P.M., 1900 Lake Tahoe Boulevard, City Services Center. (2) Announced planned meeting with Carol Onorato/SWRCB re Alpine County Lawsuit on 1/4/85. Attorney Weidman reported he had been working on the Schwake claim defense. Moved Jones/Second Mason/Passed Unanimously (Olson Absent) to accept TRPA Conditional Approval and authorize Finance Officer to add security to Certificate of Deposit, Moved Jones/Second Wynn/Passed Unanimously (Olson Absent) to award contract to Wunschel & Small, Inc. in the amount of $337,150 by adoption of Ordinance No. 375. Attorney Weidman explained legal points regarding a rebid. Mason questioned irregularity in Wunschel & Small bid. Explanation by Weidman. Moved Wynn/Second Mason/Passed Unanimously (OlSon Absent) to authorize execution of Task Order No. 12 in an amount not to exceed $16,593 to Culp/ Wesner/Culp for Engineering Services during construction. Presented by Assistant Manager Baer. Moved Jones/Second Mason/Passed Unanimously (Olson Absent) to authorize submittal of pre-application requesting $846,000 and authorized execution by Assistant Manager Baer. Director Jones questioned necessity of coagulation regardless of grant with Baer responding it may be a future re- quirement. Director Mason asked if requested amount included Engineering costs. Baer re- sponded there was a 10% contingency but no environmental costs. Director Mason requested an explanation of the term "coagulation" from Baer. PAYMENT OF CLAIMS SKI RUN BLVD. Weidman was not sure due to the number of people being sued and the number of agencies involved. Pursuant to order of this Board of Directors of the South Tahoe Public Utility District, County of E1 Dorado, State of California, notice was duly given for receiving bids for Ski Run Water Improvements, Contract No. 2, Bid No. 84-85-12, South Tahoe Public Utility District, and eight (8) bids were received at the time and place specified, at 2:00 P.M. on Tuesday December 18, 1984, and publicly opened. 2. Thomas Haen Company, Inc. bid the apparent iow bid in the amount of $168,978.00 for Item No. 1 through Item No. 11. 3. Pursuant to Chapter 5, Relief of Bidders, Public Centract Code Section 5100, et seq.~said Thomas Haen Company, Inc claimed relief of its bid, which relief of bid was granted by motion of the Board of Directors of South Tahoe Public Utility District on December 20, 1984. 4. The apparent second iow bid of Wunschel & Small, Inc. in the amount' of $337,150.00 for the total of Item No. 1 through Item No. 11 thus became the apparent low bid. 5. Wunschel & Small, Inc. failed to include in its bid, the following: "Part 15 - Lost Time Accident 15.01 Each Bidder shall submit with his bid: A. A copy of the company safety program 6. South Tahoe Public Utility District had on record, at the time of the submission of the Wunschel & Small, Inc. bid for the above contract,'the record for the past 3 years of lost time accidents on previous projects of said Wunschel & Small, Inc., and a copy of the company'safety program of said Wunschel & Small, Inc. 7. The bid requirement of submission of record of lost time accidents on previous projects and a copy of the company's safety program was for the District's information. 8. Under said circumstances, the failure of Wunschel & Small, Inc. to submit with its bid said record of lost time accidents on previous projects and said copy of the company safety program is an irregularity which can be waived in the discretion of the Board of Directors of South Tahoe Public Utility District. 9. It is in the best interest of the Board of Directors of South Tahoe Public Utility District to waive said irregularity 10. Under the circumstances, the lowest, responsive, responsible bid for the Ski Run Water Improvements, Contract No.2 is Wunschel & Small, Inc. NOW, THEREFORE, BE IT ENACTED by the Board of Directors of the South Tahoe Public Utility District, County of E1 Dorado, State of California, as follows: 1. Said Board of Directors does hereby waive the irregularity in the bid of Wunschel & Small, Inc. of failure to submit with its bid a record for the past . 3 years of lost time - 2 - 1 2 3 4 5 6 7 8 9 10 I1 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 accidents on previous projects and a copy of the company safety program for the reason that said information was in the possessiol of the South Tahoe Public Utility District at the time of the making of the Wunschel & Small, Inc. bid, and said requirement was for the information only of South Tahoe Public Utility Dis- trict. 2. Said Board of Directors does hereby determine that the bid of Wunschel & Small, Inc., P.O. Box 799, Fair Oaks, CA, 95628, is the lowest, responsive, responsible bidder for doing the work and improvements and furnishing the labor, materials, supplies, and equipment necessary for the ski Run Water Improvements, Contract No. 2, Bid No. 84-85-12, South Tahoe Public Utility District. 3. Said Board of Directors does hereby award said con- tract for doing the work and improvements and furnishing the labor, materials, supplies, and equipment necessary for the Ski Run Water Improvements, Contract No. 2, Bid No. 84-85-12, South Tahoe Public Utility District, at the price named in its bid for Bid Items No. 1 through No. 11 of Three Hundred Thirty-Seven Thousand, One ttundred Fifty Dollars ($337,150.00). 3. The President of said Board of Directors is hereby authorized to make and enter into a written contract with said successful bidder, Wunschel & Small, Inc., and to receive and approve all bonds in connection therewith, and the Clerk is hereby directed to attest to said President's signature and affix thereto the corporate seal of said District, all in accordance with the plans and specifications, special conditions and notice to bidders thereto approved and on file with the District. - 3 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 4. Upon adoption, this Ordinance shall be posted in three (3) public places at least seven (7) days prior to the expiration of thirty (30) days from the date of its passage, and shall be published in the Tahoe Daily Tribune, a newspaper of general circulation published in the District, one (1) time at least seven (7) days prior to thirty (30) days from the date of its adoption.
