DETERMINING THAT PUBLIC INTEFtEST AND NECESSITY
REQUIRE THE ACQUISITION OF EASEMENTS AND DIRECTING
THE FILING OF EMINENT DOMAIN PROCEEDINGS
SEWER PROJECT
RESOLVED, by the Board of Directors of the South Tahoe Public
Utility District, that
WHEREAS, pursuant to Plans and Estimates approved by this
Board on June 2, 1951 for the construction of a certain public
utility and utility works, which is the project of supplying the
inhabitants of said District with means for the collection and dis-
position of sanitary sewage and the acquisition of lands and ease-
ments therefor, it is necessary that certain interests in land be
acquired therefor;
NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as
follows:
1. That the public interest and necessity require the acqui-
sition, construction and completion, by said District, of the pro-
posed public improvements, all as more particularly described in
said Plans and Estimates.
2. That the land and easement described in Exhibit'"A" hereto
attached and by reference incorporated herein are necessary for
said improvements;
3. That said proposed improvements are planned and located
in the manner which will be most compatible with the greatest pub-
lic good and the least private injury;
4. That a right of way in fee is necessary for Parcel 1 and
a right of way in easement is necessary for Parcel 2 as described
in said Exhibit "A";
5. That the law firms of Hughes & Maul, Placerville, California
and Kirkbride, Wilson, Harzfeld & Wallace, San Mateo, California,
employed for that purpose, be, and they ~are hereby, directed to
institut'e and conduct to conclusion an.action in eminent domain
for the acquisition of said land and easement and the acquisition
or relocation of said improvements thereon, and to take such actio~
as is necessary therein;
6. That an order of immediate possession be obtained in said
action, and that a warrant or warrants be issued to the County
Clerk of this County in the amount or amounts determined by the
Court to be deposited as a condition to the right of immediate
possession, as lollows. That the amount required to be deposited
for the possession of the parcels be drawn from the General Fund
of said District;
