RESOLUTION NO.
A SUPPLEMENTAL RESOLUTION REQUESTING CONSENT OF
THE BOARD OF SUPERVISORS OF EL DORADO COUNTY TO
UNDERTAKE APPROPRIATE SPECIAL ASSESSMENT AND
ASSESSMENT BOND PROCEEDINGS TO ACQUIRE AND CON-
STRUCT A SANITARY SEWERAGE SYSTEM AND TO THE
EXERCISE OF EXTRA TERRITORIAL JURISDICTION
THEREIN
PROJECT NO. 52-1
RESOLVED, by the Board of Directors of the South Tahoe
Public Utility District, E1 Dorado County, California, that
WHEREAS, it is the intention of this Board to undertake
appropriate special assessment and assessment bond proceedings
for the acquisition and construction of a comprehensive sanitary
sewerage collection, treatment and disposal system for the said
District and certain parcels of property outside of its boundaries
necessary to be sewered in conjunction therewith;
WHEREAS, the cost of said project will be assessed upon
the lands benefited thereby within said District or abutting upon
said improvements;
WHEREAS, a portion of said acquisitions and improvements
will necessarily be had outside of the boundaries of said District
due to the numerous exclusions therefrom at the time of the forma-
tion of said District;
WHEREAS, said acquisitions to be had and improvements to
be made are of such a character that they will directly and
peculiarly affect property not only within the boundaries of said
District but also unincorporated territory in the County of E1
Dorado outside the limits of the District, and the purpose
sought to be accomplished can best be accomplished by a single
comprehensive scheme of work;
WHEREAS, there has been approved by this Board a porposed
form of Supplemental Resolution of Intention to be used in said
proceedings; and
WHEREAS, the public interest, convenience and necessity
will be served by the making of said acquisitions and improve-
ments;
NOW, THEREFORE, IT IS ORDERED, as follows:
1. That request be, and the same is hereby, made that the
Board of Supervisors of E1 Dorado County, being the legislative
body having jurisdiction of the territory in which said work is
to be done and said assessments are to be levied, grant to this
District its consent, expressed by resolution, to order the acqui-
sitions and construction of said sanitary sewerage system in the
whole or any part of the streets in said District and to provide
that the costs may be assessed upon the properties benefited.
2. That said Board of Supervisors, in said resolution,
grant to this District its consent to open all such public streets
as are required for the installation of said sewerage facilities,
said work to be done under the direction of the District Engineer
and to the satisfaction of the County Surveyor of said County and
in conformity with good engineering practice. Said District. Engi-
neer shall require of the contractor that all of the provisions of
the specifications approved by this Board be complied with to the
end that no greater amount of ditches are opened at any time than
is necessary, that they shall be adequately lighted and barricaded
that they shall be promptly backfilled, and that the surface of
the streets shall be restored with materials of like quality and
character as those existing at the time of such work and to its
former condition and state of usefulness as nearly as may be.
3. That the Clerk of this District is hereby directed to
file with the County Clerk of E1 Dorado Count,
this resolution, together with
Resolution of Intention.
