Resolution No. 183KW~I: JS.· cs 4/25/60 8 c RESOLUTION NO. 183 A RESOLUTION DETERMINING THAT PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF EASE- MENTS AND DIRECTING THE FILING OF EMINENT DOMAIN PROCEEDINGS ASSESSMENT DISTRICT 1960-1 RESOLVED, by the Board of Directors of the South Tahoe Pub- lic Utility District, E1 Dorado County, California, that WHEREAS, pursuant to Resolution of Intention No. 173 adopte¢ by this Board on March 17, 1960, this Board did on March 31, 1960, adopt its Resolution No. 174 of Preliminary Approval of the Engi- neer's Report~ and WHEREAS, said Resolution of Intention and said proceedings were had and taken pursuant to the Municipal Improvement Act of 1913 and bonds are to be issued pursuant to the Improvement Bond Act of 1915; NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED, as follows: 1. That the public interest and necessity require the acquisition, construction and completion, by said District~ of the proposed public improvements, all as more particularly described in said Resolution of Intention and in said proceedings. 2. That the easements desoribed in said proceedings and herein described~ are necessary for said improvements. 3. That said proposed improvements are planned and located in the manner which will be most compatible with the greatest public good and the least private injury. 4. That all of said acquisitions are located within the territorial limits of this District. 5. That the law firm of Hughes, Maul and Fogerty, Placerville, California, employed for that purpose~ be~ and they are hereby, directed to negotiate for the acquisition of the ease- ments therefor herein described, and to institute and conduct to conclusion an action in eminent domain for the acquisition of such easements as are not acquired by negotiation, and to take such action as necessary therein, and that their compensation be fixed at the reasonable value thereof. 6. That an order or orders of immediate possession be ob- tained in said action or actions, and that a warrant or warrants be issued to the County Clerk of the County of E1 Dorado in the amount or amounts determined by the Court to be deposited as a con- dition to the right of immediate possession, as follows: That the amount required to be deposited for the possession of the parcels be drawn from the appropriate construction funds of said District and if there are not sufficient moneys therein, that the amount necessary therefor be transferred thereto as a loan from the general operation fund of the District. 7. That said easements so sought to be taken are all more particularly described in said Resolution of Intention and in the Engineer's report made pursuant thereto, on file in the office of the Clerk of said District, to which reference is hereby made for a particular description thereof. Said parcels are more particu- larly described as follows: (a) An easement 10 feet wide running along the bound- ary common to lots 16 and 17 in Block 80 of A1 Tahoe Subdivision. (b) An easement 10 feet wide running along the bound- ary common to lots 41 and 42 in Block 80 of A1 Tahoe Subdivision. (c) An easement 10 feet wide running along the bound- ary common to Lots 50, 51, 52, 53 and 54 in Block 80 of A1 Tahoe Subdivision. (d) An easement l0 feet wide running along the bound- ary common to lots 1, 2, 3, ~, 5, 6, 7, 10, 11, 12, 13 and 14~ in Block 93 of A1 Tahoe Subdivision. (e) An easement 10 feet wide running along the bound- ary common to lots 7, 8, 9 and 10 in Block 93 of A1 Tahoe Subdivision. (f) An easement 12 feet wide lying adjacent to and westerly and southwesterly of the westerly and south~esterly boundary of A1 Tahoe Subdivision from San Francisco Ave. south to Trout Creek. 2 (g) an easement 10 feet wide running easterly along the northerly edge of Trout Creek to the easterly boundary of A1 Tahoe Subdivision. (h) an easement 10 feet wide running along the bound- ary common to lots 16 and 17 of the Trout Creek Tract. (i) an easement 10 feet wide running along the south- erly lines of lots 16 17 18 19 20 and 30 of Trout Creek Tract. ' (j) an easement 10 feet wide running along the bound- ary common to lots 40 and 41 of Trout Creek Tract. (k) an easement 10 feet wide running along the west lines of lots 39, 40, 41 and 42 of Trout Creek Tract. (1) an easement 12 feet wide running along the line common to lots 5 and 6 of Sec. 3, T12N, R18E, M.D.B. and M. from the west line of Trout Creek Tract to the northwest corner of Tahoe-50 Subdivision. (m) an easement 10 feet wide running along the bound- ary common to parcels bearing Assessor's No.'s 31-030-13, 31-030-17, 31-030-15, and 31-030-20. (n) an easement 10 feet wide running along the north- easterly line of the parcels bearing Assessor's No.'s 31-030-10, 31-030-11, 31-030-22 and 31-030-21. (o) an easement 10 feet wide running across parcel 31-030-04 from 31-030-21 to the northwesterly corner of 31-030-19. (p) an easement 10 feet wide running along the north- erly line of Lakeview Heights Subdivision from Ski Run Boulevard west to the easterly line of lot 18 of Lakeview Heights Subdivision. (q) an easement 10 feet wide running northerly and southerly along the center of lots 7, 8 and 9 of Lakeview Heights Subdivision. (r) an easement 10 feet wide running along the line common to lots 2 and 11 of Lakeview Heights Subdivision. (s) an easement 10 feet wide running along the line common to lots 10 and 11 of Lakeview Heights Subdivision. (t) an easement 10 feet wide running along the line common to lots 1[~ and 15 of Lakeview Heights Subdivision.
