Resolution No. 93RESOLUTION NO. DETERMINING Ti~T PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF REAL PROPERTY AND D~IRECTING AMENDMENT OF THE AMENDED COMPLAINT ON FILE IN EMINENT DOMAIN PROCEEDINGS SEWER PROJECT RESOL~ED, by the Board of Directors of SOUTH TAHOE PUBLIC UTILITY DISTRICT, that WHEREAS, pursuant to Resolution No. 37 of the Board of Directors of SOUTH TAHOE PUBLIC UTILITY DISTRICT heretofore and on or about the 10th day of April, 1953, duly and regularly adopted, an action in Eminent Domain was commenced in 'the Superior Court of the State of Calif- ornia, in and for the County of E1 Dorado, which said action is now pending in said Court; and WHEREAS, pursuant to Resolution No. 65 of the Board of Directors of SOUTH TAHOE PUBLIC UTILITY DISTRICT heretofore and on or about the 27th 5ay of May, 1956 an amended complaint in said pending action in Eminent Domain was filed in ohe Superior Court of the State of California, in and for the County of E1 Dorado; and WHEREAS, since the adoption of said Resolutions Nos. 37 and 65, and since the filing of said complaint and said amended complaint, it has become necessary that addi- tional land be acquired in connection with the construction of the utility works mentioned in said resolutions, and that the amended complaint on file in said action in Eminent Domain be further amended to include said additional land; -1- NOW, T~EREFORE, IT IS FOUND, DETERMINED AND ORDERED, as follows: 1. That the public interest and necessity require the acquisition of all that certain land situate in the County' of E1 Dorado, State of California, more par- ticularly described as Parcel 3 in Exhibit "A" attached hereto, and by reference incorporated herein. 2. That the lands described in W~xhibit "A" attached hereto are necessary for the construction of the improvements referred to in Resolutions Nos. 37 and 65. 3. That said proposed improvements are planned and located in the manner which will be most com- patible with the greatest public good and the least private injury. 4. That counsel of record for the. plaintiff District in said pending action in Eminent Domain be, and they are hereby, directed to prepare and file such supple- merits and amendments to the pleadings now on file t~erein, so as to include the lands described as Parcel 3 in ~hibit "A" attached hereto.
