Parties specificalfV acknowleege that no Pa . cting as the
agent of any other Party in any respect, and that each IIIfty is an indep ent entity with
respect to the terms, covenants and conditions CC!mt<<ined in this Agreement. None of the
terms or provisions of this Agreement shall be deet1ted to create a partnership between
or among the Parties in their bUSi'Aesses, operations. affairs, or otherwise; nor shall it
cause them to be considered joint ver:t1urres or members.~t8nyjoint enterprise.
4.5 E~j Aareement. ltais writ1fm Agreement constitutes the entire Agreement between
the P'3f'lties with resPMt to the subject matter of the Agreement and supersedes all
negotiations, prior agrt~ements, and understandings between the Parties with respect to
the subject matter.
4.6 Further ActionI', Each Party agrees to take all reasonable actions, to do all reasonable
things, and to execute any and all documents and writings that may reasonably be
necessary or proper to achieve their purposes and objectives of this Agreement.
4.7 Good Faith. The Parties recognize and adopt the covenant of good faith and fair
dealing in carrying out this Agreement.
4.8 Modification. The Parties may not modify the terms of this Agreement except by written
consent of all the Parties.

4.9 Governina Law. Due to the fact that the NTPUD has executed the T AA on behalf of the
Partners and is primarily responsible pursuant to the provisions of the T AA, this
Agreement shall be governed by and construed in accordance with the laws of the States
of California and venue shall be within the County of Placer.
4.10 Construction. The Parties acknowledge that each had the benefit of legal counsel, has
had an opportunity to review this Agreement with its legal counsel, and that this
Agreement shall be construed as if jointly detailed by all Parties.
4.11 Counterparts. This Agreement may be executed by the Parties in counterparts, each of
which shall be deemed an original instrument, and all of which shall constitute one and
the same instrument.
4.12 Notices. Any and all notices or other communica~ns reqUired or permitted by this
agreement or by law to be served on or given to Party by aAy other Party. shall be in
writing, and shall be deemed duly served an when persdaUy delivered to the
party to whom it is directed, or in lieu of suth personal service, then deposited in the

charges established by each Partnership agency along with conditions for sharing as
provided by each agency. Each Partnership agency will provide and maintain sharing
provisions they are willing to offer to other agencies. These sharing provisions will be
attached to this agreement and updated as needed by each agency.

This Memorandum of Understanding (MOU) expresses the intent of lake
Tahoe basin pubic utility districts and general improvement districts (Districts) and
the U.S. Army Corps of Engineers, Sacramento District (Corps) to collaborate in
establishing a programmatic approach to lake Tahoe basin wastewater
infrastructure capital improvement and replacement. The Districts recognize the
strong connection betwee.n the service they provide and maintaining the
environmental quality for the Lake Tahoe basin as well as the vibrancy of their
communities. The Districts also recognize the benefits of collaboration among
themselves, their customers and the regulatory agencies. This MOU is not an
obligation of funds or a commitment of resources. Nor does the MOU abridge the
decision-making authorities of any signatory.
This program will be supported by signatory Districts and the Corps. This
programmatic approach will address issues common to all the signatory Districts in
providing a more effective and efficient implementation of wastewater
infrastructure capital improvement and replacement. The signatory Districts do
commit to work together and share resources for the common goal to the extent
possible for each District. The Districts will seek opportunities to share local
resources, including cash and work-in-kind of cash, to match potential state and
federal assistance.
Signatories further commit to:
. Development of a workplan outlining a phased programmatic approach to
infrastructure improvements and replacement.
. Promote the needs of wastewater infrastructure capital improvement and
replacement as a common interest to other lake Tahoe basin groups such

as the Lake Tahoe Federal Advisory Committee, the Tahoe Interagency
Executives, and Pathway 2007 Forum.
. Share any previously acquired key capital program elements with other
Districts in the interest of creating an equivalent level of operations
throughout the Lake Tahoe basin,

. Promote the use of science in development of best available technology.

The following is In response to your inquiry about what constitutes eligible in kind services under the L T
Wastewater Infrastructure Partnership. The purpose of the program is to assess the current wastewater
collection and transport system for the purposes of identifying needed rehabilitation/replacements to prevent
Sanitary Sewer Overflows. Simply stated the Partnership agreement has three areas of activity; communications
to the public, system assessment, and programmatic project identification.
In the communications aspect the work STPUD has and continues to do through your public information officer,
so far as it relates to educating the public about the wastewater infrastructure, already qualifies as in kind
services. A Fats, Oils and Grease Program would also qualify.
For system assessment, the televising or inspection of sewer system components using the NAASCO standards
qualifies. The training of employees on these standards and the process from televising to input into a
maintenance management program or other asset management program qualifies as in kind services.
The programmatic project identification process is a broad classification of activities. The USACOE through their
consultant is preparing a project database that each participant is expected to populate with information learned
during the system assessment. The participants will then assemble needed infrastructure
rehabilitation/replacement projects to systematically address the needs based on priority (risk assessment),
economy of scale in construction activities, geographic conditions, or other factors that take into account the
conditions existing in each entity's jurisdiction and structure. The sewer master plan that I understand STPUD is
undertaking is eligible as in kind service under the agreement. That said portions of a master plan may address
issues outside of the general category of preventing SSO's so perhaps not all the costs associated with the plan
should be used as in kind services.
In seeking guidelines on this matter from the Corps, Phil Brozek has offered that the in kind services do not have
to be met by each agency on a task by task basis and that the interpretation of in kind services will be as liberally
applied as possible to keep this process moving forward. The recent visit by HDR representatives has the
purpose of identifying additional activities being performed by the wastewater entities that could be considered In
kind services. The Corps is desirous of increasing their contract with HDR to achieve additional work tasks if we
can show that existing activities qualify as in kind services.

for either cash or in kind contribution. Every agency intends to meet their obligation under this agreement through
the use of in kind services. The summary of participation percentages is in Attachment A. Attachment A is part

The District's wastewater collection system consists
of approximately 420 miles of pipeline and 39 pump
stations that convey wastewater to the WWTP.
The purpose of the master plan is to provide a
comprehensive guide for improving the collection
system. It will include hydraulic and condition
assessments and will develop a detailed capital
improvement plan using the concepts of Asset
Management.
The last master plan was completed in 1986. Since
that time, the state has imposed several new require-
ments, which the new master plan will address.
Paul Sciuto reported three proposals were received
and reviewed by staff. Two firms were interviewed
and staff recommended selection of Brown and
Caldwell. This item was reviewed by the Water and
Wastewater Operations Committee and approval
was recommended.

with.
Director Wallace arranged a lunch that included
Assemblyman Ted Gaines, District staff, and David
Kelly to provide an overview of the District's system.

Director Wallace reported the agency approved EL DORADO COUNTY WATER
transitioning the District out of its entire share of AGENCY PURVEYOR REPORT
funding. They plan to return 80% to the District for
2006/07. Beginning in 2007/08, funding will be
phased out by 2011. After 2010, the District will have
to apply on a year-to-year basis for specific projects to
be funded. District representative, Dennis Cocking,
intends to be more of a presence at the agency's
regular meetings.

REQUESTED BOARD ACTION: (1) Hold a Public Hearing to receive public
comments; and (2) Adopt Resolution No. 2826-07 adopting the 2005 Urban Water
Management Plan (UWMP) Update and declaring the Board's intent to implement water
conservation measures.

DISCUSSION: The Urban Water Management Planning Act of 1983 (California Water
Code Division 6, Part 2.6, Section 10610) requires that UWMPs be updated every five
years. The last update was scheduled for December 31,2005 for local water suppliers
that deliver more than 3,000 acre feet of water or have more than 3,000 customers. The
2000 plan was revised and submitted to meet the new deadline, but did not meet the
current state requirements and was not accepted. Kennedy/Jenks Consultants were
contracted to update and complete the 2005 UWMP.
The plan submitted for adoption fulfills the District's requirements to date. Notice of
Public Hearing was published in the Tahoe Daily Tribune on February 2,2007, and
February 8,2007. A copy of the draft plan was made available for public revieW
beginning February 1, 2007, at the District Customer Service Office.

WATER CONSERVATION MEASURES
7 WHEREAS, Water Code Section 10610 et. seq., known as the Urban Water
8 Management Planning Act, mandates that every urban supplier of water providing water
9 for municipal purposes to more than 3,000 customers or supplying more than 3,000
10 acre feet of water annually, prepare an Urban Water Management Plan ("Plan"); and
11
12 WHEREAS, the Urban Water Management Act requires urban water suppliers to
13 describe and evaluate sources of water supply, efficient uses of water, demand
14 mana gement measures, implementation strategy and sched ule, and other relevant
15 programs and information; and
16
17 WHEREAS, in accordance with Water Code Section 10620, the South Tahoe
18 Public Utility District has made available its Plan for review in advance of the Public
19 Hearing; and
20
21 WHEREAS, such statues require the Plan be reviewed at least once every five
22 years, and that the District as an urban water supplier make any amendments or
23 changes to the Plan which are indicated by the review; and

25 WHEREAS, such statues require the Plan be adopted after public review and
26 hearing, and filed with the California Department of Water Resources, the California
27 State Library, and any city or county within which the supplie r provides water supplies
28 within thirty days of adoption; and

The U.S. Environmental Protection Agency (U.S. EP A) has adopted a revised MCL for
arsenic of 0.010 mg/L, along with monitoring requirements, arsenic health effects
language, and best available technologies for arsenic contamination mitigation. The
effective date for the new federal MCL was January 23, 2006. Although the California
Department of Health Services (Department) is in the process of adopting new
regulations, it is unknown when the state regulation will be adopted.
In the meantime, the Department will be implementing the new federal requirements.

The pending state MeL
If your source water arsenic level is not approaching the new federal MCL,
there is nothing special that you need to do.
State MCL: What will the state MCL be?
There is no way to know for certain what the state MCL will be at this time,
because the state regulation package is still undergoing review and has not been subject
to public comment yet. Since a state MCL cannot be less stringent than a federal MCL, it
will not be higher than 0.010 mg/L.
State MCL status: When will the state adopt its revised MCL?
Under law, regulation packages must proceed through a number of steps prior to
adoption, including:

· Reviews by the Department's Office of Regulations, the Budget Office, Legal
Services, and the state Department of Finance,
· A public comment period,
· A final review by the Office of Administrative Law, and finally,
· Signing into the California Code of Regulations by the Secretary of State.
The regulation package is currently still in the regulatory adoption process. The soonest
one could anticipate adoption would be in Fall 2007; the latest could be the end of2008.

The Department will implement the federal MCL and monitoring requirements;
however, it will not have the authority to enforce the MCL, i.e., take enforcement steps,
such as issuing citations, until the state regulations have taken effect. If a violation of the
federal MCL should occur, the Department will notify the U.S. EPA. The U.S. EPA will
then take any necessary enforcement action. Most likely, both the Department and U.S.
EP A will work with you to set up a compliance schedule.
Systems affected: What systems are required to comply with the new federal (and
state) arsenic MCL requirements?
All community and nontransient-noncommunity (NTNC) water systems must
comply with the new federal requirements beginning January 23,2006.
Monitoring under new requirements
Monitorin!!: What monitoring does a water system have to do to be compliant with
the new requirements?
· If you are monitoring quarterly for arsenic, continue to do so.
· If you have an arsenic monitoring waiver for a source with any historical data
greater than 0.010 mg/L, your waiver will be rescinded and you will need to collect a
sample during the first quarter of 2006.
· If you have an arsenic monitoring waiver for a source that has never exceeded
0.010 mg/L, monitor as required under your waiver.
· For other sources, collect and analyze an initial sample under the new rule
pursuant to your routine compliance monitoring schedule.

Grandfatherim! data: If a system collected an arsenic sample between January 1,
2005, and January 23, 2006, is it required to grandfather this data?
No. You have the option of doing so, but you are not required to grandfather data
because the requirements related to compliance monitoring did not take effect until
January 2006. Ifthe sample result was equal to or less than 0.010 mg/L, you may
grandfather this sample result and continue monitoring according to your routine
compliance monitoring schedule (once/3 years).
If the sample result (or arithmetic average of sample results) exceeds 0.010 mglL
and you grandfathered this data, you would be in immediate violation of the federal MCL
as of January 23,2006. Before making a decision to grandfather such data, the
Department recommends that you contact your regulatory oversight person (the
applicable Department office or LP A) regarding your existing monitoring compliance
schedule, whether to grandfather this data, and when next to sample.
Waivers: Is it possible for a source to be waived from monitoring?
Yes; as for other inorganic chemicals, you may apply to the Department for a
waiver from the routine monitoring frequency, if the source has been monitored at least
three periods (groundwater) or three years (surface water) and all previous analytical
results are less than 0.010 mg/L. The waiver period is nine years during which the source
must be monitored once.
Roundine Policv: What is the Department's rounding policy for data and data
averages?
The federal regulations require that data must be rounded to the nearest 0.001
mg/I. The Department's 2007 rounding policy is consistent with the U.S. EPA's policy
for rounding. If the digit following those to be retained is 5 and is only followed by
zeroes, the last digit retained is increased by one. In other words, any result equal to or
greater than 0.0105 mg/L would be an exceedance of the arsenic MCL of 0.010 mg/L.
When averaging results, any rounding should be performed after the mathematical
operation. However, the water system should submit all data in its raw, "unrounded",
form.
Result < 0.010 me/L: If the sample result is less than or equal to 0.010 mg/L, what is
a system required to do?
If the sample result does not exceed 0.010 mg/L, you must sample annually for
surface water sources and once every three years for groundwater sources, unless the
Department directs you to monitor quarterly because the result and/or historical data
indicate levels close to the MCL.

Compliance determinations
Result> 0.010 m!!:lL: If the sample result is greater than 0.010 mgIL, what is a
system required to do?
1. a. Initiate a compliance determination process: Notify the Department within
48 hours of receiving the result and collect and analyze three quarterly samples;
or
b. Initiate a sample result confirmation process: Notify the Department
within 7 days ofreceipt of the result and collect one additional sample within 14 days to
confirm the result. If the average of the two samples collected exceeds the MCL, notify
the Department within 48 hours of receiving the confirmation result and collect and
analyze a minimum of three more quarterly samples, consecutively;
2. Average all monitoring results (i.e. initial and confirmation) for each quarter.
Calculate the running annual average based on each quarterly average to determine
whether the source is in violation of the new MCL; and,
3. Proceed as follows:
· Average exceeds 0.010 mg/L: You are in violation of the revised standard.
Contact the Department, notify the public, and take steps to come into compliance (see
information below for more details); note that a 0.0105 average rounds to 0.011 and,
therefore, exceeds the MCL and is a violation.
· A verage does not exceed 0.010 mg/L: Monitor the source quarterly until the
Department determines that the source is reliably and consistently below the MCL. A
minimum of two quarterly samples that have levels below the MCL would be required
before the Department would consider reducing the monitoring frequency.
Notes:
1. Four quarters of results may not be necessary to determine a violation. If the result of
anyone sample collected would cause the annual average to exceed the MeL (i.e. the
sum of sample results to date exceeds 0.042 mg/L), the source is immediately out of
compliance).
2. Compliance is based on the running annual average of quarterly samples collected
during a period of twelve months. If a system fails to collect all four quarters,
compliance will be determined at the end of the last quarter during which monitoring was
required by averaging those samples that were collected. In this case, regardless of
whether or not the running annual average exceeds the MCL, the system would have
committed a monitoring and reporting violation, which will lead to public notification.
Violation timeframe: What is the soonest that a system could be in violation of the
revised MeL?
If you choose to grandfather a sample result, or average of results, collected in
2005 and such results exceed 0.010 mg/L, you would be in violation as of January 23,
2006.

If you do not choose to grandfather data, the soonest your source could be in
violation would be three quarters after you collect the initial sample exceeding the MCL
that triggers you into quarterly monitoring to determine your compliance status, unless
the sum of sample results exceeds 0.042 mg/L before you have collected all the required
samples.
Source taken offline: Would a system be in violation of the MCL if it did the
following: Collected a sample that exceeds the MCL, followed by one or more
quarterly samples, then takes the source offline, and initiates a process to install
treatment?
No. However, you should consult with your regulatory oversight person (the
Department or LP A). Once you take the source offline, you must either initiate an
application for an amended permit for treatment and reactivation, request that the
Department designate the source as a "standby source", or disconnect it from the
distribution system. Regardless of which option you select, in your next Consumer
Confidence Report. you must include all collected data, along with an explanation of
what you are doing and why.
If you decide that you want to bring the source back online without treating it, you
should notify the Department or your LP A. You will be required to complete the
quarterly monitoring and determine compliance by averaging all the samples collected
since the compliance determination was first triggered (prior to going offline), including
the first sample that exceeded the MCL.
Result> 10 times MCL: Are there any special requirements if the arsenic level
found in a source exceeds 10 times the MCL?
There are no special requirements under the new federal regulations. However,
the draft state regulations include a requirement that any source with an inorganic
chemical at a level greater than 10 times the MCL must be taken off line immediately.
Since water systems have been required to be in compliance with the MCL of 0.050 mg/L
for many years and that level is only 5 times the new MCL, the Department does not
anticipate any sources being impacted by this proposed requirement.
MCL exeedance in treated effluent: What happens if a treated effluent sample
exceeds the MCL?
The objective of the arsenic treatment is to produce water that reliably meets the
MCL at all times; the operations plan needs to address how treatment failures will be
avoided and how the utility would respond, should one occur. However, if a utility has
one or more treated water sample(s) that exceed the MCL, it must notify the Department
in its monthly report, including the estimated length of the exceedance(s) and the actions
taken to correct the situation. The Department will review the report and may require
additional follow-up actions; depending on the situation, the Department may require
public notification.

Notification and Consumer Confidence Report
Notification: What type of notification is required for an arsenic MCL violation?
An arsenic MCL violation requires a Tier 2 notification, pursuant to federal
regulations and the state public notification regulations (see "Tier 2 Notice", Title 22,
section 64463.4 of the state regulations)
You must give the Tier 2 notice as soon as possible and within 30 days after you
learn of the violation. In addition, you must:
· Maintain posted notices in place for as long as the violation or occurrence continues,
but in no case less than seven days; and
· Repeat the notice every three months as long as the violation continues.
Community water systems: Unless othetwise directed by the Department in writing
based on the Department's assessment of the violation, community water systems must
give public notice by:
· Mail or direct delivery to each customer receiving a bill, including those that
provide their drinking water to others (e.g., schools or school systems, apartment building
owners, or large private employers), and other service connections to which water is
delivered by the water system; and
· Using one or more of the following methods to reach persons not likely to be
reached by a mailing or direct delivery (renters, university students, nursing home
patients, prison inmates, etc.):
o Publication in a local newspaper;
o Posting in public places served by the water system, or on the Internet; or
o Delivery to community organizations.
Nontransient-noncommunity water systems (NTNC): Unless othetwise directed by
the Department in writing based on the Department's assessment of the violation, NTNC
water systems must give the public notice by:
· Posting in conspicuous locations throughout the area served by the water system;
and
· Using one or more of the following methods to reach persons not likely to be
reached by a public posting:
o Publication in a local newspaper or newsletter distributed to_customers;
o E-mail message to employees or students;
o Posting on the Internet or intranet; or
o Direct delivery to each customer.
CCR: What is required in the Consumer Confidence Report (CCR)?
2006 Report (due July 2007):
Monitoring for compliance with the MCL is not required to begin until January
23,2006. CCRs due in July of2007 report data for the year 2006, the bulk of which the
new federal MCL of 10 ppb was in effect. For more details, see the Department's 2007

The 2006 CCR is the first that could include a violation of the revised arsenic
MCL, since 2006 is the first year during which compliance monitoring is required. As
with all other violations, you would be required to highlight it and explain how you are
addressing the violation (e.g., treatment, taking source offline).
Please note that the 2006 CCRs require special health effects language for levels
between 0.005 and 0.010 mg/L.
Compliance steps
Timeframe for compliance: What timeframe will the Department allow a water
system to bring a source in violation of the MCL into compliance?
The Department will work with each water system to set up a specific compliance
schedule that protects public health and considers the particular issues that the water
system must address to install treatment and serve water meeting the MCL. If the state
has not adopted its regulations at the time that a system experiences a violation, the U.S.
EP A and the Department will consult in setting up the compliance schedule.
Exemptions: Will the Department grant exemptions for the arsenic MCL?
The Department, along with the U. S. EP A, will grant exemptions if a water
system meets the applicable criteria. If you wish to apply for an exemption, you may
submit your application to the Department and the Department will transmit it to the
appropriate staff person at U.S. EPA. The Department expects to have developed its own
application procedures and criteria for exemptions in the near future.

The Department recommends that you carefully evaluate the pros and cons of
exemptions. An exemption does not mean that you do not have to comply with the MCL.
It also does not mean that you will get more time to come into compliance; in fact,
depending on system size and arsenic concentration, the potential exists that you could to
end up with far less time. If you meet the extensive criteria involved (the Department's
criteria may be more stringent than U.S. EPA's), the primary advantage to your system is
that you are not subject to a legal suit during the timeframe between the granting of the
exemption and your coming into compliance with the MCL. The U.S. EPA has specified
the exemption timeframes depending on system size and arsenic concentration and there
is no flexibility.

POD Treatment: Can I use point-of-use (POD) water treatment devices for
compliance?
California law provides for use of point- of-entry, but not POD devices; the
Department is working to change the law.

Fundine coordination: What if a system has applied for SRF or Prop 50 funding to
solve the arsenic problem? What if the system has already applied for a different
problem---does the system need to reapply or will the Department re-rank the
system?
If the system has applied for an arsenic problem, it need not resubmit a pre-
application and it will stay in the same rank as before.
If the system has applied for a problem other than arsenic, but now has data
indicating that it will, or does, exceed the new arsenic MCL and wishes to apply for
arsenic as well, then a new pre-application might need to be submitted during the next
application cycle. To be certain, the system should contact their district engineer.
