01-09-86MINUTES The Board of Directors of the South Tahoe Public Utility District met in a Special Session, January 9, 1986, 1:04 P.M., 1275 Meadow Crest Drive, South Lake Tahoe, California. BOARD OF DIRECTORS: Chairman Wynn, Directors Mason, Jones, Olson Absent: Director Madden ROLL CALL STAFF: Cofer, Mamath, Fischer, Attorney Weidman GUESTS: Melvin Springmeyer 1:05 P.M. to 1:25 P.M. EXECUTIVE SESSION Attorney Weidman requested an Executive Session to discuss pending litigation: Johnson vs Springmeyer and purchase procedures for Johnson/Springmeyer property adjacent to Treatment Plant. Guest, Melvin Springmeyer, left room. 1:25 P.M. REGULAR SESSION RESUMED Guest, Melvin Springmeyer, returned to meeting room. ITEMS FOR BOARD ACTION Chairman Wynn requested comments from Mr. springmeyer. Mr. Springmeyer stated he had nothing to add to what he had said earlier. Chairman Wynn explained the District's position on the four requests by the Springmeyers. Additional comments were made by Mr. Springmeyer and Attorney Weidman. Moved Mason/Second Olson/Passed Unan- imously (Madden/Absent) to authorize the terms of sale of property be $700,000.00/cash for Parcels No. 25-041-07, 25-051-18, 25-071-12, 25-061-19 and the naming of the parcels under District control be named Johnson/Springmeyer Park. PROPERTY PURCHASE: JOHNSON/ SPRINGMEYER PROPERTY ADJACENT TO TREATMENT PLANT SPECIAL SESSION MINUTES - JANUARY 9, 1986 Page 2 Moved Olson/Second Mason/Passed Unan- imously (Madden/Absent) to give the option to each property owner to choose terms to receive their one- third (1/3) share of $175,000/down payment and their one-third share of $525,000 balance in five equal annual principle payments, with interest paid quarterly at the max- imum allowable rate, as allowed under Section 53531 of the Govern- ment Code and if any party accepts the terms the interest is not guaranteed or warranted by the District to be tax exempt. Moved Olson/Second Jones/Passed Unanimously (Madden/Absent) to adopt Resolution No. 2376: Setting Date of Hearing on Intention to Adopt a Resolution of Necessity to Authorize Filing of Eminent Domain Proceedings.
