RESOLUTION NO. 79
REQUESTING CONSENT OF THE BOARD OF SUPERVISORS
OF EL DORADO COUNTY TO CONSTRUCT SEWERS BY
SPECIAL ASSESSMENT PROCEEDINGS AND TO THE
EXERCISE OF EXTRA-TERRITORIAL JURISDICTION FOR
A PART THEREOF
PROJECT NO. 56-1
RESOLVED, by the Board of Directors of the South Tahoe
Public Utility District, E1 Dorado County, California, that
WHEREAS, it is the intention of this Board to undertake
appropriate special assessment and assessment bond proceedings for
the construction of the following improvements, to-wit:
The construction of standard sewer main pipes with manholes
and appurtenant structures in
(a) Fairway Avenue from U. S. Highway 50 southerly to
opposite Lot 177 easterly of the southerly portion of Glenwood
Way, and the northerly branch of Glenwood Way from Fairway Avenue
westerly to Fawn Way, and thence northerly along the easterly
branch of Fawn Way;
(b) Bijou Park Boulevard between U. S. Highway 50 and
Pioneer Trail;
(c) Mountain View Avenue between U. S. Highway 50 and
Meadow Edge Avenue;
(d) Pentagon Road for its full length, and Midway Road
between the two ends of Pentagon Road, and in an existing easement
along the dividing lines between Lots 5 and 6, Map of Pentagon
Tract; and
(e) Fern Road between U. S. Highway 50 and Lot. l, Block 1,
Map of Pinewood Park.
WHEREAS, this Board proposes to assess the costs of said
improvements and the expenses incidental thereto upon a district
benefited thereby, the exterior boundaries of which are the coter-
minous boundaries of the composite and consolidated area consistin~
of the several parcels of land abutting on and benefited by said
improvements. Said boundaries are more particularly described in
a written legal description thereof and shown on a map of the
assessment district filed with the Secretary;
WHEREAS, a portion of said improvements to be made are
within the unincorporated territory of the County of E1 Dorado
outside the District, and a portion of the lands to be assessed to
pay the costs and expenses thereof is unincorporated territory
without said District;
WHEREAS, said improvements to be made are of such a charac-
ter that they will directly and peculiarly affect property not
only within the boundaries of the District but also the unincor-
porated territory within the County of E1 Dorado outside the
District, and the purposes sought to be accomplished can best be
accomplished by a single comprehensive scheme of work;
WHEREAS, there has been filed with this Board a form of
Resolution of Intention to be used in said proceedings; and
WHEREAS, the public interest, convenience and necessity
will be served by the making of said improvements and the levying
of said assessments;
NOW, THEREFORE, IT IS ORDERED, AS follows:
1. That request be, and the same is hereby, made of the
Board of Supervisors of the County of E1 Dorado, it being the
legislative body having jurisdiction over the unincorporated
territory in which a portion of said improvements are to be had
and made and said assessments are to be levied, grant to this Boar~
its consent, expressed by resolution, to order said improvements,
to assess the costs thereof upon the property benefited thereby,
both within and without the District.
2. That request be, and the same is hereby, made that the
form of Resolution of Intention be approved. ~
3. That the Clerk of this Board is hereby directed to
file with the Clerk of the Board of Supervisors a certified copy ol
this resolution, together with a copy of said Resolution of
