RESOLUTION NO. 2684-98
A Resolution of the South Tahoe Public Utility District
Declaring an Emergency, Authorizing Contracts Without Bids,
Delegating Authority to Order Emergency Action and
Determining CEOA Exemption
Upper Truckee River Sewer Line and
Original A-Line Crossing Emergency Repair
WHEREAS, the South Tahoe Public Utility District (District) is engaged in the collection,
7 treatment and disposal of wastewater; and
8 WHEREAS, high river flows caused exposure of the Upper Truckee River sewer line
9 and original A-Line crossings near the Upper Truckee Pump Station; and
10 WHEREAS, these events have caused the potential for damage to these two lines; and
11 WHEREAS, the entire sewage flow from the Meyers area flows through the gravity
12 sewer main in question; and
13 WHEREAS, the original export A-Line is a backup line to our new export line and thus,
14 should be maintained, and

WHEREAS, protection of the pipe may consist of diverting the river flow back into its
16 original channel, excavating and backfilling around the pipelines with concrete and lor rock
17 to protect the pipe; and
18 WHEREAS, the exposed Upper Truckee River sewer line and original A-Line crossings
19 near the Upper Truckee River Station is an unexpected occurrence, posing a clear and
20 imminent danger, which could lead to the loss or impairment of health, property and/or
21 essential public services; and
22 WHEREAS, substantial evidence has been provided to the District which
23 demonstrates immediate action is necessary to prevent this loss or impairment, repair these
24 facilities, and enter into agreements with river hydrogeologists and contractors to perform
25 such repairs necessary to maintain service; and
26 WHEREAS, emergency projects are exempt from the requirements of the California
27 Environmental Quality Act (CEQA) pursuant to CEQA guidelines sections 15269 and 15369.

3 NOW, THEREFORE BE IT RESOLVED, AS FOLLOWS:

The exposed Upper Truckee River sewer and original A-Line crossings near the
Upper Truckee River Pump Station is a sudden, unexpected occurrence that
poses a clear and imminent danger, requiring immediate action to prevent or
mitigate the loss or impairment of health, property and essential services and
is therefore an emergency.

The emergency will not permit a delay resulting from a competitive solicitation
for bids.

Immediate actions directly related to the emergency, including backfill and
concrete encasement of the Upper Truckee River sewer line and original A-Line
crossings near the Upper Truckee River Pump Station and actions to procure

the necessary equipment, services, and supplies are necessary to respond to
the emergency and shall be made without giving notice for bids to let contracts.
The General Manager of the District is hereby authorized and directed to order
any action necessary and appropriate to respond to the emergency including
backfill and concrete encasement of the Upper Truckee River sewer line and
original A-Line crossings near the Upper Truckee River Pump Station, and the
procurement of any necessary equipment, services and supplies, without giving
notice for bids to let contracts.

Emergency repairs related to the exposure of the Upper Truckee River sewer
line and original A-Line crossings near the Upper Truckee River Pump Station,
are necessary: to maintain service and repair actions, to mitigate the
emergency, and are thus exempt from the requirements of CEQA.
This Resolution shall take effect immediately.
