Resolution 2945-14 1 RESOLUTION NO. 2945-14 2 A RESOLUTION OF THE SOUTH TAHOE PUBLIC UTILITY DISTRICT 3 DECLARING AN EMERGENCY, AUTHORIZING CONTRACTS WITHOUT 4 BIDS, DELEGATING AUTHORITY TO ORDER EMERGENCY ACTION, AND DETERMINING CEQA EXEMPTION 5 6 WHEREAS, the South Tahoe Public Utility District ("District") is engaged in the 7 production, treatment and distribution of water to its customers; and, 8 WHEREAS, the District's Sunset Well ("Well") was constructed in 1990, and is 9 currently used as a lag well to the Main Zone in the District's water distribution system; 10 and, 11 WHEREAS, a recent inspection of the Well by District personnel and consultants 12 revealed that fhe motor shaft in the submersible motor had dropped and was not free 13 turning, indicating worn thrust bearings; the check valve on the column pipe was not 14 functional and required replacement; scale and pitting showed significant 15 deterioration of the column pipe; and the power cable also showed sign�ricant wear; 16 and, 17 WHEREAS, installing a replacement submersible pump and motor is critical to 18 allowing the planned well evaluation and restoration work to move forward to ensuring 19 that the District has sufficient capacity before the July 4th Holiday to satisfy upcoming 20 season high water demands this summer; and, 21 WHEREAS, the damage to the well is an unexpected occurrence posing a clear 22 and imminent danger, which could lead to the loss or impairment of health, property 23 and/or essential public services; and, 24 WHEREAS, in accordance with Public Contract Code section 22050, substantial 25 evidence has been provided to the District, which demonstrates immediate action is 26 necessary to prevent this loss or impairment, repair these facilities, and enter into 27 agreements with contractors to design and perform such repair necessary to maintain 28 service, which will not permit a delay resulting from competitive solicitation for bids and 29 this action is necessary to respond to the emergency; and, 30 1 WHEREAS, emergency projects are exempt from the requirements of the 2 California Environmental Quality Act (CEQA) pursuant to CEQA guidelines section 15301 3 relating to existing facilities. 4 NOW, THEREFORE BE IT RESOLVED AS FOLLOWS: 5 1. The damage to the Sunset Well is an unexpected occurrence that 6 poses a ciear and imminent danger, which could lead to the loss or impairment of 7 health, property and essential services, and are therefore an emergency, pursuant to 8 section 1 102 of the Public Contract Code. 9 2. Immediate action directly related to the emergency, including protection to 10 the well and action to procure the necessary equipment, services and supplies is 11 necessary to respond to the emergency, which will not permit a delay resulting from 12 competitive solicitation for bids and this action is necessary to respond to the 13 emergency. 14 3. The General Manager/Engineer and Assistant General Manager/Engineer of 15 the District are hereby authorized and directed to order any action necessary and 16 appropriate to respond to the emergency including protection to the well, and the 17 procurement of any necessary equipment, services and supplies, without giving notice 18 for competitive bids to let contracts. 19 4. Emergency repairs related to the protection of the well is 20 necessary to maintain service and repair actions are necessary to mitigate the 21 emergency are thus exempt from the requirements of CEQA pursuant to CEQA 22 guidelines section 15301 relating to existing facilities. 23 5.
