5 WHEREAS, the South Tahoe Public Utility District (District) is engaged in the

DECLARING AN EMERGENCY, AUTHORIZING CONTRACTS WITHOUT BIDS,
DELEGATING AUTHORITY TO ORDER EMERGENCY ACTION
AND DETERMINING CEQA EXEMPTION
(TAHOE KEYS PUMP STATION SEAL AND DISCHARGE VALVE REPLACEMENT)

6 collection and treatment of sewage; and

WHEREAS, there is a frozen valve preventing the replacement of a leaking seal
8
at the Tahoe Keys Pump Station; and

WHEREAS, the frozen valve and leaking seal need to be replaced to prevent a
11 sewage spill, and to protect the health and safety of the public as well as to protect
12 employee safety; and
13 WHEREAS, the leaking seal and frozen valve is an unexpected occurrence
\.., 14 posing a clear and imminent danger which could lead to the loss or impairment of
15
health, property and/or essential public services; and
16

WHEREAS, substantial evidence has been provided to the District which
demonstrates immediate action is necessary to prevent this loss or impairment, repair
18
19 these facilities, purchase replacement parts, and possibly enter into agreements with
20 contractors to perform such repairs necessary to maintain service; and
21 WHEREAS, emergency projects are exempt from the requirements of the
22 California Environmental Quality Act (CEQA) pursuant to CEQA guidelines sections
23

15269 and 15369.
NOW, THEREFORE BE IT RESOLVED AS FOllOWS:

The leaking seal and frozen valve is a sudden, unexpected occurrence
~ 27 that poses a clear and imminent danger requiring immediate action to prevent or
28 mitigate the loss or impairment of health, property and essential services and is

therefore an emergency.

The emergency will not permit a delay resulting from a competitive
3 solicitation for bids.

Immediate actions directly related to the emergency, including replace-
ment of the seal and valve and actions to procure the necessary equipment, services
and supplies are necessary to respond to the emergency and shall be made without
8 giving notice for bids to let contracts.
4. The General Manager of the District is hereby authorized and directed to
order any action necessary and appropriate to respond to the emergency including
repair or replacement of the seal and valve, and the procurement of any necessary
equipment, services and supplies, without giving notice for bids to let contracts.
5. Emergency repairs related to the leaking seal and frozen valve are necessary
to maintain service, and repair actions are necessary to mitigate the emergency and are
16 thus exempt from the requirements of CEQA.

This Resolution shall take effect immediately.
WE, THE UNDERSIGNED, do hereby certify that the above and foregoing
Resolution was duly and regularly adopted and passed by the Board of Directors of the

South Tahoe Public Utility District at a regular meeting held on September 16, 1999 by

the following vote:
