RESOLUTION NO. 2645
A Resolution of the South Tahoe Public Utility District
Declaring an Emergency, Authorizing Contracts without Bids,
Delegating Authority to Order Emergency Action
and Determining CEQA Exemption
WHEREAS, the South Tahoe Public Utility District (District) is engaged in the
collection, treatment and disposal of wastewater; and
WHEREAS, severe weather conditions and excessive runoff caused damage to the
the Upper Truckee River sewer line crossing behind Carrow's Restaurant; and
WHEREAS, these events have caused excess Inflow/Infiltration to enter the
8 system; and
WHEREAS, the District plugged off the one of the two parallel lines which restricts
the capacity of the sewer lines in the area serviced; and
WHEREAS, the entire Upper Truckee River sewer line crossing behind Carrow's
Restaurant needs to be repaired and protected from further damage; and
WHEREAS, it is possible most repairs can be done internally without excavation;
however, protection of the pipe may consist of driving sheet piling into the river and
backfilling behind the piling to protect the pipe; and
WHEREAS, the damaged relatg.d1o the Upper Truckee River sewer line crossing
behind Carrow's Restaurant is an unexpected occurrence posing a clear and imminent
danger which could lead to the loss or impairment of health, property and/or essential
19 public services; and
20 WHEREAS, substantial evidence has been provided to the District which
21 demonstrates immediate action is necessary to prevent this loss or impairment, repair
22 these facilities, and enter into agreements with contractors to perform such repairs
23 necessary to maintain service; and
24 WHEREAS, emergency projects are exempt from the requirements of the California
25 Environmental Quality Act (CEQA) pursuant to CEQA guidelines sections 15269 and
26 15369.

NOW, THEREFORE BE IT RESOLVED AS FOLLOWS:

Carrow's Restaurant is a sudden, unexpected occurrence that poses a clear and imminent
danger requiring immediate action to prevent or mitigate the loss or impairment of health,
property and essential services and is therefore an emergency.
2. The emergency will not permit a delay resulting from a competitive
5 solicitation for bids.

Immediate actions directly related to the emergency, including repair or
7 replacement of the Upper Truckee River sewer line crossing behind Carrow's Restaurant,
8 and actions to procure the necessary equipment, services and supplies are necessary to
9 respond to the emergency and shall be made without giving notice for bids to let contracts

The General Manager of the District is hereby authorized and directed to
11 order any action necessary and appropriate to respond to the emergency including repair
12 or replacement of the Upper Truckee River sewer line crossing behind Carrow's
13 Restaurant, and the procurement of any necessary equipment, services and supplies,
\., 14 without giving notice for bids to let contracts.

Emergency repairs related to the damage for the Upper Truckee River sewer
16 line crossing behind Carrow's Restaurant, are necessary to maintain service and repair
17 actions are necessary to mitigate the emergency and are thus exempt from the require-
18 ments of CEQA.
6. This Resolution shall take effect immediately,

South Tahoe Public Utility District at an regular meeting held on January 16, 1997 by the
