06-19-86 Adjourned MINUTES ADJOURNED REGULAR MEETING OF THE BOARD OF DIRECTORS SOUTH TAHOE PUBLIC UTILITY DISTRICT JUNE 19, 1986 The Board of Directors of the South Tahoe Public Utility District met in an adjourned regular session, June 19, 1986, 4:00 P.M., City Council Chambers. BOARD OF DIRECTORS: Chairman Wynn, Directors Mason, Madden, Jones, Olson ROLL CALL STAFF: Cofer, Baer, Fischer, Mamath, Plasterer, Hrbacek, Tiran, Swain, Hydrick, Cartwright, G. Eppler, E. Eppler, Attorney Weidman GUESTS: Martha Lennihan, Suellen Fulstone, Mel Schwake, Jr., Jeff De Long-Tribune HEARING (continued from June 12, 1986, 9:30 A.M.): LAND ACQUISITION/ Chairman Wynn reopened the Hearing at 4:00 P.M. Manager Cofer requested Attorney Martha Lennihan update the negotiations with Attorney Fulstone representing Melvin Schwake, Jr. and with Mr. Schwake. Attorney Fulstone responded to the explanations made by Attorney Lennihan and concurred they had come a long way on the major objections raised by Mr. Schwake on June 12th and stated the main objections had been resolved. Attorney Fulstone stated there was one remaining objection by Mr. Schwake: Rights of Mr. Schwake on the Diver- sion Structure itself - Vehicular Access & Pedestrian Access. Further she stated they would accept the vehicular access but still objected to the language in the limits of the pedestrian access. Questions were posed by members of the Board to which Ms. Fulstone responded. ALPINE COUNTY MELVIN SCHWAKE, JR. Manager Cofer added the staff felt very strongly about the issue of pedestrian access to the Diversion Structure and recommended the Board adopt the language in the Resolution as submitted. Gene Eppler responded to questions by the Board posed by Director Mason. Ms. Lennihan and Ms. Fulstone responded to his questions, also. Hearing closed at 4:27 P.M. Moved Olson/Second Madden/Passed Unan- imously to adopt Resolution No. 2403 modified to exclude the word "wastewater effluent" and to change the reference to "Mr. Schwake" to "Fee Owner" Manager Cofer requested the tape of this meeting be retained by the Clerk. 4:30 P.M.
