Resolution No. 151 RESOLUTION NO. ~/~-~'~ A RESOLUTION DETERMINING THAT PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION 0F EASE- M~NTS AND DIRECTING THE FILING 0F EMINENT DONA IN PROCEEDINGS ASSESSMENT DISTRICT 1959- RESOLVED~ by the Board of Directors of the South Tahoe Public Utility District~ E1 Dorado County, California, that WHEREAS~ pursuant to Resolution of Intention No. l~___~_ adopted by this Board on August 20, 19~9, this Board did on said date, adopt its Resolution No. _147 of Preliminary Approval of the Engineer's Report; and WHEREAS, said Resolution of Intention and said proceedings were had and taken pursuant to the Municipal Improvement Act of 1913 and bonds are to be issued pursuant to the Improvement Bond Act of NOW, THERE~ORE~ IT IS FOUND~ DETERMINED AND RDERED~ as 0 follows: 1. That the public interest and necessity require the acquisition, construction and completion, by said District~ of the proposed public improvements, all as more particularly described in said Resolution of Intention and in said proceedings. 2. That the easements described in said proceedings and herein described, are necessary for said improvements. 3. That said proposed improvements are planned and located in the manner which will be most compatible with the greatest public good and the least private injury. ~. That all of said acquisitions are located within the territorial limits of this District, excepting parcels (Y),(z)~(aa)~(bb). 5. That the law firm of Hughes, Maul and Fogerty, Placerville, California, employed for that purpose~ be, and they are hereby, directed to negotiate for the acquisition of the easements therefor herein described, and to institute and conduct to conclusion an action in eminent domain for the acquisition of such easements as are not acquired by negotiation~ and to take such action as necessary therein, and that their compensation be fixed at the reasonable value thereof. 6. That an order or orders of immediate possession be obtained in said action or actions, and that a warrant or warrants be issued to the County Clerk of the County of E1 Dorado in the amount or amounts determined by the Court to be deposited as a condition to the right of immediate possession~ as follows: That the amount required to be deposited for the possession of the parcels be drawn from the appropriate construction funds of said District and if there are not sufficient moneys therein, that the amount necessary therefor be transferred thereto as a loan from the general operation fund of the District. 7. That said easements so sought to be taken are all more particularly described in said Resolution of Intention and in the Engineer's report made pursuant thereto~ on file in the office of the Clerk of said District, to which reference is hereby made for a particular description thereof. Said parcels are more particularly described as follows: (a) An easement 10 feet wide over the easterly extension of Lakeview Avenue from Harris Avenue to U. S. Highway No. 50. (b) An easement 10 feet wide lying 5 feet on either side of the dividing line between Parcels 27-221-10 and 27-221-11, and thence easterly along the dividing line 'between Parcels 27-221-11, 27-221-12~ and 27-170-10, and 27-170-11~ County Assessor's Maps. (c) An easement l0 feet in width lying 5 feet on either side -- 2 -- of the line dividing Lots 243 and 2~4 of Bijou Pines Subdivision; thence easterly along the northerly line of Lot 244 to the easterly line of Bijou Pines Subdivision; thence northerly to the northerly line of 27-241-17; thence easterly along 27-2~1-17, 27-2~1-16, and 27-2~1-15, County Assessor's Maps, from Alder at Oak Avenues to Johnson Boulevard. (d) An easement IO feet wide lying 5 feet on either side of the dividing line between Parcels 25-371-O9 and 25-371-O5, County Assessor's Maps. (e) An easement 10 feet wide along a center line commencing in the center of the most northwesterly intersection of Lester Street, thence northwesterly to the southwesterly corner of the dividing line between Parcels 27-34~-30 and 27-344-31, County Assessor's Maps, thence northerly along said dividing line to Fairway Avenue. (f) An easement 20 feet wide for the full length of Ham Road through the unrecorded subdivision known as Ham Tract, from U. S. Highway No. 50 southerly about 625 feet to near the northerly end of Glenwood Way. (g) An easement 10 feet wide lying 5 feet on either side of Parcel lines commencing in Shirley Avenue at the center line of Parcel 27-113-10, County Assessor's Maps, thence along said center line northerly to Lloyd Avenue. (h) An easement l0 feet wide lying 5 feet on either side of a lot line commencing in Shirley Avenue, thence southerly to the northerly line of 27-203-10; thence easterly along the northerly line of 27-203-10 to the northeasterly corner of Parcel 27-203-10; thence southerly along the easterly line of 27-203-11 to the northerly line of 27-203-07; thence easterly along the northerly line of 27-203-07 to the N.E. corner of 27-203-O7~ thence southerly along the easterly line of Parcels 27-203-07, 27-204-07 and 27-204-26, County Assessor's Maps, to Meadow View Road. (i) An easement 10 feet wide lying 5 feet on either side of a line commencing immediately east of Lloyd Avenue, thence northerly along the westerly line of Parcel 27-O5~-10, County Assessor's Maps: to the southwesterly end of Meadow Edge Avenue. (j) An easement £o feet wide lying 5 feet on either side of the northeasterly line of Parcel 25-251-O5, County Assessor's Maps~ from the northerly end of Heather Lake Road F~tension to Meadow View Road. (k) An easement IO feet wide lying 5 feet on either side of the southerly line of Parcel 29-374-07 and the southwesterly portion of the southerly line of Parcel 29-374-09, County Assessor's Maps, extending southeasterly from Birch Road northwesterly of Chinokis Road. - 3- (i) An easement lO feet wide lying 5 feet on either side of the southeasterly line of Parcel 29-351-35 and lying ±o feet west of the easterly line of Parcel 29-351-12, County Assessor's Maps, extending from Glen Road to the northwesterly end of Cellador Road. (m) An easement lO feet wide lying 5 feet on either side of the easterly lines of Parcels 29-414-O3~ 29-414-O9, 29-4i~-10, and 29-414-11 and extending into Parcel 29-414-16, County Assessor's Maps, and extending southerly from Shepherds Drive easterly of Lost Sheep Lane. (n) An easement 10 feet wide lying ~ feet on either side of the southerly lines of Parcels 29-~14-13 and 29-414-15~ County Assessor's Maps~ and extending from Lost Sheep Lane to Larch Drive. (o) An easement IO feet wide lying 5 feet on either side of the rear lot lines of Parcels 29-413-O1, 29-413-O2~ 29-~13-12, 29-413-13~ 29-413-14, 29-413-15~ 29-~13-16~ and extending into Parcel 29-413-1~ County Assessor's Maps~ extending southerly from Shepherds Drive westerly of Lost Sheep Lane. (p) An easement 10 feet wide lying 5 feet on either side of the northerly line of Parcels 29-1~1-14 and 29-151-15, County Assessor's Maps, extending from Pioneer Trail to Aspenwald Road. (q) An easement 10 feet wide lying 5 feet on either side of the easterly lines of Parcels 27-1~5-O3, 2~-145-O6~ and 2'?-145-12~ County Assessor's Maps, and extending from Wildwood Avenue to Larch Avenue. (r) An easement lO feet wide lying 5 feet on either side of parcel lines commencing in the southwesterly portion of the southeasterly line of Parcel 27-1~3-10, thence southwesterly along the southeasterly lines of Parcels 27-163-o9~ 27-163-O~, 27-163-O7 and 27-163-O5~ County Assessor's Maps~ and thence continuing in a straight line along lot lines to Ski Run Boulevard. (s) An easement lO feet wide along the center of the entrance portion of Parcel 2~-o~1-£O~ County Assessor's Maps~ from Pioneer Trail Southeasterly about 150 feet. (t) An easement lO feet wide lying 5 feet on either side of the northeasterly line of Parcel 27-15t-21 and the center line of Parcel 27-151-17: County Assessor's Maps, and extending from Larch Avenue to Birch Avenue midway between Ski Run Boulevard and Mountain View Avenue. (u) An easement for the width of Johnson Boulevard, from U. S. Highway No. 50 to opposite Heavenly Valley Road. (v) An easement 10 feet in width the centerline of which is described as follows: Beginning at the southerly most point in the centerline of ~eninsula Meadows Road; thence southerly across the westerly portion of 25-020-57 to a point in the northerly line of Pioneer Park subdivision said point bearing S 77° 5~' E ll6.O feet from the northwesterly corner of Pioneer Park~ thence southerly across the easterly portion of 25-252-09 to a point in the northerly line of Rockwood Drive~ said point bearing N ~o OO' E 35.0 feet from the northeasterly corner of 25-2~2-O7~ County Assessor's Maps. (w) An easement lO feet in width lying ~ feet on either side of the westerly line of 27-321-01~ 27-321-02~ 27-322-01~ 27-322-1~ County Assessor's Maps, running southerly from Tamarack Ave. to Terry Lane. (x) An easement lO feet in width lying northerly of and adjacent to the northerly line of 26-023-O3~ County Assessor's Maps. (y) An easement 10 feet in width lying adjacent to and westerly and northerly of the easterly and southerly line of 26-023-06; adjacent to and southerly~ westerly and northerly of the southerly, westerly and northerly lines of 26-O61-12~ 26-O6t-13~ 26-061-1~, 26-O~1-1~ 26-O~1-16~ 26-O~1-17~ 26-061-21, and 26-O61-22~ County Assessor's Maps. (z) An easement 10 feet in width lying 5 feet either side of the westerly line of 26-061-22: County Assessor's Maps. (aa) An easement 10 feet in width lying westerly of and adjacent to 26-066-O2~ County Assessor's Maps. (bb) An easement 10 feet in width lying 5 feet either side of the southerly line of 2~-~1-1~ County Assessor's Maps. (cc) An easement lO feet in width lying northerly of and adjacent to the easterly prolongation of the southerly line of San Jose Ave.: said easement lying in the northerly portion of 26-072-O~: County Assessor's Maps.
