Resolution 2642 \., 1 2 3 4 5 6 \" 15 16 17 18 19 20 21 22 23 24 25 26 \. 27 RESOLUTION NO. 2642 A Resolution of the South Tahoe Public Utility District Declaring an Emergency, Authorizing Contracts without Bids, Delegating Authority to Order Emergency Action and Determining CEQA Exemption WHEREAS, the South Tahoe Public Utility District (District) is engaged in the production, storage, transmission, and distribution of water; and WHEREAS, approximately 300 feet of pipeline from Boulder Mountain Road to Forest Mountain tanks has been exposed due to the washout of the road shoulder on 7 Boulder Mountain Road; and 8 WHEREAS, with the line exposed, the ability to pump water to Forest Mountain and 9 Angora tanks is threatened and water supply to the residences of Angora Mountain is in 10 jeopardy; and 11 WHEREAS, the pipeline has been misaligned during the washout and is now 12 unsupported; and 13 WHEREAS, the water line to the Christmas Valley tank off of Snowflake Drive has 14 been exposed due to excessive runoff; and WHEREAS, the access road has been washed out and a portion of the water line has been exposed in a sink hole in the road; and WHEREAS, these events have eliminated access to the Christmas Valley tank, and also exposed the pipeline to that tank to potential future damage; and WHEREAS, access to several residences has also been cut-off on Snowflake Drive which will also require emergency repairs; and WHEREAS, the damage related to the pipeline going to Boulder Mountain Road and to Forest Mountain tanks, and the water line at Christmas Valley tank off of Snowflake Drive is an unexpected occurrence posing a clear and eminent danger which could lead to the loss or impairment of health, property and/or essential public services; and WHEREAS, substantial evidence has been provided to the District which demonstrates immediate action is necessary to prevent this loss or impairment, repair these facilities, and enter into agreements with contractors to perform such repairs 28 necessary to maintain service; and \. '-' ~ Resolution No. 2642 Page 2 WHEREAS, emergency projects are exempt from the requirements of the California 2 Environmental Quality Act (CEQA) pursuant to CEQA guidelines section 15269 and 3 15369. 4 NOW, THEREFORE BE IT RESOLVED AS FOLLOWS: 5 1. The damage to the pipeline at Boulder Mountain Road leading up to Forest 6 Mountain tanks, and at the water line for Christmas Valley tank off of Snowflake Drive is a 7 sudden, unexpected occurrence that poses a clear and eminent danger requiring 8 immediate action to prevent or mitigate the loss or impairment of health, property and 9 essential services and is therefore an emergency, 10 2. The emergency will not permit a delay resulting from a competitive 11 solicitation for bids. 12 3. Immediate actions directly related to the emergency, including repair or 13 replacement of the pipeline from Boulder Mountain Road to Forest Mountain tanks, and 14 the water line from Christmas Valley tank off of Snowflake Drive, and actions to procure 15 the necessary equipment, services and supplies are necessary to respond to the 16 emergency and shall be made without giving notice for bids to let contracts, 17 4. The General Manager of the District is hereby authorized and directed to 18 order any action necessary to respond to the emergency including repair or replacement 19 of the pipeline from Boulder Mountain Road to Forest Mountain tanks, and the water line 20 from Christmas Valley tank off of Snowflake Drive, and the procurement of any necessary 21 equipment, services and supplies, without giving notice for bids to let contracts. 22 5. Emergency repairs to the pipeline at Boulder Mountain Road to Forest 23 Mountain tanks, and the water line at Christmas Valley tank off of Snowflake Drive, are 24 necessary to maintain service and repair actions are necessary to mitigate the emergency 25 and are thus exempt from the requirements of CEQA. 26 6, This Resolution shall take effect immediately. 27 WE, THE UNDERSIGNED, do hereby certify that the above and foregoing 28 Resolution was duly and regularly adopted and passed by the Board of Directors of the Resolution No, 2642 Page 3 1 South Tahoe Public Utility District at a regular meeting held on January 2, 1997 by the \., 2 following vote: 3 4 AYES: Directors Jones, Mason, Wallace 5 NOES: None 6 ABSENT: Directors Strohm and Mosbacher 7 8 9 10 11 12 13 14 \., 15 16 17 ATTEST: 18 19 20 21 22 23 24 25 26 27 '" 28
