04-08-85 ExecutiveMINUTES EXECUTIVE SESSION OF THE BOARD OF DIRECTORS SOUTH TAHOE PUBLIC UTILITY DISTRICT The Board of Directors of the South Tahoe Public Utility District met in an executive session, April 8, 1985, 4:00 P.M., 1900 Lake Tahoe Blvd., City Services Center at the request of Attorney Weidman. BOARD OF DIRECTORS: President Madden, Directors Mason, J.ones, Wynn, Olson ROLL CALL STAFF: Cofer, Baer, Fischer, Mamath, G. Eppler Attorney Weidman stated he had requested the Executive Session to discuss the pending litigation in Alpine County. Further, he stated he would file a Waiver of Notice within the seven (7) day time period to do so. 4:02 P.M. ADJOURNMENT TO EXECUTIVE SESSION 4:48 P.M. RECONVENE TO REGULAR SESSION ACTION ON ITEMS FROM EXECUTIVE SESSION None Attorney Weidman reported the District would be receiving the $117,000 from E1 Dorado County Water Agency. The Agency had indicated to him they planned to combine the tax transfer funds next year. Attorney Weidman told them there might be legal problems and suggested their legal counsel look into it. ATTORNEY'S REPORT Texas Hill funds and reimbursement issue has been postponed until the first Water Agency meeting in May. Suggested Jim Jones put the matter back on the agenda since County Water Agency had not followed the recommendation of the Water Committee. MAMATH, C~.RK OF BOARD SOUTH TAHOE PUBLIC UTILITY DISTRICT Memo No. 3 Date 4Zl1785 CONFIDENTIAL MEMORANDUM OF LEGAL COUNSEL TO THE BOARD OF DIRECTORS OF SOUTH TAHOE PUBLIC UTILITY DISTRICT STATING REASONS AND LEGAL AUTHORITY FOR HOLDING A CLOSED SESSION OF THE BOARD PURSUANT TO GOVERNMENT CODE SECTIONS 54956.8 OR 54956.9 TO: The Board of Directors of South Tahoe Public Utility District As your attorney, I submit this memorandum stating the reasons and legal authority for holding a closed session of the Board with your attorney and for the purposes set forth herein: A. There is an appeal now pending in the Court of Appeal, Third Appellate District, entitled South Tahoe Public Utility District, Plaintiff and Respondent, v. County of Alpine, et al., Defendants and Respondents, Sierra Club, Inc., et al., Intervenors-Appel!ants, Case No. 3 Civil 24892. Discussing said pending litigation, Amador County Superior Court Action No. 12657, and the Third District Court of Appeal Action No. 3 Civil 24892, in open session would prejudice the position of the Dis- trict. I only learned of a Settlement Conference advanced from June 7, 1985 to April 19, 1985 on the date of the Special Board meeting of April 8, 1985, and had no opportunity to prepare this memorandum for distribution prior to the special meeting of April 8, 1985, at which an executive Session was requested on said appeal.
